Planning Commission in the City of
Brooklyn Center in the County of
Hennepin and State of Minnesota
November 5, 1970
The Planning Commission met in regular session and was called to
order by Chairman Robert Jensen at 8:12 P.M.
Roll Call: Chairman Robert Jensen, Commissioners Robert Gross-
hans, Paul Ditter, Karl Schuller and Henry Bogucki. Staff members
present were: Jim Merila and Tom Loucks.
Motion was made by Commissioner Schuller and seconded by
Commissioner Bogucki to approve the minutes of the October 15th
study session as submitted. Motion carried unanimously.
Following the Chairman's introductory comments, the first item
of business was Applications No. 70063 and 70064 submitted by Harold
Swanson requesting preliminary plat approval, site and building plan
approval, and a seven foot green strip variance.
Mr. Loucks introduced the preliminary plat and indicated that
the applicant is proposing to divide the property, legally described
as Auditor's Subdivision No. 309, Lots 1 and 2, except the North
33 feet of Lot 1, into three parcels that would be described as
Swanson's Addition, Lots 1, 2 and 3. He indicated that the appli-
cant is requesting the division to facilitate the building of two
four unit and one seven unit multiple dwellings. Mr. Loucks
recommended approval of the preliminary plat providing that cross
easements for driveways are indicated on the plat. He explained
that the staff is recommending these easements because there is a
P3ci_h _l.ity that at some future date, Lyndale Avenue would be up-
graded and that the access points of the proposed seven and four
unit buildings on the south may be cut off at Lyndale Avenue, thus
requiring that access to the properties in question be located at
73rd Avenue North. He further indicated that the staff would
suggest additional elevations and drainage easements be submitted to
the City Engineer prior to final plat approval.
Mr. Loucks then recommended approval of site and building plans
on the three sites providing the usual conditions of plan approval
are adhered to and providing that the seven foot green strip
variance for the seven unit building is approved by the Commission.
It was explained that the applicant does have enough room to develop
the parcel without the variance on Lot 2; however, the parking lot
and traffic lane as required by the ordinance would have to be moved
to within one foot or less of the seven unit building which would be
undesirable. Mr. Loucks noted that an eight foot green strip aug-
mented by tree plantings and a six foot fence would probably be
preferable to the alternative of parking cars abutting the seven
unit building.
Commissioner Bogucki then asked if Lyndale Avenue (West River
Road) were up-graded to a four lane facility, would such upgrading
require purchase of a portion or all of the subject property. Mr.
Merila indicated that a four lane facility could be constructed on
the existing 66 foot right-of-way of Lyndale Avenue assuming that
an urban design section is applied and further indicated that if
a divided four lane facility such as is proposed by the Comprehensive
Plan were required, it could be built within the limits of a 100
foot right-of-way which would still give the proposed buildings
approximately 35 feet of front yard setback. The staff indicated

that the recent Metropolitan Development Guide Transportation Study
dated August, 1970, does not address itself to T.H. 169 specifically,
but, in light of the general roadway patterns as discussed in the
report, and in view of the proposed roadway development pattern as
indicated in the report, it appears that Lyndale Avenue will probably
be no greater than a four lane facility. It was further indicated by
Mr. Merila that the staff would direct a letter to the Minnesota
Highway Department requesting confirmation of future development
on T.H. 169.
Motion was made by Commissioner Grosshans and seconded by
Commissioner Schuller to recommend to the City Council approval of
the site and building plans subject to the following conditions:
1) All areas shown as parking or driveway areas be curbed
including those areas designated as future garage;
2) The fence on the northeast portion of the property
adhere to the ordinance requirements in regard to
height and line of sight at street entrances;
3) Building plans are subject to the approval of the
Building Inspector with respect to applicable
building codes;
4) Utility, drainage and elevation plans are subject
to the approval of the City Engineer prior to the
issuance of the building permit;
5) A performance agreement and performance bond (in
an amount to be determined by the City Manager)
shall be submitted to the City to guarantee site
improvements as designated on the plans submitted
to the City.
The motion carried unanimously.
Motion was made by Commissioner Grosshans and seconded by
Commissioner Schuller to recommend to the City Council approval of
the preliminary plat providing the proper driveway, utility, and
drainage easements are shown on the plat and that additional
elevations are submitted to the City Engineer for approval. The
motion carried unanimously.
Motion was made by Commissioner Ditter and seconded by
Commissioner Grosshans to recommend to the City Council approval
of the green strip variance because it would not be a detriment to
the abutting property owners and it does not violate the intent
of the green strip requirement as promulgated by the City Zoning
Ordinance. The motion carried unanimously.
The next item of business was Application No. 70061 submitted
by Ernst, Lane and Ernst requesting a rezoning and site and building
plan approval. Mr. Loucks indicated that the staff had requested
additional site information from the applicant and in view of this
further requirement, it is requested by the applicant to table any
action upon the application until December 3, 1970.
Motion was made by Commissioner Bogucki, seconded by
Commissioner Schuller, to table Application No. 70061 until Dec-
ember 3, 1970. The motion carried unanimously.

The next item of business was a discussion among the Planning
Commissioners in regard to the Midwest Planning Study as it relates
to the Southwest Neighborhood. It was the consensus of the
Commission that the report and the changes as suggested by Midwest
Planning had far reaching effects and further, that the plan should
be presented to the Southwest Neighborhood Committee, and that the
Planning Commission special study meeting of November 24th should
be devoted to discussion of the report with the neighborhood committee.
Motion was made by Commissioner Schuller and seconded by
Commissioner Grosshans to conduct a special study meeting on
November 24, 1970, to formally review with the Southwest Neighborhood
Committee the Midwest Planning Study. The motion carried
unanimously.
The next item of business was discussion of proposed parcels
to be included in the Freeway Development zone. The staff presented
a map, identified as Exhibit I, and backgrounded the Commission on
those areas deemed to be appropriate as Freeway Development zones.
After discussion of the proposed zones, a motion was made by
Commissioner Schuller and seconded by Commissioner Ditter to
recommend Exhibit I, as revised, to the City Council as those
areas deemed potential Freeway Development zones. Motion carried
unanimously.
Motion by Commissioner Bogucki and seconded by Commissioner
Schuller to adjourn. The motion carried unanimously. The Planning
Commission meeting adjourned at 11:15 P.M.
