The applicant seeks a special use permit to operate an automobile washer in an existinq bay of the Shell Service Station located on the southwest corner of 69th and Humboldt Avenue: iqorth. Auto washers are special uses per Section 35-322 (3a) . AITAL'YS1S AND RECOMMENDATION • The applicant has yet to complete the site work for the service station; the completion date was June I, 1971. Also, site improvetnent.s for the Shell Service station at 66th and Lyndal.e Avenues North have yet to be completed; the completion date wads August. 5< 1972. These were con- ditions of a speci=1 use permit for a car .usher there approved by the Council on May S., 1972. The Building inspector made numerous attempts to communicate with the applicant and finally in late November -the applicant expressed regret at the failure to complet-;� the site -work;` it was requested that the completion date for both stationsa' be postponed ufr til early spring. The City's response was an extension of the completion dates to no later than June 1, 1973. The applicant wash reminded of the possible rnwi"ications of non-compliance. upon the special use permit and licenses at the subjec stations. In Light of the past non-performance by tr,, applicant, the recommendation is to defer further cons:%de.-ation until. the June, 1973 requiar mehting. Efforts to apply eXisting provisions, which are directed at buildings three stories or less in height and clustered establishments in a "shopping center complex" hove accentuated this need. Results have been less than desirable for example in determin-- ini the relation hip between clustered establishments in a shopping center and those in a speculative industrial building or in a high rise office bui lcgii1q . The need, then, is to amend pertinent sections of t!hapter 34 so to effectively and reasonably provide for multi-tenant commercial and industrial buildings and particularly those which are multi- storey struettres.
