Request: Site and Building Plan Approval
The applicant proposes an approximate 2,200 sq. ft. dental clinic on the
recently platted C-2 parcel .
There are 24 proposed parking spaces which would meet the ordinance require-
ments for the "ultimate use" of the building as indicated by the applicant
(3 doctors) .
Several items we have recommended be changed include:
1 . Add a pedestrian walkway from the north (rear) parking
area to the front entrance on the south.
2. Provide a detailed table of landscape materials in addition
to the plan.
3. Modify the front yard grading to provide berming.
4. Provision for adequate site lighting.
The Director of Public Works will be prepared to comment on the grading.

Approval of.Application No. 77008 (Dr. Steven Schell ) would be subject

1 . Building plans are subject to approval by the Building
Official with respect to applicable codes.
2. Drainage, grading, berrying and utility plans are subject

be submitted to assure completion of approved site improvements.

Request: Special Use Permit
The applicant proposes a recreation center in conjunction with a retail sales
and display facility. Recreation centers are special uses in the C-2 zone.
The recreation .center operation would consist of billiard tables, foosball
tables and electronic and pinball games according to a plan submitted by
the applicant.
A copy of two letters received from the applicant are attached for your
review.
A public hearing has been scheduled.
The primary concern is proper management. Past and present experience in
the City has demonstrated the "problem" frequency to be directly related to
the quality of management -- personnel and policies..
Conditions of approval would include:
1 . The special use permit is issued to the applicant as
operator, and is non-transferable.
• 2. The use is subject to all applicable ordinances and
regulations, including special licensing requirements
and violation thereof shall be grounds for revocation
of the permit.
3. House rules and hours of local curfew regulations shall
be clearly posted in the establishment and rigorously
enforced.
4. Provision shall be made for bicycle parking racks located
in a manner approved by the Planning and Inspection
Department.
5. The special use permit shall be subject to review one
year from date of issuance.

Dear Mr. Tremere:
This is in response to your request for fuaftherwritten description
of the operating policies for the recreation portion of my proposed
business.
I have thoroughly investigated the recreation establishments in
the Twin Cities as they exist today. The facts are that the
successful locations are found in pleasant suburban communities,
not in the inner city. Also, the most successful locations are
not on large thoroughfares where walk—in traffic is more common
• and an arcade—type atmosphere is evident. The side street
location that I have proposed limits the clientele to Billiard
and Foosball players that are dedicated enough to their respec-
tive game that they are willing to drive some distance in order
to play at a deluxe facility. The recreation side of the pro-
posed business is, with no qualifications,. an ideal way to
promote billiard and foosball table sales but the retail portion
will be the life of the system. In fact, I foresee a time when
the retail and supply business will have a large enough reputa-
tion of its own that I can sell the location tables on the used
market and utilize the space for additional showroom area for
an even larger line of home entertainment devices, effectively
and completely phasing out the recreation center.
The recreation area will, as I described in my first letter to
you, be furnished and managed in such a deluxe motif that any
questionable clientele will certainly feel and be out of
place. The location tables will consist of four to six
regulation—sized Brunswick pocket billiard tables and from
six to eight regulation style Tournament Soccer professional
foosball tables; the same as are used on the nation—wide,
$500,000 tour. Both brands are the most respected in their
industry. All tables will have individual hanging lights,
which will add to a pleasing atmosphere.

• The area will be carpeted and the walls paneled part of the way
up with the remainder of the walls texure sprayed. I am seriously
considering an absolute no-smoking policy. This may discourage
a few perspective players, but it would, for the most part, help
establish the strict setting I want. I fully understand that the
success of the location, basically, depends on the managerial
style. I am quite determined to manage in a way that will be
pleasing to your community. I plan on devoting myself completely
to the business at hand and will be on location most of its
operating hours. I am an ambitious and determined person and
will live up to my .proposals. In fact, in the past two years
I have sold about one hundred foosball tables including about
46' tables from my home during the five weeks before Christmas
this year. The home entertainment and recreation market is a
growing one bedause of the increasing amounts of leisure time
on peoples hands these days. Please consider this letter a
paxt of a sincere and continuing effort to successfully,
establish myself in this business.
Enclosed is a floor plan showing the approximate use of floor
space. Additional information will be available at your request.

Dear Sir:
The enclosed letter is a synopsis of my proposed format
for Brooklyn Center Billiards. Additional details are avail-
able on request.
Brooklyn Center Billiards will be a business that will,
in the long run, make most of its profits by selling home
recreation equipment and supplies to the public. Among others,
the games that it will specialize in are pocket billiards,
foosball trampolines, new and reconditioned flipper machines
(pinball, shuffleboard tables, ping pong and combination
game tables. Parts, service, and custom supplies such as cues
will be available, also.
The success of Brooklyn Center Billiards is practically
guaranteed by the nature of the billiards supply business as
it exists in the Twin Cities' metro area, today. The signif-
icant existing billiard suppliers are located in South hiinneapolis,
Excelsior, Wayzata and in St. Paul. Brooklyn Center Billiards
closest competitor is located in Plymouth. These facts high-
light the desirability of a location on the North side of the
cities.
Brooklyn Center Billiards will also be a billiards location
or "recreation center" as defined by ,yourself. The idea is that
sales will be promoted through the exposure gained by the traffic
that visits and plays the game tables�on location. As owner and
manager I fully realize that recreation centers can be acceptable
or non—acceptable by the community and that this is basically
determined by the style of management. Since a staple and
possibly lucrative retail business is at stake, I personally
guarantee a working relationship with the community and the
highest quality management.

and attitudes to the Planning Commission and City Council.

Request: Approve Amendments to Site and Building Plans and
Preliminary Plat
The applicant proposes modification to the width of the main roadway and
to the front yard setbacks of the structures in Phase I . These are in
anticipation that the roadway may be dedicated as a public street through
future amendment to the subdivision for this area.
We will be prepared to discuss these items in detail .

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 15 AND CHAPTER 35 OF THE
CITY ORDINANCES RELATIVE TO SINGLE FAMILY ATTACHED
DWELLING UNITS
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS:
Section 1 . Sections 15-106 (c), (e), (f) , and (g) of the City Ordinances
are hereby amended in part to read as follows:
(c) 15. Private Streets. With the exception of condominium
single family attached [ (townhouse)] dwelling unit sub-
divisions, private streets shall not be approved nor shall
public improvements be approved for any private street.
(e) 1 . Provided for Utilities. With the exception of
condominium single family attached [ (townhouse)] dwelling
unit subdivisions, easements at least 10 feet wide, centered
on rear and other lot lines shall be provided for utilities,
where necessary. They shall have continuity of alignment
from block to block, and at defection points. Easements for
pole-line anchors shall be provided where necessary.
(f) 4. Arrangements. With the exception of condominium
single family attached [ (townhouse)] dwelling unit sub-
divisions, a block shall be so designed as to provide two
tiers of lots, unless it adjoins a railroad or limited access
highway where it may have but a single tier of lots.
(g) 1 . Location. With the exception of lots in a condominium
single family attached [ (townhouse)] dwelling unit subdivision,
all lots shall abut by their full frontage on a publicly dedicated
street or a street that has received the legal status as such.
Section 2 . Section 15-111 of the City Ordinances is hereby amended to
read as follows:
BUILDING PERMIT. With the exception of condominium single family
attached [ (townhouse)] dwelling unit subdivisions, no building permits shall be
issued by any governing official for the construction of any building, structure
or improvement on any land required to be subdivided by this ordinance until all
requirements of this ordinance have been fully complied with.
Section 3. Section 35-312 (1) (a) is hereby amended to read as follows:
(a) Townhouse or garden apartments and condominium_ single family
attached dwelling units as defined in Section 35-900.

Section 4. Sections 35-312 (3) (b) (2) and (3) are hereby amended to
read as follows:
(2) At least 25% of the total number of dwelling units shall be
[R-3 type] townhouse/garden apartments or condominium
single family attached dwelling units as defined in Section
35-900;
(3) If the Planned Residential Development is to be constructed
in multiple phases , at least 20% of the total number of dwelling
units in each phase shall be [R-3 type] townhouse/garden
apartments or condominium single family attached dwelling
units, until the above minimum requirement has been fulfilled;
Section 5. Section 35-900 of the City Ordinances is hereby amended by
the addition of the following:
Condominium Single Family Attached Dwelling Units. Two or more
dwelling units horizontally attached in a linear or cluster arrange-
ment, with the individual dwelling units separated from each other
by a wall or walls extending from foundation to roof, and with each
dwelling unit located upon a separate platted lot Characteristic
features of such a development include individual ownership of
dwelling units, and common (nonpublic) ownership of open areas,
site amenities, and recreation facilities . A condominium single
family attached dwelling unit development includes at least one
large common area of open space for aesthetic or recreational
purposes.
Section 6. This ordinance shall become effective after adoption and upon
thirty (30) days following its legal publication.
