Adjournment MINUTES OF THE PROCEEDINGS OF THE PLANNING COMMISSION OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA STUDY SESSION MARCH 1, 2012 CALL TO ORDER The Planning Commission meeting was called to order by Chair Rahn at 7:09 p.m. ROLL CALL Chair Rahn, Scott Burfeind, Michael Parks, and Stephen Schonning were present. Also present were Councilmember Carol Kleven, Director of Business & Development Gary Eitel, and Planning Commission Recording Secretary Rebecca Crass. Stan Leino and Kara Kuykendall were absent and excused. Carlos Morgan was absent and unexcused. APPROVAL OF MINUTES —February 16 2012 There was a motion by Commissioner Parks, seconded by Commissioner Schonning, to approve the minutes of the February 16, 2012 meeting as submitted. The motion passed. CHAIR'S EXPLANATION Chair Rahn explained the Planning Commission's role as an advisory body. One of the Commission's functions is to hold public hearings. FINAL PLAT OF EVANS NORDBY ADDITION — THOMAS J. WEBER, 6000 BROOKLYN BOULEVARD — (REQUEST TO ADOPT PLANNING COMMISSION RESOLUTION NO. 2012-02) Mr. Eitel presented the final plat for the "Evans Nordby Addition" which consists of combining three existing parcels into one for the business located at 6000 Brooklyn Boulevard (Evans Nordby Funeral Home). He added that the preliminary plat was approved by the Planning Commission at their November 17, 2011 regular meeting and this final plan does not require a public hearing. Mr. Eitel further explained that prior to this application, the Planning Commission normally reviewed just the preliminary plat and the final plat was typically reviewed and approved by the City Engineer and City Attorney, with City Council providing authorization and acceptance of said final plats under separate action. He noted that the procedural requirements of the subdivision ordinance does include the submittal of the final plat to the Planning Commission and that the Planning Commission may, at its discretion, submit a report to the Council. It is the recommendation of city staff that to comply with the subdivision ordinance that the Commission review the final plat and confirm with that the final plat is consistent with the approved preliminary plat. 3-01-12 Page 1 Mr. Eitel further explained that on December 12, 2011, the City Council considered the preliminary plat of Evans Nordby Addition, and adopted Resolution No. 2011-171 along with two additional conditions. He added that Mr. Weber has complied with the two conditions requested, which were an additional sidewalk easement in the southwest corner of the platted property and closure of the driveway in the southwest corner. Mr. Weber has complied with all items and the final plat appears consistent with the approved preliminary plat and meets all the requirements necessary for final approvals. Mr. Eitel stated that Staff recommends the Planning Commission adopt Planning Commission Resolution No. 2012-02, which recommends approval of the proposed Final Plat of Evans Nordby Addition. Commissioner Parks asked if there was an opportunity with this replatting to create safer sidewalks along Brooklyn Boulevard. Mr. Eitel explained that the Brooklyn Boulevard Corridor Study will look at the possibility of an expanded easement along sidewalks as that process moves along to enhance the corridor and improve pedestrian traffic safety. There was a motion by Commissioner Parks , seconded by Commissioner Schonning, to adopt Planning Commission Resolution No. 2012-02, which recommends approval of the proposed Final Plat of Evans Nordby Addition. Voting in favor: Chair Rahn, Commissioners Burfeind, Parks, and Schonning. And the following voted against the same: None The motion passed unanimously. DISCUSSION ITEMS REVIEW OF CONCEPT PLANS FOR MARANTHA HOMES/CARE CENTER EXPANSION PROJECT—5401, 15 69TH AVENUE NORTH Mr. Eitel introduced the conceptual plans for an expansion of the Maranatha Care Center located at 5401, 15 691h Avenue North. He explained that the site consists of two separate parcels split into two separate zoning districts (the west parcel is zoned R-6 Multiple Family Residence and the east parcel is zoned R-1 One Family Residence). He continued that the westerly parcel contains a four story, 64 unit senior apartment facility and the easterly parcel contains a 97 bed nursing home facility. Mr. Merkins with Presbyterian Homes presented the proposed project and stated that they have owned the property since 2009. He added that in 2009 they applied for a moratorium exception that allows for capital improvement sites that have proven to be non-functional. He further explained that there is currently a moratorium on nursing homes and no additional beds can be added. They received an exception award in 2009 and the project was put on hold due to economics. Mr. Merkins further explained that the process allows for construction to start within 360 months of the award and the exception ends on April 14, 2012. They have applied for zoning changes and other requirements to be met prior to the April 24th deadline. 3-01-12 Page 2 I Mr. Merkins explained that they are currently functioning as a congregate care facility. They were recently approved for a plan that tears down one wing, builds one phase of the project, then builds the second phase and moves the residents into private rooms. However, in the proposed plan, the existing building stays in its current configuration, the new building will be constructed where parking exists and then the old building will come down once residents are moved. He added that leaves space on the site for and independent living space two to five years out. Mr. Merkins stated that the current facility is very antiquated and the new facility will allow them to provide care by today's standards and will allow adequate space for residents with a neighborhood model. Mr. Merkins provided examples of how the new rooms will be laid out according to state regulations and for providing ease of care for residents. Chair Rahn asked about the timing and transition during construction. Mr. Merkins stated that traditionally they provide interim care and this will allow them to provide this in a single facility. However, it will be a few years before Phase I1 takes place and the area planned for that will be green space until the next phase of development takes place. Commissioner Parks asked about the possibility of sustainability on the site. Mr. Merkins stated that they use sustainable products during construction and will be doing storm water management that does not currently exist on the site and will be working with civil engineers to meet requirements on the site for appropriate water retention. Commissioner Parks stated that he would like to see the use of non-porous products and pavers in areas where there may not be a lot of snow removal and spread out the water on the site not just contain it. Mr. Merkins responded that they are getting soil borings on the site and will infiltrate water on the site where possible. He added that pavers can be troublesome for seniors walking; however, they have looked at rain gardens on the site. Burfeind asked about removal and relocation of the garages on the site. Mr. Merkins stated there are 12 to 13 garages on the space and they may have to leave a portion of the garages since some of the independent residents use them. Commissioner Burfeind stated that he would like to see some consideration if the garages are moved on the site bordering the single family home to the westerly side of the property. Mr. Eitel explained that this application is proposed to be before the Planning Commission on March 29, 2012 for a PUD/Rezoning public hearing. 3-01-12 Page 3 REVIEW OF REDESIGNED SITE LAYOUT PLAN OF PAUL HYDE'S (REAL ESTATE RECYCLING) 90,000 SF. OFFICE/MANUFACTURING/WAREHOUSE DEVELOPMENT ON THE FORMER LIFETIME FITNESS SITE—4001 LAKEBREEZE AVENUE NORTH Mr. Eitel explained that the Comprehensive Plan Land Use amendment relating to this site is currently being reviewed by the Metropolitan Council. He gave an overview of the revised proposed plan for the development of 4001 Lakebreeze Avenue North. Mr. Eitel added that the plan will be presented as a public hearing before the Planning Commission as a rezoning under a Planned Unit Development to a Mixed Use C-2/I-1 (Commerce/Industrial Park). This proposed rezoning will allow for an office/manufacturing/warehouse use on the site. SHINGLE CREEK CROSSING UPDATE Mr. Eitel reported that he recently had a discussion with Mr. Gatlin and he is ready to move forward with further redevelopment on the site. It is expected that plans will be before the Planning Commission in April for the food court and one of the junior box store tenants. OTHER BUSINESS BROOKLYN BOULEVARD STUDY UPDATE Mr. Eitel stated that a newsletter went out to residents regarding the Brooklyn Boulevard Corridor Study. He added that staff is meeting with the engineer working on the project tomorrow to begin developing concepts and strategies in the redevelopment and improvements along Brooklyn Boulevard. There was no other business. ADJOURNMENT There was a motion by Commissioner Parks, seconded by Commissioner Burfeind, to adjourn the Planning Commission meeting. The motion passed unanimously. Request: Final Plat of"Evergreen Villas" INTRODUCTION Brett Hildreth, on behalf of the 720 Company LLC, is seeking approval of a final plat titled "Evergreen Villas". This new addition will re-plat two existing parcels into two separate platted lots. The plat is located at 720 and 800 — 69th Avenue N. This final plat is being presented as a discussion item under this agenda and does not require a public hearing. BACKGROUND This final plat application is related to Planning Application No. 2011-018, which considered the preliminary plat of Evergreen Villas. The preliminary plat of Evergreen Villas was reviewed and recommended for approval by the Planning Commission at the October 27, 2011 regular meeting. The two parcels are 0.88 acres and 2.34 acres in size, respectively. The new Lot 1 will consist of 121,870 sq. ft. of area, or 2.8 acres, while Lot 2 will contain 11,584 sq. ft., or 0.27 acres. This plat also provides for the dedication of a small northerly section of land of the larger lot into additional 70th Avenue right of way, consisting of 6,994 sq. ft. The residence on Lot 2 will remain and all utilities have been relocated to insure they are not crossing over new lot lines. Mr. Hildreth's plans for redeveloping the larger vacant lot remain unknown at this time. Staff reaffirms our previous statement under the preliminary plat report that once the housing market rebounds, the city may expect a follow-up application from Mr. Hildreth or others on this site. The preliminary plat was approved by the City Council at the November 14, 2011 meeting, whereby City Resolution No. 2011-148 was adopted along with the following conditions: 1. The final plat shall be subject to review and approval by the City Engineer. 2. The final plat shall be subject to the provisions of Chapter 15 of the City Ordinances. 3. Prior to final plat approval, all encroachments into or over proposed lot lines shall be removed and verified. Evergreen Villas-FP Page 1 of 2 03-15-2012 4. No building permits shall be issued for any new dwellings until the plat has been given final approval by the City Council and filed with Hennepin County. 5. An updated certified abstract of title or registered property report must be provided to the City Attorney and City Engineer for review at the time of the final plat application (within 30 days of release of the final plat). 6. The Applicant shall provide a 10 foot drainage and utility easement on all exterior lot lines. 7. The Applicant shall provide a 5 foot drainage and utility easement on all interior lot lines. 8. Disconnect existing sewer and water services at the main on Lot 1, Block 1. 9. Cure swing set encroachment(move swing set to one side of the property line or the other, dependent on owner). 10. Dedicate 70th Avenue North as right-of-way including 2-ft behind the existing sidewalk on the final plat. 11. Install a new sanitary sewer service to 720 - 69t" Avenue that does not encroach on Lot 2 and remove the old service line. 12. The boundary and topographic survey must show the sanitary sewer and water service and material for the existing house. Most of these issues or items have been completed, or will be deemed complete as part of the of this final plat approval process performed by the City Engineer. For all intents and purposes, this is a fairly simple and standard final plat request. The new lots created will not impede any orderly growth of the neighborhood or cause any increased impact on local services. The final plat appears to meet all minimum requirements set forth under City Code Chapter 15 —Platting. RECOMMENDATION Staff recommends the Planning Commission adopt the attached Resolution No. 2012-03, which recommends approval of the proposed Final Plat of Evergreen Villas. The final plat shall be subject to review and approval by the City Engineer. 2. The final plat shall be subject to the provisions of Chapter 15 of the City Ordinances. 3. City staff is expected to meet next Tuesday, March 13th at City Hall with the SRF consultants and the Technical Advisory Committee to review the latest information and findings related to this ongoing corridor study. Planning may provide a verbal report or hand-out information at the March 15th PC meeting. Staff is also providing under this memo the text (verbatim) from the City's 2030 Comprehensive Plan that addresses the Brooklyn Boulevard Corridor. This section is taken from Chapter 2 — Land Use, Redevelopment and Community Image Plan of said Plan, and provides the background statements and basis for the City's need to study this important urban corridor: BROOKLYN BOULEVARD CORRIDOR Brooklyn Boulevard is a six-mile long County road running parallel with County Road 81 and serving as a reliever minor arterial to that roadway. The Boulevard runs between County Road 81 in Brooklyn Park and the 44th Avenue North/Penn Avenue intersection in north Minneapolis. In the regional transportation system, it provides an alternative connection to Minneapolis and the central city from suburbs to the north and west. Average daily traffic on the 3.5-mile stretch of Brooklyn Boulevard located in Brooklyn Center varies between 18,700 south of Highway 100 to 40,700 just north of 1-694/1-94. Much of the roadway north of 1-694/1-94 in Brooklyn Center and Brooklyn Park has been improved to better accommodate the significant traffic volume and to facilitate adjacent redevelopment. The function of Brooklyn Boulevard within the regional transportation system conflicts with its function of providing access to residents of and shoppers in this part of Brooklyn Center. The section south of 1-694/1-94 is lined with many single-family dwellings that access directly onto the Boulevard, causing traffic problems. These single family units are too close to the street given the level of traffic carried by the street. In addition, the streetscape in this section of the Boulevard has a negative visual image and lacks aesthetic appeal. Brooklyn Boulevard has been extensively studied over the years, including in the 1979 Comprehensive Plan, the Brooklyn Boulevard Redevelopment Study (1993) and the Brooklyn Boulevard Streetscape Amenities Study (1994). The Brooklyn Boulevard Redevelopment Study is a set of project recommendations for land use and redevelopment, traffic circulation, parking and design and was intended to guide future decisions regarding redevelopment of the corridor. It contains an illustration of a proposed treatment for the section of the Boulevard south of 1-694/1-94. The Brooklyn Boulevard Streetscape Amenities Study proposed an overall design theme for the public right-of-way of Brooklyn Boulevard, along with redevelopment plans for specific sites. Several detailed studies were prepared for specific sites, including at least two alternative site plans to illustrate the application of different design principles. Specifically recommended design themes should be implemented to encourage growth and provide the community with a greater sense of pride. Streetscape Amenities Study have generally been incorporated into the Comprehensive Plan, but the City continues to consult the studies for further, more detailed, advice. The City Planning Commission should develop overall strategies to implement agreed upon design recommendations from these studies favorable to the community's image objectives. The land-use and redevelopment themes of both studies, broadly stated, recommend gradually eliminating the remaining inappropriate single-family units along the Boulevard. Further, both studies recommend replacing the single-family units with either commercial and office/service uses on sites that are large enough to provide for adequate circulation and good site design or with high- and medium-density residential uses. Generally, they recommend that the central segment of the corridor be used primarily as a commercial district while the balance of the corridor is devoted primarily to either higher-density housing or single-family housing south of Highway 100. Some neighborhood service and retail functions should be promoted at 58th Avenue, 63rd Avenue and 69th Avenue. Additional multi-modal and transit amenities should be considered along Brooklyn Boulevard due to its multiple purpose and function to both the City and the region. Bus pull-offs and better bus shelters should be provided to upgrade this transit corridor. Positive changes have occurred on Brooklyn Boulevard, including the reconstruction of the Boulevard north of 1-694/1-94, redevelopment of the Culver's restaurant commercial center at 69th Avenue, and redevelopment of the CVS drug store at Bass Lake Road. Reaching consensus on a vision for the section of Brooklyn Boulevard south of 1-694/1-94 that would then be translated into design parameters should precede redevelopment of land area along the Boulevard. Three basic alternatives exist for the reconstruction design of this section of the Boulevard: • Use the current design; • Create a landscaped boulevard between the roadway and the sidewalk; or • Widen the landscaped boulevard to create a greenway within which the walkway would meander, similar to 53rd Avenue N. adjacent to the Bellevue Housing project. Upgraded multi-modal transit amenities could be provided to improve the function and safety of the corridor. Hennepin County should be engaged in the consensus-building process since Brooklyn Boulevard is a County road. Reaching consensus on vision and design will answer the following questions that need to be answered before redevelopment land use decisions can be made: • How much right-of-way will be needed in the reconstruction of Brooklyn Boulevard? • How far should the roadway be situated from residential structures? The Metropolitan Council should also be engaged in the consensus building process to implement design recommendations for transit shelters in the Brooklyn Boulevard Streetscape Amenities Study. There is no required or recommended action by the Planning Commission on this item.
