March 25, 1971
The meeting was called to order by Chairman Robert Jensen
at 8:01 P.M.
Roll Call: Chairman Robert Jensen, Commissioners Cecelia
Scott, Henry Bogucki, Robert Foreman, Karl Schuller and Paul
Ditter. Staff members present were Tom Loucks.
The first item of business was a resolution affirming the
action of the Building Inspector in denying a building permit
to the Riverside Motel.
Member Henry Bogucki introduced the following resolution
and moved its adoption:
RESOLUTION NO. 71-1
RESOLUTION AFFIRMING THE ACTION OF THE BUILDING
INSPECTOR IN DENYING A BUILDING PERMIT TO THE
RIVERSIDE MOTEL
WHEREAS,. the Board of Appeals anC Adjustments of the City
of Brooklyn Center has heard testimony on January 7, 1971, and
on March 4, 1971, regarding the valiCity of a denial by the
Building Inspector of a request for a building permit by the
Riverside Motel, the Board of Appeals and Adjustments makes
LhP following findings:
I. That the Riverside Motel, as described in the
files of the Board of Appeals and Adjustments,
is a non-conforming land use located in a
district zoned for two family residences.
2. That a building, 18h feet by 54 feet, containing
five motel units was constructed in 1949; that
a building being roughly 14 feet by 60 feet and
containing four motel units was constructed in 1939;
that a space of approximately 4 feet in width,
containing stairs leading to the lower level,
separates these two buildings; that a residence
and garage was constructed at some unknown date,
a portion of the basement of the residence was
converted to one motel unit and a portion of the
first floor was converted to office use; that a
distance of approximately 63� feet separates the
residence from the four unit building; and that the
entire complex described was connected by a common
roof line at some unknown date (all as depicted
on the survey in the file of the Board of Appeals
and Adjustments and dated the 14th day of January,
1971, which is attached hereto and made a part
thereof by reference) ; and
WHEREAS, the Board of Appeals and Adjustments heard
evidence to determine if the motel use was a single building
or three separate buildings connected by roof line; and

WHEREAS, the Board of Appeals anc Adjustment heard evidence
to determine if the building was more than 60% destroyed, and
whether it was three buildings or a single building; and
WHEREAS, based upon the evidence brought forth in this
regard, the Board of Appeals and Adjustments ascertains:
1. That using the multi-builcing approach, the
southerly building was 100/ destroyed by fire
and explosion;
2. That using the single building approach:
A. The market value of the non-conforming use was
diminished by 68/ due to such explosion and
fire;
B. That the number of square feet contained within
the non-conforming use (excluding the residence)
was diminished by 64% due to such fire and
explosion;
C. That the number of square feet contained within
the non-conforming use (including the portion
of the residence converted to the motel use)
was diminished by 59.48% through such fire
and explosion.
D. That the basic character of the destroyed portion
was that of an income producing nature;
E. That the gross income of the non-conforming use
was diminished by 66/ as a result of the explosion
and fire;
F. That the remaining non-conforming use can not be
operated as a viable economic unit.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF APPEALS AND
ADJUSTMENTS OF THE CITY OF BROOKLYN CENTER that the action of
the Building Inspector in denying a building permit to the
Riverside Motel is hereby affirmed.
Member Robert Foreman seconded the motion and upon a vote
being taken thereon, the following voted in favor thereof:
Robert Jensen, Cecelia Scott, Robert Foreman and Henry Bogucki;
and the following voted against the same: none; whereupon said
Resolution was declared duly passed and adopted.
The Commission next reviewed the Southwest Neighborhood
Committee Report. following a lengthy review and discussion, it
was the consensus of the Commission to take the matter up again
at the meeting of April 1, 1971.
Notion was made by Commissioner Scott and seconded by
Commissioner Foreman to adjourn. The motion carried unanimously.
The meeting adjourned at 10:30 p.M.
