HomeMy WebLinkAbout1983 11-10 PCM i MINUTES OF THE PROCEEDINGS OF THE PLANNING COMMISSION OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA REGULAR SESSION NOVEMBER 10, 1983 CITY HALL CALL TO ORDER The Planning Commission met in regular session and was called to order by Chairman George Lucht at 7:32 p.m. ROLL CALL Chairman George Lucht, Commissioners Molly Malecki , Mary Simmons, Nancy Manson and Lowell Ainas. Also present were Director of Planning and Inspection Ronald Warren, Assistant City Engineer James Grube, and Planning Assistant Gary Shallcross. Chairman Lucht noted that Commissioners Sandstrom and Versteeg had called to say that they would be unable to attend the evening's meeting and were excused. APPROVAL OF MINUTES - October 20, 1983 Motion by Commissioner Manson seconded by Commissioner Simmons to approve the minutes of the October 20, 1983 Planning Commission meeting as submitted. Voting in favor: Chairman Lucht, Commissioners Simmons. and Manson. Voting against: none. Not voting: Commissioners Malecki and .Ainas. The motion passed. APPLICATION NOS. 83051. and 83052 (Normandale Tennis Clubs, Inc. ) Following the Chairman is explanation, the Secretary introduced the first two items of business, a request for site and building plan approval to construct a racket and swim club on the 7.4 acre : - area of land at the southeast corner of Lakebreeze and Azelia Avenues and preliminary plat approval to combine the same property into a single parcel. The Secretary reviewed the staff reports for these two applications (See Planning Commission Information Sheets for Application Nos. 83051 and 83052 attached) . The Secretary briefly discussed with the Commission the possibility of a link between Lakeside and Lakebreeze Avenues or Lakeside and France Avenues. He stated that such a link could still possibly be provided via Azelia Avenue or within Highway 100 right-of-way if the tennis club were approved. The Secretary briefly reviewed reasons as to why he felt Highway 100 would probably not be upgraded in the foreseeable future. Commissioner Ainas asked whether the project could be expedited if the MN/DOT district engineer gave the City a letter that no MN/DOT permits would be required for the project. The Secretary explained that no permits were required from MN/DOT at present. He explained that MN/DOT had been notified regarding the plat as is customary procedure. He stated that the City received a written comment from MN/DOT suggesting that accommodation be made for a link between Lakeside and Lakebreeze in light of the possibility that the signals would be removed at Indiana Avenue. The Secretary stated that the staff felt there must have been confusion because this was contrary to the position taken by MN/DOT in 1980. He explained that MN/DOT has, in fact, changed its position.. since 1980, but added that the letter from MN/DOT is only a suggestion. Chairman Lucht asked the applicant whether he had anything to add. Mr. Alan Kimpell , the architect for the project, stated that he had nothing to add, but would answer questions of the Commission. 11-10-83 -1- PUBLIC HEARING (A lication Nos. 83051 and 83052) Chairman Lucht opened the meeting for a public hearing and asked whether anyone present wished to speak on the application. Seeing none, he called for a motion to close the public hearing. CLOSE PUBLIC HEARING (Application No. 83051 ) Motion by Commissioner Simmons seconded by Commissioner Ainas to close the public hearing on Application No. 83051 . The motion passed unanimously. CLOSE PUBLIC HEARING (Application No. 83052) Motion by Commissioner Manson seconded by Commissioner Malecki to close the public hearing on Application No. 83052. The motion passed unanimously. Commissioner Manson stated that she did not feel the project should be held up on account of a remote possibility that the signals at Indiana Avenue would be eliminated. Commissioner Simmons added that the Highway Department does not yet know what its plans are and that the City should not have to act on the basis of a possibility.; Chairman Lucht stated that the site in question is not affected by MN/DOT's change in position as much as Denny's Restaurant is. ACTION RECOMMENDING APPROVAL OF APPLICATION NO. 83051 (Normandale Tennis Clubs, Inc. Motion by Commissioner Ainas seconded by Commissioner Manson to recommend approval of Application No.83051 , subject to the following conditions: 1. Building plans are subject to review and approval by the Building Official with respect to applicable codes prior to the issuance of permits. 2. Grading, drainage, utility and berming plans are subject to review' and approval by the City Engineer, prior to the issuance of permits. 3. A site performance agreement and supporting financial guarantee (in an amount to be determined by the City Manager) shall be submitted prior to the issuance of permits to assure completion of approved site improvements. 4. Any outside trash disposal facilities and rooftop mechanical equipment shall be appropriately screened from view. 5. The building is to be equipped with an automatic fire extinguishing system to meet NFPA standards and shall by connected to a central monitoring device in accordance with Chapter 5 of the City Ordinances. 6. An underground irrigation system shall be installed in all landscaped areas to facilitate site maintenance. 7. Plan approval is exclusive of all signery which. is subject to Chapter 34 of the City Ordinances. 8. B612 curb and gutter shall be provided around all parking and driving areas. 9. The special - use permit is subject to all applicable codes, ordinances, and regulations and any violation thereof shall be grounds for revocation. K -2- 11-10-83 10. Plan approval acknowledges proof-of-parking for at least 95 additional stalls based on a formula of: 20 spaces for the first 1000 sq... ft. of floor area, plus one space per 300 sq. ft. of additional floor area, plus two spaces for each outside tennis court (this formula subject to adoption of a Zoning Ordinance amendment by the City Coun- cil ) . Part or all of these additional parking spaces shall be provided by the construction of a parking ramp above the west end of the pro- posed parking lot. Said parking ramp shall be appropriately screened. The applicant shall enter into a written agreement with the City to in- stall this parking ramp at the request of the City and this agreement shall be filed with the property at Hennepin County. 11 . Plan approval is contingent on adoption of the parking formula in Condition No. 10 by ordinance amendment. No building permits shall be issued prior to the effective date of this ordinance. 12. The developer shall be responsible for installing the turnaround area at the end of Azelia Avenue including curb and gutter in con- junction with the development of this plan. 13. Building permits shall not be issued until the plat comprehended under Application No. 83052 has been given final approval and filed with the County. Voting in favor: Chairman Lucht, Commissioners Malecki , Simmons, Manson and Ainas. Voting against: none. The motion passed unanimously. ACTION RECOMMENDING APPROVAL OF APPLICATION NO. 83052 (Normandale Tennis Clubs, Inc. Motion by Commissioner Manson seconded by Commissioner Malecki to recommend approval of Application No. 83052, subject to the following conditions: 1 . The final plat is subject to review and approval by the City Engineer. 2. The final plat is subject to the provisions of Chapter 15 of the City Ordinances. 3. Hookup charges for water shall be paid in conjunction with the platting . of the property. 4. The agreement regarding installation of the parking ramp shall be executed prior to final plat approval and filed with the County in conjunction with this plat. Voting in favor: Chairman Lucht, Commissioners Malecki , Simmons, Manson and Ainas. Voting against: none. The moti.on passed unanimously. DISCUSSION ITEMS (Ordinance Amendment) Commissioner Malecki asked whether the draft ordinance amendment regarding the parking requirement for tennis clubs, was based on ordinances of other communities. The Secretary explained that the only City with a definite ordinance for this particular use was St. Louis Park. He explained that the recommended formula was a duplication of the St. Louis Park formula plus some additional stalls for outside tennis courts. 11-10-83 -3- ACTION RECOMMENDING APPROVAL OF ORDINANCE AMENDMENT Motion by Commissioner Manson seconded by Commissioner Ainas to recommend approval of a draft ordinance amendment to require parking spaces for athletic clubs and racket and swim clubs on the following basis: 20 spaces for the first 1000 sq. ft. of gross floor area, plus one space for each additional 300 sq. ft. of gross floor area, plus two spaces for each outside tennis court. Voting in favor: Chairman Lucht, Commissioners Malecki , Simmons, Manson and Ainas. Voting against: none. The motion passed. By consensus it was agreed that the Planning Commission would cancel its November 17, 1983 meeting on the grounds that there were no business items to consider. ADJOURNMENT Motion by Commissioner Malecki seconded by Commissioner anson to adjourn the meeting of the Planning Commission. The motion pass d nanimously.
