4. Chairman's Explanation: The Planning Commission is an advisory body. One of
the Commission's functions is to hold public hearings.
In the matters concerned in these hearings, the
Commission makes recommendations to the City Council .
The City Council makes all final decisions on these
matters.

Applicant: Herbert L. Beighey
Location: 6901 West River Road
Request: Preliminary Plat
The applicant is seeking approval of a preliminary plat of the property at the
northwest corner of 69th Avenue North and West River Road. The property
currently is a large single property containing a single-family home and the
applicant's proposal would create an 85 foot wide interior lot to the west of
the existing house.
The property immediately north is zoned single-family residential and contains
single-family homes facing West River Road. The property to the northwest of
the lot is zoned R-4 and contains the Columbus Village apartment complex. The
Comprehensive Plan originally designated this entire area to be single family
residential ; however, in the early 1970's, the major rezoning occurred estab-
lishing the R-4 properties in this area.
The major concern with the design of the proposed subdivision has been provision
for adequate additional street right-of-way along 69th Avenue North (County Road
130) and along West River Road (State Highway 169) . Provision has been made
on the preliminary plat for additional right-of-way dedication.
Notice of public hearing has been published.
Approval would be subject to the following conditions:
1 . Final plat is subject to review and approval by the City
Engineer.
2. Final plat is subject to the requirements of the City Subdivision
Ordinance.

Applicant: Gene Hamilton
Location: 6230 Lee Avenue North
Request: Appeal from Administrative Ruling
This item was considered and tabled at the November 10, 1977 meeting and involves
an appeal from the administrative ruling that an erected carport attached to the
front of a house extending 20 feet into the front yard setback cannot be permitted
as an accessory structure. The applicant contends essentially that the structure
represents a canopy which, under the language of Section 35-400 of the Zoning
Ordinance, allows canopies as encroachments into yard setbacks . The City's
position is the structure is not a canopy in that context and represents an
accessory carport structure which is subject to the ordinance setback requirements .
The Commission tabled the item to direct the staff to prepare a draft ordinance
amendment comprehending definitions of such accessory structures, and language
which would provide for specific setback limitations .
We are still continuing our research into this matter and have not at this writing,
prepared draft ordinance language, however, we feel that further discussion and
input by the Commission is warranted as to the general subject of such accessory
structures and we will be prepared to present the extent of our research at this
point.
The applicant has been notified of the meeting and we would expect that he would
be present to participate in the discussion.
We would recommend, however, and we have related this recommendation to the
applicant, that action not be taken on the appeal at this time. We would recommend
that final disposition of the application be deferred until the next meeting
(scheduled for the 15th) when the Commission can act on possible recommendations
to the City Council for ordinance amendment. In that context then, the application
can serve as a vehicle for conveying those ordinance amendments . Conversely,
should the Commission decide that no amendments are warranted, action can be taken
on the application and it can be forwarded on its own merits to the City Council .
We would suggest that Commissioners drive by the European Health Spa on County
Road 10, east of, Xerxes Avenue North, and by the former beauty shop at 61st and
Brooklyn Boulevard to observe a canopy within the meaning of the Zoning Ordinance.
We would also suggest that Commissioners drive by the applicant's residence and
by 5017 Brooklyn Boulevard to observe carport-type accessory structures . The
carport at 5017 Brooklyn Boulevard is within the ordinance setback requirements .

Applicant: Northwestern Bell Telephone Company
Location: 6540 Shingle Creek Parkway
Request: Special Use Permit
This item was considered at the November 17, 1977 meeting and consists of a
requst for a special use permit to allow a gasoline dispensing facility at the
office-service building in the Industrial Park. The item was tabled at that
meeting to allow for reevaluation of the location of the proposed facility and
to permit the applicant time to revise the plans as necessary to reflect all
desired uses. There had been extensive discussion regarding an outside storage
area which had been permitted by variance when the applicant first occupied the
building.
It was also the consensus of the Commission that the proposed location of the
facility and of the storage area should be reevaluated in view of the number of
parking spaces required against those available to see where the tank area and
the storage area would best fit. The Commissioners generally agreed that there
was no objection to -the gas facility, but that the location and parking require-
ments were major concerns.
The applicant has submitted a revised plan indicating a relocation of the proposed
gasoline pump station and a retention of the original approved outside storage
area.
We will be prepared to comment further on the proposed site plan.
Approval would be subject to the following conditions:
1 . The permit is issued to the applicant as operator of the facility
and is not transferable.
2. The special use permit is subject to all applicable codes,
regulations and ordinances, including special licensing
requirements of the City, and violation thereof shall be
grounds for revocation.
3. Any outside trash disposal facilities shall be appropriately
screened.
4. There shall be no outside storage of equipment or materials
other than that permitted by the City Council under Application
No. 70039 unless specifically approved by the City through a
subsequent variance action allowing such storage in the I-1
zoning district.
