I have searched Chapters 15 and 35 and nowhere is this claim disallowed. originally R.L.S. 235 and Twin Labe Woods were government lot 1 and as such individual property ownership extended into the bed of Twin Lake with riparian I rights below the high water mark reserved to the State of Minnesota, When Government Lot 1 was subdivided, the lake bed, contained within the individual lot lines extended, remained part of these individual lots. This point, &* made in answer to the platting ordinance requiring 9500 sq. feet of lot area. This requirement is good in areas of high density problems, however, these problems do not exist in this case as long as side yard and set back requirements are met. The acres and acres of open space, lake, and use available to these lots provide them area far in excess of the 9500 sq. feet minimum. 6. Section 601 allows that platted lots with area 70% of 9500 sq. feet be issued building permits. It is discriminatory to allow others this right and not us. The above facts are not meant to be contradictory but rather state our position. W feel that the conditions affecting this property are such that in refusing to issue two building permits for Tracts A. and B. the Council would deprive us of the reasonable use of our land. We feel we are within our rights in requesting this and that the granting of our request by the Council will not be detrimential to the public welfare or injurious to the adjoining property. Bather, it will assist' in improving this property to the benifit of the surrounding area and the Village: as a whole. A letter similar in nature was presented to the Council in April. In answer to the first question, it is our opinion that the Village can enter into such a lease agreement. There have been numerous situations where municipalities have been allowed to lease municipal property which is not currently needed for municipal purposes. Some examples of this are where the municipality may lease a civic auditorium to a private corporation for showing moving pictures or the use of a civic building for private dinners or other functions. In answer to the second question, it would probably be well to have a month-to-month lease which would be terminable upon a month's notice. This agreement should contain a "hold harmless clause" which would pro- tect the Village from any liability, as well as any costs of defense on any lawsuit arising out of the use of the property by the non-profit corporation. In answer to the third question, it seems to me that the clear intent of Section 35-310 when paragraphs 1 e. and 3 h. are taken together is that this kind of use should be permitted. To make it clear, however, it might be well to amend Section 3 h. to read "unlighted ball parks not operated for profit."
