The home is a non--conforming use - single family dwelling in R-5 District. Neighboring property owners have been notified of the request and public hearing. • ANALYSIS AND R,ELIOD •NDATION As a residential use jalbeit non--conforming;) , this property,, and the proposed occupation involving stock in trade and 'the employment of a nonresident, merits consideration for eligi- bility for a Special Home occupation permit. Certain specific factors in this application however raiae several policy and feasibility questions ,attached is a statement of proposed operation submitted by the applicant, . 1. Retail gales of "accessories". Although "limited" and related to the appliances under repair, sale of such items is a retail use, expressly prohibited its this district. Recently the Counail directed full enforcement of the ordinance provisions in this regard, and efforts are being made to do this. Approval of the sale of "limited !accessories" would tend to negate this actiod, and thus the recommendation, should the permit be granted, is to specifically prohibit, a retail sales. ,.x PlAnning commission information sheet - February 1, 1973 Page 2 Application No. 73001 2. The applicant states the operator will live on the premises. Note should be made however to the reference to "business" Iva. hmme occupation) , wherein, a rather substantial inventory is proposed. Perhaps the absence of any retail sales would diminish this concerns which is founded upon the ordinance restriction of commercial business from residential districts and upon the policy discouraging perpetuation of the use of residential structures for businesses uses on Brooklyn Boulevard. 3. Xp,ocation, traffic, parklszg The residence is located on the west side of Brooklyn Boulevard, just south of the new dental clinic on 65th Avenue North. There is a standard curb cut and driveway apron onto the highway. The driveway is approximately 12 feet wide and is not paved. There is a "turn around" area at the front of a double garage which is to the rear of the houses this maneuver could be difficult if other, vehicles were • parked in that area. Vehicles parked in the driveway itself would tend to obstruct clear access from the turn around to the highway. The applicant has mentioned the possible use of the front yard area for "overflow" parking, this is not endorsed. ;f the number of cars is minimal and if parking spaces are delineated in the rear, the area should be adequate. Yllegal and hazardous bac ing out onto Brooklyn Boulevard is possible if these provisions are not made. Approval would be subject to the followings 1. Retail sales of any kind are prohibitedr 2. Driving and parking areas shall be designed and delineated so to allow turn around capability and adequate parking for customer vehicles. 3. (Statement of proposed operation submitted by applicant in • support of Application No. 73001 January 25, 1973) TYPE OF BUSINESS : Small vacuum cleaner repair shop with limited sale of accessories (replacement paper bages, hoses, etc.) . NATURE OF OPERATION: a) Equipment General household tools, hand drills (no heavy equipment) . b) Hours 9 to 5 daily and evenings by special appointment. c) Customer Contact In as much as all repairs will be picked up at customers home and delivered back, we would ex- pect a maximum of 3-5 cars on the premises on any given day. There would be in all likeli- hood be no more than one car at a time at the home. d) Operator will live in the home and use as a full time residence. The only other person there will be a relative for the purpose of answering the telephone when owner is not present. INVENTORY- Likely never to exceed $2, 500.00 at any time, this would consist mostly' in the form of replacement parts (bags, hoses, cords, and accessories) . • THESE ARE THE RECOMMENDED CHANGES TO CHAPTER 34 AS SUBMITTED BY THE SIGN SUBCOMMITTEE AND THE PLANNING COMMISSION AND REVISED BY THE COMMISSION ON JANUARY 18, 1973 .
