number 69049 regarding special use permit for a nursing home.
We have come to the conclusion, in view of the limited size of the
proposed site, it would be economically unfeasible to profitably
operate a nursing home with the number of beds that we probably
would get on such a site.

Dear Mr. Poss:
Enclosed is the original and one copy of an Agreement between the City and
the owner of the above captioned property which will allow us to remove the
building without court proceedings.
According to the statute, we need only obtain the consent of the property
owners of record, but since I had discussed this matter with the property
owner's daughter in terms of an agreement between her mother and the City,
I think it would be a good idea if you would sign the copy and return it to
me so that I could forward it to the daughter. If you would then pass the
original along to Mr. Murphey he could go ahead with the removal of the
building.

Dear Mr. Herman:
Enclosed is the original of a proposed Escrow Agreement which I will re-
commend to the City Council, and a copy of the Density Credit Ordinance
in the form which I believe it will finally take.
This Escrow Agreement is forwarded to you with the understanding that
your client will proceed immediately with obtaining approval of Site and
Building Plans by the Brooklyn Center Planning Commission, and that
such Plans will then be forwarded to the City Council for final approval.
D It is my judgment that the final action on Rezoning Application 68018 will
probably reach the Council table at the same time that the application for
Site and Building Plan approval is heard.
If this procedure and the Escrow Agreement is acceptable to your clients,
please have them sign the document and return it to me. Upon receipt
of the signed document we will consider the Escrow Agreement to be in
effect. In addition to the stipulation set forth in the Escrow Agreement,
the City will acquire immediate possession of the property conveyed in
accordance with Paragraph 3 of your letter of April 17, 1969.
Assuming that the final action on the rezoning and the Site and Building
Plan approval is carric-d out at the same meeting, I believe the difficulties
which we previously discussed will be eliminated.

There is herewith delivered to you a deed dated the 17th day of

April, 1969, and signed by Malcolm W. Glad and Alfred J. ' 'Miller, in
their capacities as officers of Glad and Miller Construction Co. , grant-
ors, and running to the City of Brooklyn Center, as grantee, a copy of E
which deed is attached hereto and made a part hereof by reference.
The aforementioned deed is to be delivered to the City of Brooklyn
Center upon the occurrence of the following events:

1. The granting by the City Council of the City of Brooklyn {
Center, to Glad and Miller Construction Company, of 1

Amendment §35-400 (c) (d) and (e).

3. The granting of building permits for the construction

If at any time prior to the approval of Site and Building Plans by

its request for Density Credits, its application for Site and Building Plan
