Chairman's Explanation: The Planning Commission is an advisory body. One of the Commission's functions is to hold public hearings. In the matters concerned in these hearings, the Commission makes recommendations to the the City Council . The City Council makes all final decisions on these matters. 5. George Shimshock 79029 Resubdivision of two pre-existing parcels combined for tax purposes in 1971 . 6. St. Alphonsus Church 79046 Special Use Permit for an addition to a storage building. (Churches are special uses in the R1 (single family) district. 7. Church of the Nazarene 79047 Special Use Permit for a day care of up to 16 preschool children at the church. 8. Discussion Items a. Report from BRW on traffic analysis for properties in the Industrial Park south of Interstate 94. Included will be analysis of street locations and a policy for median cuts. b. Ordinance Amendments. Staff will present background information and possibly proposed C% D language for ordinance amendments relating to setback from major thoroughfares and freestanding signs. 9. Other Business 10. Adjournment Planning Commission Information Sheet Application No. 79029 Applicant: George Shimshock Location: 5900 Colfax Ave. North Request: Resubdivision The applicant seeks approval to subdivide two pre-existing lots between Bryant Avenue North and Colfax Avenue North at 59th Avenue North. The two lots are described as Tract Q and Tract R, R.L.S. 1271 . These lots were combined for tax purposes circa 1971 . Mr. Shimshock wishes simply to redivide the properties along the same line. Tract R will be roughly 79' x 140' and Tract Q will be roughly 80' x 131 ' . While a lot width deficiency exists for both lots (corner lots should be 90' width in the R1 zone) , a variance is not necessary since lot width is a pre- existing condition, unaffected by this redivision. Section 35-500 of the Zoning Ordinance states that substandard lots of record prior to 1976, the R1, and R2 zones shall be considered buildable so long as all new construction meets current ordinance requirements. The only zoning criteria at question in this division are lot depth and lot area. In both these respects, the application complies with ordinance requirements. The applicant intends to move a house onto lot at 5900 Colfax Avenue .North in accordance with ordinance requirements. Approval of the application is recommended, therefore, subject to at least the following conditions: 1 . The subdivision is subject to the approval of the City Engineer and the City Assessor prior to filing with the County. 2. The subdivision approval does not comprehend approval of any other action pertaining to the use of the property. 7-26-79 i f� f f .1 U i EARL BROWN 0 Planning Commission Information Sheet Application No. 79046 Applicant: St. Alphonsus Church Location: 7025 Halifax Avenue North Request: Special Use Permit The applicant seeks approval for the construction of a 24' x 30' addition to the St. Alphonsus Church service garage. The garage is located on the west portion of the church site at 7025 Halifax Avenue North, just beyond the outer service drive. Since churches are a special use within the R1 zone, any con- struction requires Planning Commission and City Council review and approval . The structure is proposed to be concrete block with a frame roof, consistent with the existing garage. When completed, the garage will be 24' x 60' , double its present size. The enlarged building will be able to house recreational and maintenance equipment presently stored outside. The proposed structure requires no additional parking (parking provisions on the site are already more than adequate) . No landscape treatment is required and none is proposed. Approval of the proposed service garage addition is recommended subject to the following conditions: 1 . The permit is granted to the applicant as user of the facility and is nontransferable. 2. All maintenance and recreational equipment shall be stored in the garage when not in seasonal use to minimize outdoor storage. 3. The Church is bounded by single family homes on the west and north and by apartments on the east and south (West River Villa and Evergreen Park Apartments) . Under new state legis- .lation, group day care of up to 10 children is a permitted use within a single family residential district. The proposed operation would serve 16 children, ages 22 to 5 years. Hours of operation would be from 6:45 a .m. to 6:00 p.m. In a letter of application (attached) , the applicant states that the day care center will enhance the general public welfare by providing a service. needed by working parents. The driveway and parking area are already adequate and there will be no structural alterations associated with the day care center. There does not seem to be any conflict with the Standards for Special Use Permits (copy attached) . The premises have been inspected by the Health Department and by the fire marshal . The Sanitarian has communicated to Ms . Kolstad the need for certain required equipment. The Minnesota Department of Public Welfare has indicated that the Church has applied for a group day care license which can be issued after August 15, 1979 according to Minnesota Statute 257.101 . Sally Goldberg of the Minnesota Department of Public Welfare indicates the facility is t licensable for up to 20 children. The Church desires to begin operation of the center on August 27, 1979. While other approvals are yet to be officially granted, there do not seem to be any zoning barriers to the granting of a special use permit. Approval should, therefore, be subject to at least the following conditions: 1 . Permit is issued to operator of the day care facility and is nontransferable. 2.. A copy of the applicant's State license shall be kept on file with the City. 3: The permit is subject to applicable codes, ordinances and regulations and any violation thereof shall be grounds for revocation. 4. Hours of operation shall be from 6:45 a.m. to 6:00 p.m. Monday through Friday. 5. No more than 16 children ages 22 to 5 years shall be enrolled in the program at any one time. 6. Approval by the City Sanitarian of all food storage, eating, and washing facilities shall be -granted prior to the issuance of the permit. 7-26-79 t July 9 , .1979 Brooklyn Center City Offices 6301 Shingle Creek Pkwy . Make application at the city hall for a food establish- ; ment license. 2. Provide corm-nercial refrigeration for food storage. The unit must be National Sanitation Foundation (NSF) approved. 3. Provide commercial NSF warming box for transporting catered meals. 4. All catered meals for the day care center must be from an approved source. 5. All utensils used must be single service. 6.
