This agreement, made this day of G- , 1972, by and between
Bergstrom Realty Co. , a Minnesota Corporation, party of the first part, and
Transcontinental Development Corporation, a. Minnesota Corporation, party of
the second part,
WITNESSETH
WHEREAS, the party of the first part is the owner of a parcel of land,
herein after referred to as Parcel "A", located in the County of Hennepin
and State of Minnesota. described as follows, to-wit:
That part of Lot 2, Block 1, lying East of the West line of
Lot 48 Auditors Subdivision number 310, Hennepin County, Minnesota,
the West line of the aforementioned Lot 48 having been marked by
J'udical land marks placed at the Southwest corner of said Lot and
at a point in said line 33 feet South of the Northwest corner of
said Lot, High Crest Square, according to the plat thereof on file
and of record in the office of the Registrar of Titles in and for
said Hennepin County.
The boundaries of Hi Crest Square being marked by Judicial Landmarks.
WHEREAS _, the party of the second part is the owner of a parcel of land,
hereinafter referred to as Parcel "B", located in the County of Hennepin and
State of Minnesota, described as follows, to-wit:
Tract A, B, and C, Registered Land Survey 1312, according to the
plat thereof on file and of record in the office of the Registrar
of Titles in and for said Hennepin County.
WHEREAS _, it is the desire of the party of the first part and the party of
the second part to share a common driveway easement for the benefit of Parcels
"A" and "B".
Now, Therefore, in consideration'of the mutual covenants and grants herein-
, after set forth, the parties hereby agree as follows:
1. The party of the first part does hereby grant, remise and relinquish to
the party' of the second part a non-exclusive permanent easement of way
for ingress and egress over the following described portion of Parcel "All,
to--wit:
The Westerly 15 feet, measured at a right angle to the West line
of the heretofore described Parcel "A".
The easement shall be for the benefit of Parcel "B" and shall run with said
benefited property.
2. The party of the second part does hereby grant, remise and relinquish to
the party of the first part a non-exclusive permanent easement of way for
ingress and egress over the following described portion of Parcel "B",
to-wit:
Tract C, and the Easterly 15 feet, measured at a right angle to
the East line of the heretofore described Parcel "B".
The easement shall be for the benefit of Parcel "A" and shall run with said
benefited property.

Gentlemen:
In conjunction with Volp Construction Co. , the undersigned has
submitted plans and specifications for the construction of a
convenience food store at the approximate location of Brooklyn
Boulevard and 69th Avenue North. Accompanying our plans and
specifications was a request for a building permit.
I was recently informed that the planning commission expects to
impose certain restrictions on the construction as a condition
of issuing a building permit. Specifically, we will be requested
to install lawn sprinklers, very expensive landscaping, and black-
topping, and concrete curbs. Also a connection to the storm sewer
and water main which had not been contemplated, and a sprinkler
system on the interior of the building.
The purpose of this letter is to inform you that we are unable
to construct this building in your Village if we must comply
with all the requirements suggested by the planning commission.
We would like to withdraw the plans submitted by Volp Construct-
ion Co. with the above requirements.
Additional costs involved because of these requirements, make
it impossible for our company to pay occupancy costs of this
construction.
