October 15, 1970
The Planning Commission met in study session and was called to
order by Chairman Robert Jensen at 8:02 P.M.
Roll Call: Chairman Robert Jensen, Commissioners Robert
Gropshans, Paul Ditter and Karl Schuller were present. Staff
members present were: Tom Loucks and Bam Peterson.
Following the Chairman's explanation, the first item of
business was Application No. 70062 submitted by Joslyn Manufacturing
Company requesting a variance from Section 3-102.7 of the Building
Code which requires an internal sprinkling systems for building with
greater than 2,000 square feet of floor area and site and building
plain approval.
The application was introduced by Mr. Loucks who noted that the
structure would be a metal building used for the storage of steel
materials and that the applicant had indicated that the building
would be used for storage only and the potential fire hazard, such
as cutting and welding, would not take place in this building.
The ' staff indicated that in view of the types of materials to be
stored and that the operation to be conducted is of a non-flammable
nature and that no other buildings on the premises are sprinklered,...
the staff would recommend approval of the variance. In addition,
the 'staff recommended approval of the site and building plans
providing the usual conditions are adhered to.
Chairman Jensen then recognized Robert Jergensen of the Joslyn
Manufacturing Company who stated that the type of materials to be
stored in the building are steel cross arms utilized on power poles.
The building would be utilized for storage of these materials.
Chairman Jensen then recognized a representative of Dale Tile
Company who indicated that they had no opposition to the proposed
variance and site and building plans submitted by the applicant.
After a brief discussion among the Commission members, a
motion was made by Commissioner Schuller and seconded by Commissionex
Grosshans to recommend approval of the variance and site and
building plans because the proposed building is unique in that the
operation and materials to be stored are of a non-flammable nature.
Themotion carried unanimously.
The next item of business was a staff presentation of
Nursing Home Report #1. Mr. Loucks indicated that the report is
concerned with general items and standards that may be included in
a nursing home ordinance.
Mr. Peterson then backgrounded the Commission on the possible
devices that may be utilized to implement the ordinance.
After discussion of the various items presented, the concensus
of the Commission was that the ordinance study was moving in the
proper direction.

Mr. Loucks indicated that the staff is expanding the scope
of the study and felt that a draft ordinance would be forthcoming
at the end of October.
It was the consensus of the Commission that upon completion-
of the draft ordinance, that the Commission should meet in joint
session with the City Council to discuss and make comments in
regard to the ordinance.
The next item of business was a proposed Freeway Development
District ordinance.
Mr. Loucks presented the ordinance draft to the Commission
and indicated the philosophy and ramifications of such an ordinance.
After discussion and modification of the text, it was the
consensus of the Commission to recommend to the City Council
approval of the following ordinance:
AN ORDINANCE AMENDING CHAPTER 35 BY THE ADDITION
OF A FREEWAY DEVELOPMENT DISTRICT (FD)
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS
FOLLOWS:
Section 1: Chapter 35 of the City Ordinances is hereby
amenAed by the addition of the following:
Section 35-335. FREEWAY DEVELOPMENT DISTRICT.
1. Permitted Uses:
None. All uses in the Freeway Development District are
deemed to be special uses in order to provide for a
mixture of land uses made mutually compatible with
controls and high standards; to encourage and accommodate__
industry and commerce adjacent to freeways and express-
ways; to provide for integrated roadside business
designed to offer a group of services to the motoring
public in convenient locations; and so far as may be
possible, to protect freeway access points from con-
gestion by improper location of heavy traffic generating
land uses.
2. Special Uses:
All uses comprehended by Sections 35-320, 35-321, 35-322,
and 35-330, provided they meet the requirements as
promulgated by Sections 35-411, 35-412, 35-413, 35-414,
35-700, 35-701, 35-702, 35-703, 35-704, 35-710, 35-711,
35,-712 and 35-720 of the City Ordinances. All yard set-
backs shall meet the I-1 provisions of Section 35-400.
Section 2: Section 35-110 is hereby amended as follows:
Section 35-11. PERMITTED USES
Except as provided for in Section 35-11, no building or
premises may hereafter be used or occupied within a given land use
district unless it is a permitted use in that district or unless
it is authorized as a special use. Sections 35-310, 311, 312, 313,
314, 315, 316, 320, 321, 322, 330, 331, 335, 340, and 341 give the
various permitted and special uses.

Section 3: Section 35-300 is hereby amended as follows:

FD Freeway Development
5. Open Space
0-1 Public Open Space Reserved
0-2 Public and Private Open Space Reserved
The location boundaries of the districts established by this
ordinance are set forth in Sections 35-1100, 35-1110, 35-,11208
35-1130, 35-1140, 35-1150, 35-1160, 35-1170, 35-1180, 35-1190,
35-1200, 35-1210, 35-1220, 35-1230, 35-1240. Unless otherwise
indicated by relation to established lines, points, or features,
the district boundary lines are the centerlines of streets,
alleys, or railroad right-of-way, existing or extended.
Section 4: Chapter 35 is hereby amended by the addition of
the following:
Section 35-1240. FREEWAY DEVELOPMENT DISTRICT (FD)
Section 5: This ordinance shall become effective after its
adoption and thirty days following its legal publication.
Motion by Ditter and seconded by Schuller to adjourn. The
motion carried unanimously. The meeting adjourned at 11:30 P.M.
