4. Chairman's Explanation: The Planning Commission is an advisory body. One
of the Commission's functions is to hold public
hearings. In the matters concerned in these
hearings, the Commission makes recommendations to
the City Council . The City Council makes all final
decisions in these matters.

• Location: Shingle Creek Parkway and Xerxes Avenue North
Request: Preliminary Plat
The applicant requests preliminary plat approval to subdivide the property at
the corner of Shingle Creek Parkway and Xerxes Avenue North which is presently
described as Outlot E, Twin Cities Interchange Park Addition. The land is
currently zoned R3 and is surrounded by Shingle Creek Parkway on the north,
Xerxes Avenue North on the east, I-94 on the south, and "Old" Xerxes Avenue
North on the west. The applicant requests rezoning to Cl of Lot 1 , Block 1 ,
Earle Brown Farm Estates 1st Addition under Application No. 81022. Blocks
2, 3, 4 and 5 comprise Phase 1 of the proposed Earle Brown Farm Estates
townhouse development. In addition, the plat designates five additional
parcels as Outlots A through E.
The proposed plat shows a 60' right-of-way for the extension of Freeway
Boulevard west and north to an intersection with Shingle Creek Parkway. It
does not show, however, the dedication of additional right-of-way for Shingle
Creek Parkway at the north tip of the property. (The intersection at Shingle
Creek Parkway and 69th Avenue North may, in the future, be modified so that
69th Avenue, west of Shingle Creek Parkway, will lead directly into Shingle
Creek Parkway rather than into 69th, east of Shingle Creek Parkway)
Easements are indicated for the NSP power lines along the west edge of the
property and for City storm sewer through the north end of Phase 1 .
• The proposed plat does not show an easement for public sidewalk which follows
the south and southeast property lines of Outlot C of the preliminary plat to
the extension of Freeway Boulevard. The preliminary plat should be revised
to indicate this easement. It could also be revised to designate Outlot C
as Outlot B and vice versa so that there is continuity in the sequence of
outl'ots as they abut one to another. (This may be a concern of the County
rather than the City) . It is not necessary that the sequence of construction
follow the sequence of the outlots.
In general , the plat seems to be in order and approval is recommended subject
to the following conditions:
1 . The final plat is subject to approval by the City Engineer.
2. The final plat is subject to the �provtstons of Chapter 15 of
the City Ordinances.

3. Homeowners Association documents for Phase 1 are subject to
approval by the City Attorney prior to final plat approval .
4. The preliminary plat shall be revised prior to consideration by
the City Council to indicate: Poway
public sidewalk easement in the appropriate location; a water
main easement in the appropriate location;

Request: Site and Building Plan
The applicant requests site and building plan approval to construct 14 townhouses
in Phase 1 of the Earle Brown Farm Estates located at the north end of the
property which is east of Xerxes and south of Shingle Creek Parkway. In con-
nection with Phase 1 , the applicant has submitted a master plan for 100 town-
house units covering six phases on 14.66 acres of land. Phase 1 will abut
Shingle Creek Parkway on the north, newly dedicated Freeway Boulevard on the
east, Phase 2 on the south and Earle Brown Patio Homes on the west. Access to
the development will only be available off the newly dedicated portion of
Freeway Boulevard.
The density of the entire townhouse development will be 6,388 sq. ft. per unit,
well in excess of the 5,400 sq. ft. per unit required under the Zoning -Ordinance.
Each unit will have at least one enclosed garage stall and one outside parking
space. In addition, there are 25 visitor parking stalls scattered throughout
the entire master plan area.
Phase 1 will consist of five three-bedroom units and nine two-bedroom units.
The Master Plan calls for 40 three-bedroom units and 60 two-bedroom units.
Three bedroom units are 1 ,272 sq. ft. gross floor area and two-bedroom units
are 1 ,062 sq. ft. gross floor area. For both types, bedrooms are located
upstairs. The exterior treatment will be painted hardboard lap siding similar
to the Marvin Gardens Townhouses at 68th and Orchard,Avenues.
Landscaping for the entire site will include 15 large shade trees (6" diameter
• per ordinance requirements) including Marshall Ash, Sugar Maple, etc. Thirty
smaller shade trees such as Skyline Locusts and Greenspire Lindens and 100
decorative trees such as Russian Olives and Radiant Crabs will also be provided.
In addition, 36 coniferous trees such as Black Hills Spruce and Scotch Pines
are shown on the landscape plan. The plan calls for 4' to 6' berms along the
entire westerly property line to provide some screening from the single-family
homes to the west. Berms 4' to 6' in height are also provided intermittently
along Freeway Boulevard, Shingle Creek Parkway and Xerxes Avenue North. All
green areas on the site will be sodded.
Drainage from Phase 1 will be conveyed by 15' wide RCP pipe to the storm
sewer in .Shingle Creek Parkway. There will also be a holding pond at the
southeasterly corner of Phase 1 which will accommodate drainage from Phases
2 and 3. Drainage from the southerly portion of the development will be
collected into a holding and adjacent to Xerxes Avenue North. The holding

pond will drain into a 21 " diameter storm sewer leading to City storm sewer
at Freeway Boulevard and Xerxes Avenue North. The plans at present do not
show curb and gutter around common parking and driving areas. This should
be added to the plan prior to approval .
Subsequent approvals for the additional phases will require preliminary plat
approval and site and building plan approval by the City prior to issuing
building permits. Site plan approval will consist of verification of the
individual phase development plans with the master plans. Any change will be
subject to City approval .

All together, the plans are generally in order and approval is recommended,
subject to the following conditions:
1 . Building Plans are subject to review and approval by the Building
Official with respect to applicable codes prior to the issuance
of permits.
2. Grading, drainage and utility plans are subject to review and
approval by the City Engineer prior to the issuance of
permits.
3. A Performance Agreement and supporting financial guarantee
(in an amount to be determined by the City Manager) shall be
submitted to assure completion of approved site improvements
for Phase 1 prior to the issuance of building permits. -
4. Any outside trash disposal facilities shall be appropriately
screened from view.
5. All common parking and driving are hall be surrounded by

6. Plan approval acknowledges a Master Plan for all phases of +
the Earle Brown Farm Estates townhouse project. However,
each additional phase is subject to preliminary plat approval
and site and building plan approval by the Planning Commission
and City Council .
7. The developer shall take adequate measures to control dust and
debris during construction. A viable turf shall be established
and maintained in areas subject to future development.
