4. Chairman's Explanation: The Planning Commission is an advisory body. One of
the Commission's functions is to hold public hearings.
In the matters concerned in these hearings, the
Commission makes recommendations to the City Council .
The City Council makes all final decisions on these
matters.
5. Howe, Inc. 79016
Site and Building Plan approval to construct an
approximate 217' x 74' precast concrete warehouse,
garage and maintenance shop building to replace
the building destroyed by fire on January 6, 1979.

Application Nos. 79016 and 79017
Applicant: Howe, Inc
Location: 4821 Xerxes Avenue North
Request: Site and Building Plan Approval (79016) and a
Variance from Section 35-111 to build a nonconforming use at a
setback and buffer requirements other than that contained in the
Zoning Ordinance (79017)
Application Nos. 79016 and 79017 were tabled by the Planning Commission on March
15, 1979 and continued to a special meeting which was held on March 22, 1979 at
which time the City Attorney gave an oral report to the Commission regarding
various legal aspects associated with the application. The Commission again
tabled the matter for the opportunity to review various reports relating to Howe,
Inc. which were being prepared.
The Commission has received copies of reports from Hickok and Associates regarding
chemical storage on the site, as well as reports submitted by William H. Gruen,.
Fire Protection Consultant and R. L. Loofbourow, a consultant hired to examine
the use of explosives at the Howe site. Additional information regarding the
application is contained with this agenda for the Commission's review.
The Commission is urged to review the Planning Commission Information Sheets from
the March 15 and March 22 meetings as well as the minutes for those meetings and
other materials that have been supplied.
