Request: Site and Building Plan Approval
The applicant seeks site and building plan approval for a 43,852 commercial
speculative building which is proposed to have multiple tenancies . The site is
on the south side of 68th Avenue North at ,Lee Avenue North adjacent to the NSP
Service facility.
The applicant proposes a deferral of approximately 96 parking spaces with the
installation of 193 spaces versus the required 289 spaces . A proof of parking
plan has been submitted that indicates a potential of 331 spaces could be provided,
thereby exceeding the ordinance requirements . Because of the excess parking, the
applicant has indicated a possible building addition which would result in a total
structure of 50,400 sq. ft.
Because the building is speculative in nature and no specific tenancies are known
at this time, we have emphasized to the applicant that the zoning is C-2 which does
not comprehend any warehousing or industrial type uses .
Plan review has included the following concerns which should be resolved and re-
flected on the plans submitted to the Commission: improved parking lot design;
provision for curb and gutter delineators; proper drainage of the entire site
including filling the low areas; provision for storm sewer, on the site to assure
• adequate drainage; and provision of a lighting detail .
We will be prepared to review the plans in further detail at the meeting.
Approval would be subject to the following:
1 . Building plans are subject to approval by the Building Official
with respect to applicable codes prior to the issuance of permits .
2. Grading, drainage, utility and berming plans are subject to
approval by the City Engineer prior to the issuance of permits .
3. A Performance Agreement and supporting financial guarantee (in
an amount to be determined by the City Manger) shall be submitted
to assure completion of approved site improvements .
4. All outside trash disposal facilities and rooftop mechanical
equipment shall be appropriately screened from view.
5. Installation of certain parking stalls as indicated on the approved
site and building plans may be deferred until deemed necessary
by the City Council , providing such deferred areas are developed,
landscaped, and maintained in accordance with approved site plans
and ordinance requirements .

Applicant: Denny's, Inc.
Location: Southwest quadrant of Highway 100 and France Avenue North
Request: Site and Building Plan Approval
The applicant seeks approval of site and building plans for a 138 seat family-type
restaurant on a portion of the large undeveloped property which was rezoned and
subdivided last year. The site is south of the Dale Tile Company across Lakebreeze
Avenue and is bounded by Trunk Highway 100 on the east.
The plans are generally in order; the following concerns have been expressed to
the applicant during the plan review, and presumably the corrections will be noted
on the plans presented to the Commission:
1 . All driving and parking areas are to be bounded by B6-12 design
curb and gutter, including all parking delineators.
2. All landscaped areas are to be equipped with underground lawn
sprinkler system.
3. The major plantings on the site shall consist of long-lived hardwood
varieties known to survive and thrive in the Minnesota climate.
This item was noted because the original Denny 's plans are based on
proto-types developed in California, and a tree species was indicated
which cannot survive in this climate.
iThe applicant does not propose to seek a liquor license at this time; the menu is a
general family-type fare; and the proposed operation is 24 hours a day.
We will be prepared to comment on the plans in further detail .
Approval would be subject to the following conditions:
1 . Building plans are subject to approval by the Building Official with
respect to applicable codes prior to the issuance of permits .
2. Drainage, grading, utility and berming plans are subject to approval
by the City Engineer prior to the issuance of permits .
3. A Performance Agreement and supporting financial guarantee (in an

be appropriately screened from view.
5. Plan approval is exclusive of all signery which is subject to the

• Applicant: Standard Oil Co.

Request: Special Use Site and Building Plan Approval
The applicant has submitted plans for a 12 ft x 25 ft. addition to the rear of the
existing service station at the northeast corner of 66th Avenue North and West River
Road. The purpose of the addition is for -storage purposes . The applicant is also
proposing an upgrading of the building exterior to the current Standard Oil mansard-
type roof design.
A review of the existing site and the submitted plans indicate the need for a
substantial upgrading of certain site improvements which include:
a. Installation of a 6 ft. redwood fence along the north property line
which was to have been installed during initial construction in 1966.
b. Replacement of deteriorated bituminous curbing and concrete curb
stops with cast-in-place concrete curb around the perimeter of a-ll
driving and parking areas.
c. Repair of deteriorated entrance paving.
d. Modification and upgrading of existing storm drainage system at
the southeast corner of the parking lot. The present system consists
• of a 12 inch corrugated metal pipe which carries the water from the
site down to the street boulevard.
In addition to the basic site improvement stated above it is recommended that
the southerly curb cut on West River Road be closed off permanently and landscaped.
When the plans were originally approved in 1966, it was specified as a condition
of approval that the southerly curb cut would be an entrance only, and that the
northerly curb cut would be an exit only, and the two curb cuts were to be appropri-
ately designated with signery. Experience over the last few years indicates that
the southerly curb cut is rarely used and in fact, the operator has been parking
vehicles in the curb cut area, thereby prohibiting effective access. The basic
reason for the recommendation is the planned upgrading of this intersection, in-
cluding eventual signalization at 66th and West River Road. The remaining curb
cut onto 66th Avenue North and the remaining curb cut onto West River Road should
more than adequately serve this site.
We have related these concerns to the applicant, and it is expected that the
appropriate revisions will be reflected on plans submitted to the Commission.
A public hearing has been scheduled.
We will be prepared to review the plans in further detail .
Approval would be subject to the following conditions:
1 . Building plans are subject to approval by the Building Official with
respect to applicable codes prior to the issuance of permits .

5. The existing storm drainage system at the southeast corner of the site
shall be appropriately modified and upgraded as approved by the City
Engineer.
6. A 6 ft. redwood fence shall be installed and/or repaired as necessary
along the north and east parking areas as indicated on the approved
site plan.
7. The southerly curb cut onto West River Road shall be- permanently closed
and appropriately landscaped.

Applicant: JKH Construction Company
Location: 1601 - 67th Avenue North
.Request: Variance
The applicant seeks a variance from Section 35-413 to permit a reduced buffer
greenstrip between a proposed industrial building and adjacent property which is
zoned R-1 . The request is similar to a variance which was granted under Application
No. 74044 relative to Speculative Building No. 7 which was developed on the parcel
immediately to the north of the subject property.
Section 35-413 provides that where a proposed I-1 development abuts an R-1 district
other than a street line, a protective strip of at least 100 ft. in width shall be
provided. This strip shall be landscaped and shall not be used for parking, driving,
storage or loading. This strip must include an 8 ft. fence or wall approved by the
City Council .
The applicant proposes a 50 ft. buffer strip containing an 8 ft. fence on the parcel
which would be created by the preliminary subdivision approved under Application
No. 77046 (recommended for approval by the Planning Commission at the last meeting
and yet to be considered by the City Council ) . The adjacent R-1 parcel to the east
is owned and occupied by the Berean Evangelical Free Church whose parking lot is
between the subject industrial site and the church itself. Application No. 77045
which was also considered by the Planning Commission, but is yet to be heard by the
City Council , comprehends rezoning of the subject property from R-1 to I-1 .
The abutment between the two properties is approximately 330 ft.
Consistent with the proposed rezoning and with the variance approved under Appli-
cation No. 74044, the application is recommended for approval . Those actions and
this action comprehend the institutional use of this particular R-1 property which
is unique, and the hardship created by the ordinance which is intended to protect
single family residential development from adjacent industrial uses (a prime
example would be the pending Howe, Inc. application) .
A public hearing has been scheduled.

• Applicant: JKN Construction Company
Location: 1601 - 67th Avenue North
Request: Site and Building Plan Approval
The applicant seeks site and building plan approval for a 22,769 sq. ft. speculative
industrial and office building. Preliminary plat approval creating the subject
parcel is pending City Council review under Application No. 77046, and rezoning of
this property which is being sold by the Berean Evangelical Free Church is also
pending City Council review under Application No. 77045. The previous application
comprehends a variance which would be necessary to the approval of the proposed
site and building plans.
The building would be oriented toward the parking lot of Artic Metals, Inc. and
James Avenue North. Access would be from the 67th Avenue North cul-de-sac.
Plans indicate a possible 9,822 sq. ft. future addition, and the parking plan compre-
hends such an addition. Approval of this application, however, should reflect that
specific site and building plan approval of that addition would be required.
The plans are generally in order; certain concerns we have related to the applicant
and which we would expect would be corrected on the plans presented to the Commission
include: handicapped parking and access; installation of required automatic fire
extinguishing system; enclosure of any outside trash disposal facilities; screening
of any rooftop mechanical equipment; and provision for effective pedestrian walkway
from the parking area to the main entrances of the building.
Another item worth discussion is the nature of the proposed occupancy since this is
apparently not a multiple-tenant building.
We will be prepared to review the plans in further detail .
Approval would be subject to the following conditions:
1 . Building plans are subject to approval by the Building Official with
respect to applicable codes prior to issuance of permits .
2. Drainage, grading, utility and berming plans are subject to approval
by the City Engineer prior to the issuance of permits.
3. A Performance Agreement and a supporting financial guarantee (in an
amount to be determined by the City Manager) shall be submitted to
assure completion of approved site improvements.
4. All outside trash disposal facilities and any rooftop mechanical
equipment shall be appropriately screened from view.
5. Issuance of permits for the proposed structure is subject to approval
and adoption of the rezoning comprehended under Application No. 77045;
• and occupancy of the proposed structure is subject to the land sub-
division as comprehended under Application No. 77046.

Application No. 77054
Applicant: Buetow and Associates for Advanced Abrasives Company
Location: Northwest quadrant of 48th Avenue North and Dusharme Drive
3400 - 48th Avenue North
Request: Site and Building Plan Approval
The applicant seeks site and building plan approval for an approximate 9,600 sq.
ft. office and industrial manufacturing building. The property is in the I-2 zoning
district.
The applicant contends that the proposed machine shop and office building, while
owned by Advanced Abrasives which is on the site adjacent immediately to the north,
is a separate facility and is not in common development with the existing use.
This is noted because original preliminary plans submitted by the applicant showed
a common access to both facilities from Dusharme Drive, and there was a clear in-
dication that there would be a clear functional relationship between the two
structures . The plans were revised to indicate the now proposed independent
development when the applicant was informed that the two properties would have to
• be combined (as required by the ordinance for common developments under common
ownership) , and that certain site improvements including curbing and landscaping
would be required on the existing site.
It should be formally established that the proposed structure and use are function-
ally independent of the existing use, especially in consideration that the proposed
development, in addition to a front curb cut onto 48th Avenue North, has a proposed
curb cut onto Dusharme Drive near the existing entrance to the Advanced Abrasives
plant. °
Several concerns we have developed during the course of plan review and which should
be resolved as reflected on the plans presented to the Commission include: proper
drainage from the property to the west of the building; screening of any outside
trash disposal facilities and rooftop mechanical equipment; properly dimensioned
parking stalls and driving lane widths; and provision of the minimum 5 ft.. greenstrip
between the parking lot of the proposed site and the parking lot of the existing
site.
Another concern related to this application which should be reflected as a condition
of approval is that at the southeast end of the property abutting what is now 48th
Avenue North, there is a platted tract which is a portion of a vacated cul-de-sac
once approved for 48th Avenue North. In other words, the site contains two separate
parcels and therefore it should be combined through platting or registered land
survey. For clarification, this item is separate from the one discussed above
relative to the adjacent Advanced Abrasives parcel .
We will be prepared to discuss the application in further detail .
