4. Chairman's Explanation: The Planning Commission is an advisory body. One
of the Commission's functions is to hold public
hearings. In the matters concerned in these
hearings, the Commission makes recommendations to
the City Council . Tne City Council makes all final
decisions in these matters.

Request for preliminary plat approval for the Lutheran Church
of the Master site and the single family residence to the east
at 1200 and 1120 - 69th Avenue North, respectively.
6. Gittleman Corporation 80045
Request for site and building plan approval to rebuild four
garages destroyed by fire and a small parking lot at Apart-
ment No. 19 at Twin Lake North' Apartments, 4500 - 58th
Avenue North.

Request for a variance from the Sign Ordinance to allow a

Applicant: Lutheran Church of the Master
Location: 1200 - 69th Avenue North
Request: Preliminary Plat
The applicant requests preliminary plat approval of "Evangelical Lutheran Church
of the Master" addition which consists of two lots: lot one for the church and
lot two for the single-family residence which heretofore has been the church
parsonage. The properties are addressed 1200 and 1120 - 69th Avenue North and
are bounded by 69th Avenue North on the south, apartment buildings on the west,
70th Avenue North on the north and Emerson Avenue North, Emerson Lane, and
some smaller apartments on the east. The plat is proposed in accordance with
the site and building plan approval granted by the City Council , under Appli-
cation No. 80025 for the addition of a fellowship hall . Both lots are zoned
RI and meet ordinance requirements. A storage shed located just over the
property line separating the two lots should be relocated to meet setbacks.
As this property is presently unplatted, no right-of-way dedication has been
made for 70th Avenue North. That dedication is being made with the proposed
plat. Consistent with other replats of property along 69th Avenue North, it is
recommended that 7 feet of additional right-of-way for 69th Avenue North be
dedicated with this plat.
In other respects, the proposed plat is in order and approval is recommended,
subject to at least the following conditions:
1 . The final plat is subject to approval by the City Engineer.
2. The final plat is subject to the requirements of Chapter 15
of the City's Ordinances.
3. The plat shall be modified, prior to final plat approval , to
indicate dedication of 7 feet of additional right-of-way
along 69th Avenue North.
4. The storage shed on the northwest portion of lot 2 shall be
relocated in a manner to meet setback requirements for
accessory structures prior to final plat approval .
A public hearing has been scheduled and notices have been sent.

Applicant: Gittleman Corporation
Location: 4500-90 - 58th Avenue North
Request: Site and Building Plan
The applicant requests site and building plan approval to rebuild four garages
destroyed by fire on June 14, 1980, and to complete a small parking lot adjacent
to the garages. The project is in the area of Apartment No. 19 at the Twin Lake
North Apartment complex.
Since the garages and the parking lot are not adjacent to any public right-of-way,
no setback or greenstrip requirements apply. The primary concerns of staff are
that the parking area be surrounded by B612 curb and gutter and meet ordinance
requirements for dimensions; also that the garages, which are attached to Apart-
ment No. 19 be built with fire stops to keep smoke from. infilt.rating the residential
building. The proposed parking area does meet ordinance standards and the appli-
cant has agreed to install fire stops not only in the garages to be rebuilt, but
in all the other garages in the complex as well .
Exterior treatment of the garages will be consistent with the remainder of the
complex.
The plans seem to be in order and.approval .is therefore, .recommended subject to at
least the following conditions:
1 . Building plans are subject to review and approval by the Building
Official prior to the issuance of permits.
2. Grading and drainage plans are subject to approval by the City
Engineer prior to the issuance of building permits.
3. A performance agreement and supporting financial guarantee (in
an amount to be determined by the City Manager) shall be sub-
.nitted to assure completion of approved site improvements.
4. ' Fire stops shall be installed in all garages in the Twin Lake
North Apartment complex prior to release of the performance
guarantee.
5. B612 curb and gutter shall be provided around the new. parking
lot.
6. The parking lot surface shall meet the minimum requirements of
the Zoning Ordinance and be appropriately stripped.

Applicant: A.F.I.A. Associates
Location: 5901 John Martin Drive
• Request: Variance
The applicant has submitted a request for a variance from Section 34-140:2,1 (4)
of the Sign Ordinance to allow a 25 sq. ft'. wall sign for real estate purposes
rather than the 5 sq. ft. maximum permitted by the Sign Ordinance. The
application was considered and tabled by the Planning Commission at, its September
11 , 1980 meeting. The Commission is referred to the minutes and the staff report
for that meeting for a discussion of the merits of the variance.
Since the tabling of the application, the staff have developed and the Commission
has refined the attached ordinance amendment.
RECOMMENDATION
It is recommended that the Planning Commission, by motion, recommend denial of
Application No. 80033 on the grounds that the Standards for Variances are not
met. It is also recommended that the Commission take action to recommend
adoption of the proposed ordinance amendment.
We will be prepared to review the ordinance in more detail and answer. questions
at Thursday evening's meeting.

Applicant: , K-Mart Corporation
Location: 3600 - 63rd Avenue North
Request: Special Use Permit
This application was before the Planning Commission at its October 9, 1980 meeting
and was tabled at that time until certain revisions in the plan are completed. The
applicant's representative stated then that the gas station on the site will be
owned by K-Mart, but leased to a separate operator. Therefore, the permit to be
issued under this application will only authorize operation of the auto center.
We have not as yet received a complete revised plan. Rather, the applicant is
expected to submit a red-lined plan showing the revisions required by the Planning
Commission. These include the following:
1 . Underground irrigation along the north greenstrip area.
2. Closing of at least one entrance to Brooklyn Boulevard and
possibly the westerly entrance to 63rd Avenue North.
3. The planting of a hedgerow 2a' to 3' in height in the greenstrip
along Brooklyn Boulevard and along 63rd Avenue North.
4. Opaque fencing 6' high along the property line shared with the
apartments to the north.
• 5. Installation of B612 curb and gutter along the north side of the
parking lot.
6. The planting of taller growing trees, 22" to 3" in diameter at
40' intervals along the north greenstrip and along the north t
end of the east greenstrip. s
7. Repainting of ductwork along the north. side of the building.
8. More landscaping around the gas station.
9. Improve the drainage pattern on the site.
10. Make other necessary repairs to the building and barrier walls
on the site.
In addition to these revisions, the applicant has indicated a willingness to close
the south curb opening along Brooklyn. Boulevard. Staff have discussed the K-Mart
site with representatives of MN/DOT and a formal written recommendation should
be forthcoming by Thursday night.'s meeting. Beyond the closing of the south curb p
opening, it has been recommended that the middle entrance be redesigned to face
the Boulevard at a 900 angle;and that the City consider the closing of the westerly
curb opening along 63rd Avenue North.
It should also be noted that the restriction on the hours of operation at the auto
Scenter apply to service of vehicles only. Sales may continue during the hours
the K-Mart store is open.

If the Planning Commission deems the plans to be satisfactory, at least the follow-
ing conditions are recommended:
1 . Building plans are subject to review and approval by the Building
Official with respect to applicable codes prior to the issuance
of permits.
2. Grading, drainage and utility and landscaping plans are subject
to approval by the City Engineer prior to the issuance of permits.
3. A performance agreement and supporting financial guarantee (in
an amount to be determined by the City Manger) shall be submitted
to assure completion of approved site improvements prior to the
,.issuance of permits. This guarantee will not be released until
the proposed plat is finaled and filed with the County.
4. All outside trash disposal facilities and mechanical equipment
shall be screened from view to the maximum extent possible.
5. . The special use permit for the automotive service center is
issued to K-Mart as the operator of the facility and is non-
transferable.
6. The special use permit is subject to all- applicable codes,
ordinances and regulations including special licensing require-
ments and violation thereof shall be grounds for revocation.
7. Plan approval is exclusive of all signery which is subject to
Chapter 34 of the City Ordinances.
8. An underground irrigation system shall be installed -in all
landscaped areas to facilitate site maintenance.

11 . The hours for providing service to vehicles shall be from 8:00
a.m. to 9:00 p.m. , Monday through Friday- and 10:00 a.m. to 6:00
p.m. Saturday. No service shall be performed on Sunday. Sales
of automotive products shall be during the same hours as the
rest of the K-Mart store.

The applicant requests preliminary approval- for a new R.L.S. combining the three
existing tracts which make up the old Shopper's City site into one parcel . This
parcel and all uses operating on the site are under the single ownership of K-Mart
Corporation. Replatting the land into a single parcel is a requirement of Section
35-540 of the Zoning Ordinance.
The plat is in order as submitted and approval is recommended, subject to the
following conditions:
1. The final plat is subject to Chapter 15 of the City Ordinances.
2. The final plat is subject to approval by the City Engineer.

AN ORDINANCE AMENDING CHAPTER 34 REGARDING DIRECTIONAL SIGNS: CERTAIN
REAL ESTATE SIGNS: AND IDENTIFICATION SIGNS FOR CHURCHES, SYNAGOGUES
AND TEMPLES
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS:
Section 1 . Chapter 34 of the City Ordinances of the City of Brooklyn Center
is hereby amended as follows:
Section 34-140, Subdivision 2. Permitted Signs Not Requiring a Permit.
b. Wall and freestanding site, pedestrian, vehicular-traffic,
[and] parking [directional signs as appropriate] and other
appropriate types of directional signs as approved by the
Zoni nq_Official , provided such signs are less than [thirty-six
3b)] sixteen (16) square feet in area, and have a height no
greater than 15 feet or ground floor height, whichever is less.
1 . Real Estate signs as follows:
[(3) Wall signs for the purpose of leasing or selling dwelling
uinits in buildings .containing two (2) or more units provided
such signs shall .be limited.to five (5).�&quare feet. in area
and to one (1 ) such sign per.building.]
[(4) Wall signs for the purpose of leasing portions of commercial
or industrial buildings, such as offices or individual tenant
areas, shall be limited to five (5) square feet in area and
to--one (1 ) such sign per wall facing a major thoroughfare.

units in buildings containing two 2 or more units and

of commercial or industrial buildings, such as offices or in-
dividual tenant areas are permitted only when vacancies exist
and are limited to walls facing public streets. The size of

(a) For buildings with a wall area of 1 ,000 sq_. ft. or less
