Chairman's Explanation: The Planning Commission is an advisory body. One of the Commission's functions is to hold public hearings. In the matters concerned in these hearings, the Commission makes recommendations to the City Council . The City Council makes all final decisions in these matters. 6. Brooklyn Center Industrial Park 79070 Request for Subdivision approval to create a new R.L.S. with four tracts (A, B, C, D) on the vacant tract of land between Shingle Creek Parkway north of Freeway Boulevard (the large Spec. 9 site) . 6. Adjournment Planning Commission Information Sheet Application No. 79070 Applicant: Brooklyn Center Industrial Park Location: West of Shingle Creek Parkway, north of Freeway Boulevard Request: R.L.S. Approval The applicant .requests subdivision approval to create a new R.L.S. on the land presently described as Tract B, R.L.S. 1405. The land is bounded by Shingle Creek Parkway on the east and north, the MTC property and the Shingle Creek greenstrip on the west, and by Freeway Boulevard o the �so�th. The entire tract of land is 39.92 acres, the largest single parcel an"n ppivately owned in Brooklyn Center. The property is proposed 'to, be divided into four large tracts of the following sizes: Tract A 5.20 Acres Tract B - 11 .06 Acres Tract C - 17.09 Acres Tract D - 6.57 Acres Tract A will serve as the site for the approved Spec 9 industrial building, east of the MTC property. Tract B and Tract C are tentantively to be used for a number of industrial buildings totalling up to 430,000 square feet. Most of the parking for these two tracts would be located �a t B. Tract D is designated on the accompanying site plan as the site fo a�1mo a with a restaurant._ ThP site plan is a conceptual plan only and is not N nsidered a master plan for which the applicant is seeking approval . The platting is primarily for the purpose of establishing legal parcels for sale. The proposed R.L.S. - indicates a 5' wide NSP Company easement adjacent to all public right-of-way. A 20 ' wide drainage ditch easement is proposed to divide this subdivision through Tracts C and B in a northeasterly fashion from the Shingle Creek Parkway walkway easement to Shingle Creek- Parkway There is also a- 10' wide storm sewer easement at the southwestern tip of Tract D, .adjacent to . the.Freeway Boulevard bridge over Shingle Creek. The configuration of the proposed tract y r�eq res that a joint parking agreement between Tracts B and C will have to be concluded if develop- ment of Tract C is to be facilitated. The applicant has indicated that he plans to file joint access and joint parking agreements with the R.L.S. covering Tracts B. C. and D. A joint access agreement between Tracts A and B has already been filed, according to the applicant. The Superintendent of Engineering will be prepared at Thursday's meeting to review this subdivision proposal in more -detail along with the implied public improvements. Approval woul.d be subject to at least the following conditions: 129A- 1--�/13199 1. The final plat is subject to review and approval by the City Engineer. 2. The final plat is subject to the provisions of Chapter 15 of the City Ordinances 3. Final plat approval is subject to the conclusion of a joint parking agreement being filed as a deed restriction with Tracts B and C. 4. The final plat is subject to review and approval by the City Engineer. 2. The final plat is subject to the provisions of Chapter 15 of the City Ordinances. .3. Final plat approval is subject to joint accc-ss, joint parking, and joint maintenance agreements between Tracts A, B, C, and D being filed with the R.L.S. as a deed restriction upon all of the above tracts. 4. Final plat approval is subject to a utility and drainage easement and a sidewalk easanent through the site being filed with the R.L.S. S. Final plat approval is subject to dedication of a portion of Tracts B, C, and D for roadway purposes in conjunction with the construction of turn lanes necessary potential traffic signal installations at the intersection of Freeway Boulevard and Shingle Creek Parkway and of 67th Avenue North =1 Shingle Creek Parkway, the amount of said dedication to be determined by the City Engineer prior to final plat approval. 6, Final plat approval is subject to drainage and utility easements of 15 feet in width, minimum, along both sides of private roads on the site, said areas to be unpaved boulevards properly landscaped. 7. The applicant acknowledges through final plat approval that access to a proposed private road as a westerly continuation of 67th P.venue North shall be restricted to points greater than 200 feet from the westerly right of way line of Shingle Creek Parkway; also that access to a pro- posed private road between 67th Avenue North and Freeway Boulevard and westerly of Shingle Creek Park4ray shall be restricted to points greater than 100' from the right Hof y line of Shin l Cre Parkwaypti 8.
