Minnesota • W�. •rar.rY"� October 1, 1971 The Planning Commission met in regular session and was called to order by Chairman Robert Jensen at 8:00 P.M. Roll Call: Chairman Robert Jensen, Commissioners Karl Schuller, Paul Ditter, Cecelia Scott, Robert Foreman and Henry Bogucki. Staff members present were: Tom Loucks and James Merila. Motion was made by Commissioner Schuller and seconded by Commissioner Foreman to approve the minutes of August 17, September 2, and September 21, 1971, as submitted. The motion carried unanimously. Following the Chairman's explanation, the first item of business was Planning Commission Application No. 71038 submitted by P. Hankey. The item was introduced by Mr. Loucks who indicated that the applicant is requesting a Special Use Permit for a home occupation consisting of a beauty shop to be operated in the basement of the home located at 5907 Halifax Avenue North. Chairman Jensen then noted that a letter signed by Mr. Roy K. Thomas, Jr. , of 5919 Halifax Avenue North, had been submitted to the file expressing opposition to the issuance of a special use permit because it was felt that a beauty shop woii]d bP a commercial encroaclu►uent into a resi.denti.al neighborhood. Following further brief discussion, a motion was made by Commissioner Schuller and seconded by Commissioner Scott to recommend approval of Planning Commission Application No. 71038 subject to the following conditions: 1. That a copy of the beauty shop and beauty operator's license, as issued by the State of Minnesota, be placed on file with the planning Commission Application prior to the commencement of the operation. 2. That the permit be reviewed on an annual basis and subject to revocation should the use prove to be a disruptive influence on the immediate neighborhood. The motion carried unanimously. Chairman Jensen left the meeting at 8:20 and turned the gavel over to Commissioner Bogucki. The next item of business was Planning Commission Application No. 71039 submitted by Brooklyn Center Industrial Park. The item was introduced by Mr. Loucks who indicated that the applicant is requesting preliminary approval for a replat of Tract B, Registered Land Survey No. 1300, Lot 1, Block 3, Twin Cities Interchange Park Addition, Orutlots B and C, Brooklyn Center Industrial Park Plat I, and Part of Lot 1, Block 3, Twin Cities Interchange Park Addition and combining the parcels into a Registered Land Survey consisting of 21 tracts. i 1 -2- Following a review of the survey document, Mr. Merila commented that tract R, of the proposed R.L.S., should be modified to show a 45 foot width in lieu of 35 feet as depicted; that the Registered Land Survey be put on a composite sheet in lieu of the three sheets as submitted; and that due to the anticipated need for ease- ments being granted between Tracts Q, R and S, that those documents be filed with the Registered Land Survey. Discussion ensued at which time Mr. Krogness of Brooklyn Center industrial Park commented that City requirement that a portion of Tract R should be widened to 45 feet had not been considered by the applicant. Mr. Merila commented to the Commission that the area in question is going to be utilized for roadway purposes and it is felt that additional width should be provided for snow storage. Following a rather lengthy discussion related to roadway width, a motion was made by Commissioner Ditter and seconded by Commissioner Foreman to table Application No. 71039 to allow the staff additional time to review the matter and bring it before the Commission on October 21, 1971. The motion carried. The next item of business was Planning Commission Application No. 71047 submitted by Henning Nelson Construction. The item was introduced by Mr. Loucks who indicated that it is the intent of the applicant to construct an 8,000 square foot handball club on a parcel located west of John Martin Drive and aa}acent to the north parking lot of the Ci.nPma T-IT--TTT theater site. It was noted that approximately 5,000 square feet of the facility consists of handball courts and that the applicant is requesting that those areas be exempted from the fire sprinkler system requirement. Chairman pro-tern Bogucki then recognized Mr. Steve Krogness representing the Industrial Park and Mark Reinertson representing Henning Nelson Construction Company, who commented to the effect that it was their feeling that the sprinkler system is not warrented in the handball court area because of the single purpose use to take place in the courts and, secondly, }because the materials to be utilized are of a highly fire resistant nature. It was commented by Mr. Loucks that the arguments posed by the applicant may have merit only if one considers that the court area would never be utilized for any other purpose. Chairman Protem Bogucki commented that it does appear that handball courts themselves are rather unique and that the sprinkler system may not necessarily be appropriate in this instance. Following further discussion, a motion was made by Commissioner Scott and seconded by Commissioner Foreman to recommend approval of Planning Commission Application No. 71047 subject to the condition that adequate size piping be installed for the internal sprinkler system should the use change at a later date and require sprinklers. The motion carried. Chairman Jensen returned to the meeting at 9:10 P.M. The next item of business was Planning Commission Application No. 71048 submitted by Henning Nelson Construction. 1 1 1 -3- The item was introduced by Mr. Loucks who indicated that the qpiplicant is requesting site and building plan approval for an 8,000 square foot handball club to be located on a parcel west of John Martin Drive and adjacent to the north parking lot of Cinema I-II-III theater site, and in addition, is also requesting approval of a joint parking facility with the theater operation. Following a brief review of the site and building plans, a motion was made by Commissioner Bogucki and seconded by Commissioner Schuller to recommend approval of Planning Commission Application No. 71048 subject to the following conditions: 1. Plans submitted be signed by a registered architect or engineer; 2. A more detailed landscaping plan be submitted to the staff for review depicting specific identification of sizes and types of trees and shrubs to be utilized on the site; 3. Drainage and utility plans are subject to the approval of the City Engineer prior to the issuance of a building permit; 4. Building plans are subject to the approval of the Building Inspector with respect to applicable building codes; 5. A performance agreement and performance bond (in an amount to be determined by the City Manager) shall be submitted to the City to guarantee the site improve- ments as designated on the plans submitted. The motion carried unanimously. The next item of business was Planning Commission Application No. 71049 submitted by C. W. Gustafson. The item was introduced by Mr. Loucks who indicated that the applicant is requesting a 2 foot height variance to allow construction of a 6 foot high fence to abutt a street right-of-way on a property located at 3801 - 66th Avenue North. It was noted that the rear yard of this property in question abutts Brooklyn Boulevard, and is adjacent to the southeast ramp of Interstate 94 and it is the intent of the applicant to construct the 6 'foot high fence to serve as a noise barrier and privacy device from the traffic on Brooklyn Boulevard and the freeway entrance. Following a brief discussion, a motion was made by Commissioner Bogucki and seconded by Commissioner Ditter to approve Planning Commission Application No. 71049 because of the unique circumstances related to the property in question, and further, that not granting of the variance because of the circumstance would constitute a hardship. The motion carried unanimously. The next item of business was Planning Commission Application No. 71050 submitted by Topeka Inn, Inc. It was noted by Mr. Loucks that the Topeka Inn Management has contacted the staff late in the afternoon of October 7, 1971, and asked that the variance request contained in Application No. 71050 be tabled until a later date. 1 1 ' 1 -4- Motion was made by Commissioner Bogucki and seconded by Commissioner Scott to table Planning Commission Application No. 71050 until October 21, 1971. The motion carried unanimously. The next item of business was Planning Commission Application No. 71051 submitted by George Nerburn. The application was introduced by Mr. Loucks who indicated that the applicant is requesting a five foot side yard variance to allow conversion of an existing attached garage into a family room on a property located at 1100 - 694 Avenue North. It was noted that the existing garage has a five foot sideyard setback and the ordinance requirement is 10 feet for a living unit. Following a review of the proposed plan and a brief discussion, a motion was made by Commissioner Bogucki and seconded by Commissioner Foreman to recommend approval of Planning Commission Application No. 71051 because it meets the intent of the Zoning Ordinance for granting of such a request, and further that variances of a similar nature have been granted in the past. The motion carried unanimously. Motion was made by Commissioner Schuller and seconded by Commissioner Bogucki to adjourn. The motion carried unanimously.
