HomeMy WebLinkAbout2013-015 CCR Member Lin Myszkowski introduced the following resolution and moved its adoption: RESOLUTION NO. 2013-15 RESOLUTION VACATING A SIREN EASEMENT,NUMBER 7581467,HENNEPIN COUNTY, MINNESOTA (6700 BROOKLYN BOULEVARD, LUTHER TOYOTA SITE) WHEREAS, the City Council has approved the final plat for BRI MAR SECOND ADDITION based on certain conditions as set forth in the City Council Resolutions Nos.2011-116;and WHEREAS, an existing siren easement is being replaced by a new siren easement on Lot 2, Block 1, BRI MAR SECOND ADDITION; and WHEREAS, the easement proposed to be vacated is identified as follows and is hereafter referred to as "the Easement": A siren easement document number 7581467, and as depicted and described in the attached exhibit; and WHEREAS, after due notice and public hearing,the City Council has determined that the Easement will be no longer needed,once the new siren easement has been executed and recorded, and it is in the public interest to vacate the Easement; NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that: 1. The City Council hereby approves the vacation of the Easement described above and depicted in the attached exhibit. 2. The City Clerk is directed to prepare a Notice of Completion of Vacation Proceedings and to record it with the Hennepin County Recorder or Hennepin County Registrar of Titles, as appropriate. 3. Vacation of Easement will be effective upon proper execution,release and recording of the new replacement siren easement.
