The motion passed unanimously. -7- 6-10-76 The next item of business was consideration of Application No. 76035 Application No. 76035 submitted by Mr. Douglas (Douglas Peterson) Peterson. The item was introduced by the Secretary who stated the applicant was seeking rezoning, from R-1 to R-2, of the 15 , 495 square foot lot at 7212 Lyndale Avenue North to permit construction. of a duplex. The Secretary referred to the minutes of the May 13 , 1,976 meeting wherein reconsideration was given to Application No. 73004 which had been approved for Steven L. Boone Construction Company in 1973. He stated that application involved this parcel and the adjacent one to the north and the request had involved two things. rezoning of both parcels from R-1 to -4 and approval of a five-unit townhouse project on the site. He stated that one of the conditions of the rezoning had been that the two parcels be combined through platting, since neither parcel alone cc:,.1d support an R-4 or even R-3 type of development. He explained that the applicant had not proceeded with the development of the property and because it had not been combined, the ordinance had not been formally amended to rezone the property from R-1 to R-4. The Secretary stated that for all intents and purposes the property remained R-1 . Relative to the subj(--ct application, the Secretary stated there would be merit in including the adjacent parcel to the north in this rezoning so that both would be R-2 and that, .since the R-2 zoning district com- prehended single family or two family dwellings, the owner of the adjacent parcel, Mr. Boone, would be able to develop it either way. He stated that each parcel was large enough to support a duplex. Chairman Foreman recognized Mr. Peterson who explained that he personally had purchased the property and intended to construct a duplex on it. Voting in favor were Chairman Foreman, Commissioners Engdahl, Scott, Pierce, Horan, and Kohrt. Not voting: Commissioner Jacobson who explained that she was not at that meeting. The motion passed. In other business it was the consen�sus of the Other Business Commissioners to consider Application No. 76039 submitted by Lund-Martin Company seeking a variance from the automatic fire extinguishing system ordinance requirements at the June 24 study session so that it could be considered by the Council in conjunction with the site and building plans for the proposed facility comprehended under Application No. 76036. In other business the Secretary reviewed a number of pending applications and stated that the involving Application No. 76011 submitted by Dr. Robert Schell for John Horbal would be presented at the study meeting.
