Commission makes recommendations to the City Council .

Applicant: William Pierce
Location: 6837 Brooklyn Boulevard
Request: Special Use Permit (Amendment)
The applicant is seeking site and building plans for a major upgrading and re-
modeling of the existing A and W Drive-in which is a special use in the C-2
district. The basic proposal is to add a dining room of approximately 100 seats
and a variety of related site improvements including curb and gutter, landscaping
additional parking and site lighting. It is the applicant's intent to maintain
approximately 24 drive-in parking stalls with the electronic call -in stations.
We strongly recommend, and the plans do indicate that an automatic fire extinguish-
ing system be installed in the building which would, upon remodeling, exceed the
2,000 sq. ft. gross floor area requirement of the ordinance. It is also significant
that the ordinance specifically disallows the use of the drive-in parking stalls
for credit to the inside parking. The applicant's plan comprehends it and we will
be prepared to discuss it further.
The Director of Public Works will be prepared to discuss the site layout and
access and drainage features.
A public hearing has been scheduled.
Approval would be subject to at least the following conditions:
• 1 . Building plans are subject to review and approval by the Building
Official with respect to applicable codes prior to issuance of
permits.
2. Drainage, grading, curbing and utility plans are subject to
approval by the City Engineer prior to the issuance of permits.
3. Performance Agreement and supporting financial guarantee (in
an amount to be determined by the City Manager) shall be submitted
to assure completion of approved site improvements .
4. The special use permit is subject to all applicable codes,
regulations, and ordinances including special licensing
requirements and violation thereof may be grounds for revocation.
5. All outside mechanical equipment equipment and trash disposal
facilities shall be appropriately screened.
6. The building shall be equipped with an automatic fire extinguishing
system as specified on the approved plans.
7. An underground sprinkling system shall be installed in all land-
scaped areas as specified in the Zoning Ordinance.

Applicant: Brookdale Chrysler-Plymouth
Location: 6121 Brookdale Boulevard
Request: Special Use Permit
On February 7, 1977 the City Council approved a Special Use Permit for the
retail sale of motor vehicles at the above premises by Brookdale Motors which
was represented by Mr. Scott Powell . The dealership apparently has changed hands
to a Mr. Hesse d/b/a Brookdale Chrysler-Plymouth.
Renewal of special use permits is required especially for automobile dealerships
to assure that new ownerships are aware of original conditions of approval and
any restrictions which the ordinance or the special use permit may apply.
The conditions of approval for Application No. 77004 were as follows:
1 . A special use permit is issued to the applicant as operator and
is nontransferable.
2. The operational agreement between Chrysler Realty and the City
(as comprehended under Application No. 68035) shall become a
permit attachment to the special use permit.
3. The applicant shall take appropriate measures to ensure that
there will be no body shop or other noise emanenting from the
building after 10 p.m.
We have heard from two of the notified neighboring property owners who both
express concern that the greenstrip around the dealership especially on the
south side outside of the screen wall and on the west side has not been properly
maintained. This was brought to the attention of the previous dealership and
apparently corrective measures were not taken. Another concern voiced by one
of the property owners is that obscenities have been sprayed on the screen
wall and should be painted out.
We have related both of these matters to the present applicant who has indicated
that they will take the necessary corrective measures.
A public hearing has been scheduled.
We would recommend the above conditions plus possible additional language covering
the maintenance of green areas and the screen wall .

Applicant: Gene Hamilton
Location: 6230 Lee Avenue North
Request: Appeal
This item is continued from the December 8 meeting at which time the Commission
directed draft ordinance language relative to the definition and restrictions on
canopies, carports, and accessory structures. We will have the draft language
available for review and disposition.
This application will potentially serve as a vehicle to bring such ordinance
amendments to the City Council 's attention. However, the application must be
acted upon on its merits . The actions would be either to approve the applicant's
appeal thereby overturning the Building Official 's ruling, or to deny the appeal
thereby upholding the Building Official 's ruling.
The ruling is that the carport erected by the applicant without a building permit
is an accessory structure which encroaches into the front yard setback by approxi-
mately 20 feet and therefore a building permit could be not issued for that
structure. The applicant contends that in effect, that the carport is equivalent
to a canopy, and that a permit should be issued since the Zoning Ordinance provides
that canopies are not considered encroachments into any yard setback.
The majority of Commissioners have expressed the opinion that carports and canopies
. are basically equivalent type of structures, but that additional clarifying and
restrictive language is needed in the Zoning Ordinance to provide uniform guidelines
since the applicant's circumstances are not unique.

Applicant: Northwestern Bell Telephone Company
Location: 6540 Shingle Creek. Parkway
Request: Special Use Permit
This item was considered at the November 17, 1977 meeting and continued to the
December 8 meeting. Since the applicant was not present at that meeting, it has
been continued to this agenda and consists of a request for a special use permit
to allow a gasoline dispensing facility at the office/service building in the
Industrial Park. The item was tabled at that meeting to allow for reevaluation
of the location of the proposed facility and to permit the applicant time to revise
the plans as necessary to reflect all desired uses. There had been extensive
discussion regarding an outside storage area which had been permitted by variance
when the applicant first occupied the building.
It was also the consensus of the Commission that the proposed location of the
facility and of the storage area should be reevaluated in view of the number of
parking spaces required against those available to see where the tank area and
the storage area would best fit. The Commissioners generally agreed that there
was no objection to the gas facility, but that the location and parking require-
ments were major concerns .
The applicant has submitted a revised plan indicating a relocation of the proposed
gasoline pump station and a retention of the original approved outside storage
area.
• We will be prepared to comment further on the proposed site plan.
Approval would be subject to the following conditions:
1 . The permit is issued to the applicant as operator of the facility
and is not transferable.
2. The special use permit is subject to all applicable codes ,
regulations and ordinances, including special licensing
requirements of the City, and violation thereof shall be
grounds for revocation.
3. Any outside trash disposal facilities shall be appropriately
screened.
4. There shall be no outside storage of equipment or materials
other than that permitted by the City Council under Application
No. 70039 unless specifically approved by the City through a
subsequent variance action allowing such storage in the I-1
zoning district.
