In the matters concerned in these hearings, the Commission makes recommendations to the City Council. The City Council makes all final decisions on these matters. 5. Adjournment _r .� r Planning Commission Information Sheet Application No. 76061 Applicant: Parnell Olson Location: 810 61 st Avenue North Request: Subdivision Approval Refer to the information sheet and minutes for the December 2, 1976 meeting. The item was submitted as a request for variances to permit division by metes and bounds description, and to create a substandard R-1 lot. It was tabled to allow an opportunity to determine whether a standard size lot could be created through formal replatting. �Y We have reviewed the layout of the parcels and have determined that an interior lot, consistent with ordinance standards, can be designed. The configuration r is unorthodox in that a side lot line is "boxed" around the projected dwelling which encroaches 6 feet into the existing lot. The applicant has indicated a preference for a less cumbersome layout; however, more orthodox rectangular designs result in substandard dimensions. We also determined the original house is only 7'8" from the original lot line. The Subdivision Ordinance lists the following standards for a variance: 1 . That there are special circumstances or conditions affecting said property such that the strict application of the pro- visions of this ordinance would deprive the applicant of the reasonable use of his land. 2. That the variance is necessary for the preservation and enjoyment of a substantial property right of the petitioner. 3. That the granting of the variance will not be detrimental to the public welfare or injurious to other property in the territory in which said property is situated. We will have graphics and information on the alternative platting. w Recommended conditions for a replat of the land would be: 1 , Final plat is subject to review by the City Engineer. 2, Final plat is subject to the requirements of Chapter 15 of the City Ordinances. The proposal comprehends an addition to the President Homes headquarters originally constructed as a "display home" . The main concerns have been provision for an automatic fire extinguishing system in the total structure which would exceed 2 ,000 sq. ft. (proposed on the plans); and correction of a poor parking situation, already congested, which will intensify. Application No. 76066, on this agenda, has been submitted for an accessory off-site parking permit to alleviate the need for designated parking spaces. We will be prepared to discuss the proposal in detail. Approval would be subject to the following: 1 . Building plans are subject to approval by the Building Official with respect to applicable codes and ordinance requirements • including the provisions of Chapter 5 relative to automatic fire extinguishing systems . 2 . Appropriate measures, such as directional signs and striping, approved by the City, shall be implemented to designate adequate on-site parking for employees and customers. 3. A performance agreement and a supporting financial guarantee (in an amount determined by the City Manager) shall be sub- mitted, prior to issuance of permits , to assure completion of required site improvements, including those indicated on plans approved under Application No. 76066. Planning Commission Information Sheet Application No. 76066 Applicant: Federal Lumber Company (for President Homes) Location: 4800 Lilac Drive (Cook Paint) Request: Special Use Permit This is a companion application to File. No. 76062. It proposes installation of the minimum required 20 parking spaces, off site on the adjacent Cook Paint property. Section 35-701 (3) provides for accessory off-site parking as a special use in the I-2 District. The submitted plan meets the minimum physical design require- ments. `A public hearing has been scheduled and we will be prepared to discuss the item in detail. The purpose of the proposal is to correct a poor parking situation including unauthorized use of public boulevard and right of way areas. This is attributed to several factors including "isolation" on a dead end street; lack of effective signs and striping for customer and employee parking; and predominant use of on site areas for outside storage of goods. • A key point is that this property has land available for parking; however, a substantial portion is used for storage. Thus, the accessory parking is not proposed to be credited to the minimum parking - this would require, as in joint parking situations, an encumbrance upon the Cook Paint property. Cook Paint Company has granted the applicant permission to use the site as shown on the plans. A contingency condition of approval is recommended to require provision for adequate on site parking by the applicant, should a legal encumbrance not be placed on the accessory site, and should Cook Paint Company withdraw its permission in the future. It is also in order to stipulate that the boulevard areas damaged by unauthorized parking be rejuvenated through sodding or seeding. Approval would be subject to the following: 1 . Grading, drainage, and paving plans are subject to review by the City Engineer. 2. The parking for Federal Lumber and for President Homes shall be reviewed periodically to determine whether adjustments are needed as to the number of off-site accessory spaces. 4. Adequate on-site parking shall be installed at such time that the accessory parking on the adjacent site is unavailable, or is determined by the City to be inadequate. 5. Unpaved boulevard and yard areas damaged by unauthorized parking and driving shall be rejuvenated through seeding or sodding as approved by the City Engineer. A performance agreement and bond were submitted, but no improve- ments have been undertaken. This' applicant is purchasing the property, which consists of two tracts, and proposes to clear it of the service station and to redevelop it with an automotive service facility specializing in replacement equipment such as mufflers and shock absorbers. Auto repair is a special use in the C-2 zone. The proposed building has approximately 3,200 sq. ft. and has 4 service stalls. A public hearing has been scheduled. We will comment in detail on the site and building plans. Recommendation for approval would be subject to the following: • 1 . The special use permit is issued to the applicant as operator of the facility and is not transferable. 2. The permit shall be subject to all applicable ordinances, codes, and regulations, and violation thereof shall be grounds for revocation. 3. Building plans are subject to review by the Building Official with respect to applicable codes. 4. Grading, drainage, utility, and berming plans are subject to review by the City Engineer. 5. A performance agreement and supporting financial guarantee (in an amount to be determined by the City Manager) shall be submitted to assure completion of approved site improve- ments. 6. Installation'of approved permanent concrete curb and gutter along the south edge of the parking and driving area as indicated on approved plans, may be deferred for up to two years pending future development, provided: Planning Commission Application No. 76067 (continued) • a. Notwithstanding the following conditions, the City may require installation of permanent curbing at an earlier time as may be deemed necessary. b. During the interim temporary bituminous rolled curbing will be installed along the south edge of the approved pavement. c. If during this period, the adjacent area should develop with a plan that would not require the curb, and the City Council approves that plan, the City would waive the curb requirement in that area. 7. All outside trash and parts disposal shall be screened from view. 8.. ", which specializes in providing games, rides and other equipment for fund raising events. The firm has acquired this property which is zoned I-2 and which contains an approximate 2,600 sq. ft, building. Plan approval is required as in the case of the Mikros Engineering building at y 50th and France which was reviewed earlier this year (Application No. 76050). The concerns are the same, essentially, for this I-2 use consisting of office and equipment storage (including certain outside storage): 1 . Parking, Paving and Curbing. There has been parking on the front yard over the years, and the driveway to the rear yard and the parking space in the rear are not paved or curbed. The ordinance requires at least 4 spaces for this structure. The applicant also has approximately 12 vans and light trailers which would be stored until moved to a client's site. 2. Landscaping. The front yard and boulevard area is worn and eroded from unauthorized parking over the years. There is no planting or sod. 3. Fire Protection. The building, like the Mikros Engineering building, was not equipped with an automatic fire extinguish- ing system. Recommended parking and site design will be discussed in detail. Recommended approval would be subject to the following: 1 . Grading, paving, curbing and drainage plans are subject to approval by the City Engineer. 2. The north yard area shall be rejuvenated and improved with sod, plantings, and an underground irrigation system. The required underground irrigation system shall be provided immediately following the upgrading of 50th Avenue North. 3. A performance agreement and supporting financial guarantee (in an amount to be determined by the City Manager) shall be submitted to assure completion of site improvements shown on the approved plans.
