Planning Commission of the City of
Brooklyn Center in the County of
Hennepin and State of Minnesota
April 1, 1971
The Planning Commission met in regular session and was called
to order by Chairman Robert Jensen at 8:01 P.M.
Roll Call: Chairman Robert Jensen, Commissioners Cecelia
Scott, Robert Foreman, Henry Bogucki, Karl Schuller, Robert Gross-
hans and Paul Ditter. Staff members present were: Tom Loucks.
Following the Chairman's explanation, Mr. Loucks introduced
Planning Commission Applications No. 71006 and 71007 explaining
that Village Builders is requesting preliminary plat approval for
23 parcels to be utilized for single family home development in
the area south of 69th Avenue North and adjacent to Colfax Avenue
North. He further commented that the applicant is also requesting
a 15 foot rear yard setback variance for a home located at 921 -
69th Avenue North and a seven foot sideyard variance for a home
located at 1005 - 69th Avenue North, indicating as the homes exist,
they meet ordinance requirements, however, because of the proposed
plat configuration, variances would be required for the homes in
question.
It was noted that alternatives to variances for the homes in
question would be either physical removal of the existing homes
or platting of the property to provide larger parcels of approxi-
mately 22,000 square feet each. It was then noted that the pre-
liminary plat is in accord with the City Subdivision regulations
and it was recommended that it be approved subject to affirmative
recommendation of the variances requested.
Chairman Jensen then recognized Mr. Ed Kauffman of Village
Builders who reviewed the preliminary plat proposal and indicated
the types of homes to be constructed if the plat is approved and
further indicated whathe felt was a difficulty in platting the
property in question without variances being granted. He furtlaer
noted that he felt that the existance of the homes in the proposed
plat constituted a hardship and requested that the variances be
granted.
Chairman Jensen then recognized the affected property owners
present at the meeting and it was the consensus of those in
attendance that they would not be opposed to the preliminary plat
or the side and rear yard variances.
A discussion ensued among the Commission members at which
time Commissioner Bogucki noted that the existance of homes in
the plat is somewhat unusual and that if the ordinance require-
ments for setbacks were adhered to, it would create substandard
parcels and require a variance to that end, and if the parcels
were platted as larger lots, they would be almost double the
minimum lot size requirement.
Motion was then made by Commissioner Grosshans and seconded
by Commissioner Foreman to recommend to the City Council approval
of Planning Commission Application No. 71006 requesting a 15 foot
rear yard setback for a home located at 921 - 69th Avenue North
and a seven foot side yard variance for a home located at 1005 -
69th Avenue North, because a hardship would be created by

requiring unusual sized lots either substandard in nature or
extremely large in square. footage if the variances were not
granted. Motion carried unanimously.
Motion was made by Commissioner Bogucki and seconded by
Commissioner Schuller to recommend to the City Council approval
of Application No. 71007 with the special condition that no
properties located adjacent to 69th Avenue have direct vehicular
access to that street. Motion carried unanimously.
The next item of business was review of the Southwest Neigh-
borhood Report.
A discussion ensued at which time it was noted that there were
a number of errors in the basic data presented in the report and
some misconceptions of why the industrial property was zoned
as such in accordance with the existing Comprehensive Plan.
Following a brief discussion, it was noted that the staff
is directed to contact Midwest Planning and request that
they be available to explain various aspects of the plan at the
meeting of April 15th, 1971.
Motion was made by Commission Schuller and seconded by
Commissioner Grosshans to adjourn the meeting. The motion
carried unanimously. The meeting adjourned at 12:15 A.M.
