HomeMy WebLinkAbout2012-02 PCR Commissioner Parks introduced the following resolution and moved its adoption PLANNING COMMISSION RESOLUTION NO. 2012-02 RESOLUTION REGARDING THE RECOMMENDED DISPOSITION OF A REQUEST FOR FINAL PLAT APPROVAL OF EVANS NORDBY ADDITION SUBMITTED BY THOMAS J. WEBER ON BEHALF OF T.J. WEBER PROPERTIES, LLC WHEREAS, Thomas J. Weber on behalf of T.J. Weber Properties, LLC (Applicant), submitted Planning Commission Application No. 2011-019 to the City of Brooklyn Center, Minnesota (City) requesting approval of a preliminary plat of a subdivision to be titled Evans Nordby Addition, which is a replat of three contiguous parcels into one lot, for the benefit of the existing Evans-Nordby Funeral Home business, located at 6000 Brooklyn Boulevard; and WHEREAS, the Planning Commission held a duly called public hearing on November 17, 2011 at which time a staff report and public testimony regarding the preliminary plat of Evans Nordby Addition were received and the Planning Commission determined during its review that said preliminary plat was in general conformance with City of Brooklyn Center's City Code Chapter 15 —Platting; and WHEREAS, the Planning Commission adopted Planning Commission Resolution No. 2011-14, which recommended the City Council of Brooklyn Center approve the Preliminary Plat of Evans Nordby Addition, subject to certain conditions; and WHEREAS, the City Council considered Application No. 2011-019 at its December 12, 2011 regular meetings, and in light of all testimony received and the Planning Commission's recommendations, adopted City Resolution No. 2011-171, which approved the Preliminary Plat of Evans Nordby Addition, subject to the following considerations: 1. The final plat shall be reviewed and approved by the City Engineer; 2. The final plat shall be subject to the provisions of Chapter 15 of the City Ordinances; 3. The Owner/Applicant shall provide an updated certified abstract or title or registered property report to the City Attorney and City Engineer for review at time of final plat application; 4. The Owner/Applicant shall provide a 10-foot drainage and utility easement on all exterior lot lines; 1 of 3 RESOLUTION NO. 2012-02 5. The Owner/Applicant shall provide an additional sidewalk easement as illustrated on the revised plan set prepared by K.K. Design, dated 12/05/2011. Said easement shall be dedicated on the final plat or provided for under separate recordable document; 6. The Owner/Applicant shall remove the bituminous driveway section as illustrated on the K.K. Design plans (dated 12/05/2011), and install the landscaping and sod as indicated. Until the City repairs the sidewalk and removes the driveway apron in the right-of-way, the Owner/Applicant shall install a temporary barricade post with chain and/or planters to prevent vehicles from using the driveway access onto 60th Avenue North near this location; and WHEREAS, the City Engineer and City Attorney have also reviewed the final plat and found it to be in conformance with the previously approved preliminary plat and its conditions of approval; is in general conformance with City Code Chapter 15 — Platting; and determined to be acceptable; and WHEREAS, the Planning Commission considered the Final Plat of Evans Nordby Addition at its March 1, 2012 regular meeting, at which time a staff report and supporting documentation of said final plat was presented; and WHEREAS, the Planning Commission determined during its review that said final plat to be in general conformance with the approved preliminary plat, that all conditions have been or will be met by the Applicant prior to release by the City of the final plat for recording purposes; and the final plat is in general conformance with City Code Chapter 15 —Platting. NOW, THEREFORE, BE IT RESOLVED by the Planning Advisory Commission of the City of Brooklyn Center to recommend to the City Council of the City of Brooklyn Center, that the Final Plat of Evans Nordby Addition as submitted by the Applicant be approved, and the Mayor and City Manager are authorized to execute the final plat document on behalf of the City. 3-1 - i2 Date Chair � c ATTEST: Secretary 2 of 3 RESOLUTION NO. 2012-02 The motion for the adoption of the foregoing resolution was duly seconded by member Schonning and upon vote being taken thereon, the following voted in favor thereof: Chair Rahn, Commissioners Burfeind, Parks and Schonning and the following voted against the same: None whereupon said resolution was declared duly passed and adopted. 3 of 3
