Request: Revised Preliminary Plat Approval
as Remanded by City Council ,
The applicant presented his argument, concerning the need for
"back up space" from his garage, to the Council, and asked
that a variation in the proposed lot line be allowed.
Staff response was that the line might be adjusted in such a
manner to meet the applicant's needs, and still retain the
minimum average lot depth of 110 feet as required by ordinance.
The Council remanded the application to the Commission for
further review.
The point of tangent of the new lot line would be 115 feet on
the north and 105 feet on the south.,, -- - an average lot depth of
110 feet is provided.
• The setback to the existing house is approximately IS feet --
consequently the required varianQe for the rear yard setback
would be about 22 feet.
However, the position of the new lot line will allow a maximum
depth of 30 feet at the south end of any structure built on the
new lot. This should be noted in the action, since any greater
dimension for the new structure would necessitate a rear yard
setback variance.
Recommendation is for approval subject to the following conditionsz
1 . F-11.nal plat is subject to the requirements of Chapter 15
of the City ordinance;

The applicant seeks special use permission to operate a formal
"elementary school" .- kindergarten through ninth on the
premises of the Berean Free Church. A letter from the applicant
indicates the facility is intended for 75 to 100 children, and
the operation is to commence September 4, 1973.
As of Monday, August 13th, we have not received the following:
1) A letter from the church authorizing this facility
will be brought into compliance with all applicable
building code, fire, health, and safety requirements
prior to the commencement of classes-,
• 2) A report of juvestigal"lion by appropriate state or
county authorities.
On August 13, 1973, the physical facilities were inspected by
the Director of Planning and inspection, the Building inspector,
the City Sanitarian, the City Fire Marshall and an Administrative
Assistant.
A report of that investigation will be presented at the meeting.
Based on our findings so far, we cannot recommend approval of
this request.
Despite the applicant' s insistence that classes must start on
September 4th (applications are being solicited in the daily
press) , the use of this facility cannot be condoned until
necessary alterations and improvements have been made Ilkto bring
it up to minimum code and safety standards.

This item was tabled at the May 24, 1973 meeting for the
reasons outlined its the memorandum included in the August 2,
1973 agenda
A possible ordinance amendment which would apparently resolve
the applicant's question is noted in the memo and appears on
page 9 or the August 2nd minutes.
Recowmend ati.on for action on the subject application is for
denial, in that the standards for a variance are not met.
Should the Commission decide to recommead the ordinance change,
that decision could be conveyed to the Council in conjunction
with the application. of course` the applicant could withdraw
• the recruest and await council disposition of the proposed amend-
ment.
if the ordinance change is not recommended, the application will
be processed as usual.
