.Planning Commission of the City of
Brooklyn Center in the County of
Hennenin and State of Minnesota
July 1, 1971
The Planning Commission met in regular session and was called
to order by Chairman Robert Jensen at 8:00 P.M.
Roll Call: Chairman P.obert Jensen, Commissioners Henry
Bogucki, Karl Schuller, Robert Grosshans, Paul Ditter and
Cecelia Scott. Staff members present were: Tom Loucks.
Motion was made by Commissioner Bogucki and seconded by
Commissioner Ditter to approve the minutes of meetings of
April 1, April 15, May 6, and June 3, 1971, as submitted. The
motion carried unanimously.
Following the Chairman's explanation, the first item of
business was dunning Commission Application No. 71021.
The item was introduced by Mr. Loucks who indicated that the
applicant is proposing to construct a double bungalow on a parcel
with dimensions of 75 feet by 135 feet and a square footage of
10,125, located at 5302 Girard Avenue North. It was noted that
the Zoning Ordinance requires a 90 foot front yard width for a
corner lot, 12,400 square feet of lot area to construct such
as is being proposed, and therefore the applicant is requesting
a 15 foot lot width variance and a 2,275 :square foot lot area
variance.
Chairman Jensen. then .recognized Mr. William Holmberg who
indicated that the property is zoned R2, that he is requesting
the variances to enable him to construct a duplex dwelling for
which the property is zoned.
A discussion ensued among the Commission members at which
time Commissioner_ Bogucki noted that the applicant is attempting
to develop a duplex on a piece of property that is so substandarA
in nature that it would require variances if a single family
home were to be constructed on the same parcel. He further
indicated that, in his opinion, the applicant is asking to
put too much building on a site that can not adequately support it.
Chairman Jensen commented that although the property was
rezoned to R2 in 1968, in accordance with the recommendations
of the Comprehensive Plan, it was not the intent of the Planning
Commission at that time to allow double bungalow construction on
substandard parcels but rather to encourage redevelopment in the
area on parcels of adequate size to support an R2 use.
Following further discussion, a motion was made by
Commissioner Bogucki and seconded by Commissioner Schuller to
close the public hearing. Motion carried unanimously.
Motion was made by Commissioner Bogucki and seconded by
Commissioner Schuller to direct the staff to prepare a resolution
recommending denial of Planning Commission Application No. 71021.
The motion carried unanimously.
The next item of business was Planning Commission Application
No. 71022 submitted by Merlin West.

The application was introduced by Mr. Loucks who indicated
that the applicant is proposing to construct a swimming pool
with a si;. foot high screening fence in the side yard of a
pro aerty located at 6001 Vincent Avenue North. It was indicated
that the Zoning ordinance requires that fences, hedges, or walls
can be constructed in side yards provided t11.ey do not exceed
four feet in height anI therefore the applicant is requesting
a 2 foot height variance to allow construction of the fence.
A discussion ensued among the Planning Commission members
at which time it was noted that it would appear that the fence
proposed would not constitute an obstruction of the sight
triangle at the intersection of 60th and Vincent Avenues since
it would be set back the same distance as the front yard setback
of the building, however, that there may be some difficulty in
the proposal in that the driveway of the adjacent property to
the north would abut the fence and consequently cause a sight
obstruction for a vehicle backing out of the driveway. Further
discussion ensued at which time Commissioner Boqucki asked the
applicant if the intent of the fence was to provide privacy or
security for the pool area.
Mr. West responded that it was his intent to have the fence
function for both purposes.
Following furth3r discussion, a motion was made by
Conmiissi.oner Schuller and seconded by Commissioner Bogucki to
table Planning Ccriuuission Application No. 71022 until July 15,
1971, to give additional time for the applicant to determine
if there were other alternatives available in fence design that
would permit privacy and security in the pool area while at the
same time not obstructing vision of drivers of vehicles attempting
to back out of the driveway to the north. The notion carried
unanimously.
The next item of business was Planning Commission Application
No. 71023 submitted by Tomas Construction company.
The item was introduced by Mr. Loucks who indicated that the
applicant is requesting site and building plan approval for a
two phase 240 unit apartment complex to be located at 70th Avenue
North and Lyndale Avenue North. It was noted that the plans
had been reviewed and found to be in compliance with all zoning
ordinance requirements.
Following a brief review, a motion was made by Commissioner
Bogucki and seconded by Commissioner Scott to recommend to the
City Council approval of Planning Commission Application No.
71023 subject to the following conditions:
1. Building plans are subject to the approval of the
Building Inspector with respect to applicable
building codes;
2. Utility, drainage and elevation plans are subject
to the approval of the City Engineer prior to the
issuance of the building permits;
3. A performance agreement and performance bond (in an
amount to be determined by the City Engineer) shall
be submitted to the City to guarantee the site
improvements as designated on the plans submitted.
The motion carried unanimously.

The next item of business was P1:=.nning Commission Appli-
cation No. 71024 submitted by Brooklyn center Industrial Park
(Nino's Steak House) .
The item was .introduced by Mr. Loucks who indicated that
the applicant is requesting site and building plan approval
for a 9,000 square fcct. restanr3rt to co.i4ain dining areas,
bar and banquet rooms for a property located west of John
Martin Drive and north of the proposed theater site on the
Earle Brown Farm. It was noted that the proposal includes
a provision for joint parking between the proposed theater site
to the south and the parking areas for the steak house. It was
further commented that because of this unique circumstance,
additional consideration should probably be given to traffic
circulation between the two sites.
Upon review of the site plan, a number of alternatives in
regard to traffic circulation were discussed and it was the
consensus of the Commission to modify the circulation pattern
in the area of the entrance to the property.
Following a brief discussion, a motion was made by
Commissioner Ditter and seconded by Commissioner Scott to
recommend to the City Council approval of Planning Commission
Application No. 71024 subject to the following conditions.
1. That the areas on the proposed theater site to
be utilized for joint parking be constructed in
conjunction with the development of Nino's Steak House,
and further, that a cop, of the joint parking
agreement document be placed in the Planning
Commission files;
2. Lighting plans not be finally approved until
constructed and adjusted;
3. That all roof mechanical equipment be screened in
accordance with ordinance requirements;
4. Utility, drainage and elevation plans are subject
to the approval of the City Engineer prior to the
issuance of a building permit;
5. Building plans are subject to the approval of the
Building Inspector with respect to applicable
building codes;
6. A performance agreement and performance bond
(in an amount to be determined by the City Manager)
shall be submitted to the City to guarantee site
improvements as designated on the plans submitted.
The motion carried unanimously.
Motion was made by Commissioner Bogucki and seconded by
Commissioner Schuller to adjourn. The motion carried unanimously.
The Planning Commission meeting adjourned at 11:15 P.M.
