A brief discussion ensued and the Secretary recommended that 1ct 7 should also be included in the R.Z.S. so to clarify the situation regarding the 10 foot parcel. He noted that the already deficient Corner lot at 6001 Bryant would be even more deficient as to area , but that the building setbacks as indicated on the boundary survey were within ordinance limitations. Chairman Gross then recognized Mr. David Brandvold who stated his concern as to the additional cost of including the lot in the subdvision. He stated that he questioned whether there was a need for its inclusion since it was not involved in the proposed creation of a new lot. The Secretary responded that, whereas the applicant's primary concern was to create a buildable interior lot on Colfax Avenue, the subject property belonged to the owner of Lot 8 who was also the owner of the subject 10 foot appendage. The item was introduced by the Secretary who explained that the applicant has assumed' operation of the Timmersman Nursery School, which was approved under Application No. 74013 on March 11 , 1974 and is located at the United Methodist Church, 7200 Brooklyn Boulevard . He commented that the operation would be essentially the same and that the applicant had indicated there would be fewer students and that the hours of operation would be as follows: Monday , Wednesday 9:00-11:30 a .m. 12:30-3:00 p.m. Tuesday , Thursday 9:00-11:30 a .m. 12:30-3:00 p.m. -3- 8%14!75 He stated the premises have been reinspected by the Building Official who reports everything to be in compliance, Chairman Gross recognized the applicant and a brief discussion ensued as to the nature of the operation. Commissioner Horan inquired as to the location of outside play equipment and the ap_ ` .cant responded it was located in the yard area just north of the church building. Following further discussion there was a motion by Recommend Approval of Commissioner Jacobson, seconded by Commissioner Application No. 75023 Pierce to recommend approval of Planning Commission (Patricia Williams) Application No. 75023 submitted by Patricia Williams subject to the following conditions: 1 . The permit is issued to the applicant as operator of the facility, and is nontransferable. 2. The permit is subject to compliance with all applicable codes, ordinances and regulations, and violation thereof shall be deemed grounds for revocation. 3 . A current copy of the required State licenses shall be kept on file with the City. The operation is subject to at least annual review. TI-ie motion passed unanimously. The next item of business was consideration of Planning Application No. 75026 Commission Application No. 75026 submitted by Mr. (Clarence Stiehm) Clarence Stiehm. The item was introduced by the Secretary who stated the applicant's proposal would create nine R-1 zoned parcels. He stated one parcel at the north- east corner of Knox Avenue and Woodbine Lane, includes a small remnant parcel approved in 1972 as part of Registered Land Survey 1328 (Mrs. Pearl Lynch) . He stated that that parcel retains the 77 .7 foot width; however, enough land has been attached to the north to result in the ordinance required corner lot area of 10 ,500 square feet (proposed Tract G) . He stated that the proposed Tract H to the north on Knox Avenue has an average depth of 85 feet but that enough land had been added in length to result in an interior lot area of approximately 10,028 square feet which exceeds tl-.te ordinance minimum of 9,500 square feet. An extensive discussion ensued relative to the depth of the subject lot w-.1-13ch would be 80 feet on the south, 90 feet on the north. C --7ern was noted as to the ability to locate a structure on the lot given the normal ordinance setback. Application No. 75025 The next item of business was consideration of Planning (LeRoy Smith) Commission Application No. 75025 submitted by Mr. LeRoy Smith, 5607 Halifax Avenue North. The item was introduced by the Secretary who stated the applicant seeks approval :.Ilf a proposed Registered Land Survey which would permit the transfer of a wedge of land between the adjacent property owners of 5607 and 5615 Halifax Avenue North. He stated the additional land is needed to provide for the required sideyard setback for a garage addition at the applicant's residence. The Secretary also noted that the Registered Land Survey would formally incorporate a portion of an outlot in the in the subdivision with the lot at 5615 Halifax Avenue North (proposed Tract A) . The Secretary recommended that Lot 3 of the subject addi- tion. (Dale's Twin Lake Addition) which fronts onto Indiana Avenue North be included in the Registered Land Survey 8/14/75 since it abutted and had been combined for tax purposes with the westerly portion of the outlot in a similar fashion to Lot 1 . He stated that the owner of Lot 3 had agreed to participate in the Registered Land Survey and he noted that the subject parcel was vacant at this time. Following a brief discussion there was a motion by Close Hearing Commissioner Jacobson, seconded by Commissioner Horan to close the public hearing. The motion passed unanimously. The meeting recessed at 9:05 p.m. and resumed at 9:20 p.m. Recess The next item of business was consideration of Planning Application No. 75i=b 7 Commission Application No. 75027 submitted by Hiawatha (Hiawatha Rubber ( o.) Rubber Company. The item was introduced by the Secretary who stated the applicant proposes a two-phase, light man- ufacturing industrial building at the westerly radiant of the 67th and James Avenue cul-de-sac. He stated the first phase building would be 36,000 square feet in area . The Secretary and Director of Public Works then reviewed the proposed site and building plans and a brief discussion ensued as to concerns with respect to the design of the entrance to the site; the need for additional berming on the perimeter of the southerly portion of the site and the need to indicate sodding of the bermed area adjacent to the building on the north side. 'Chi Secretary noted that the applicant was proposing to defer installation of concrete B-612 curb and gutter along the Phase I construction limit and along the west parking lot boundary north, of the building. He stated the plans indicated a temporary bituminous curb and gutter which would be provided until such time that concrete curb and gutter was deemed necessary or until such time Phase II occurred. Chairman Gross then recognized Mr. Arthur Popehn, President of Hiawatha Rubber Company, Mr, Robert Orth, the applicant's contractor, and Mr. Wilson Montgomery, the architect for the project. Further discussion ensued as to the layout of the site and the nature of the truck traffic into the project. Mr. Popehn presented an extensive description of the manufacturing operation and exhibited examples of the end products. Building plans are subject to review by the Building Official with respect to applicable codes, prior to issuance of permits. 2 . Grading , drainage , utility and berming plans are subject to review by the City Engineer, prior to the issuance of permits. 3 . A performance agreement and supporting financial guarantee (in an amount to be determined by the City Manager) shall be submitted to assure com- pletion of approved site improvements. 4 . Landscaping and development of Phase II area may be deferred provided the area is platted and rnaLi-,talned with a viable turf. -7- 8/'14%75 14/75 5 . Required installation of permanent B-612 curb and gutter along the north line of Phase I driving and parking area may be deferred for three years, pending the development of the northerly portion of the site, subject to the following conditions: a . During the interim period temporary bituminous curb and gutter will be installed along said northerly line as indicated on approved plans. c. If, during this period of time, the adjacent area should develop with a plan that would not require curb and gutter and the City approved that plan, the City could waive the curb requirements in this area . 6. All rooftop mechanical equipment shall be appropriately screened to be aesthetically compatible with the structure. 7. Outside storage and maintenance of equipment is expressly prohibited. 8. Revised plans shall be submitted prior to the Council meeting indicating the noted improvements as to entrance way design, additional berming and additional sodding. The motion passed unanimously. The next item of business was consideration of various Amendments to Application. amendments to site and building plans contained in No. 74040 (Gabbert Application No. 74040 submitted by Gabbert and Beck, Beck) Inc. The item was introduced by the Secretary who stated that the applicant proposed certain changes with respect to the site and building of the Westbrook Mall which is currently under construction. He stated one of the amendments involved the construction of an air conditioning system cooling tower and screening device on the west side of the building near the service entrance. He stated that the applicant proposed to screen the area with materials compatible with the structure. He stated that this cooling tower would be in lieu of a number of roof top units and that, as a result of certain modifications in the design of the curb line at that location, it could be adequately located as indicated on the revised site plan. Ie stated that the applicant also seeks approval of an increase in the number of deferred parking spaces. He noted the original approval, July of 1974, comprehended two phases of development: one phase includes the existing N.S.P. power line easement and the second phase would be the site without the easement and included a conceptual freestanding building near Xerxes Avenue. He noted that the City Council had approved a deferral of 95 parking spaces in the first phase and that the 8/14/75 -8- f -7, -,. -% applicant was requesting a de.—rri] 1. 4 ;spaces, �~ an increase of 29 spaces. The applicant stated his concern that, If the delineators -v,!;' r e. to be 40 feet long , the proposed screening treatment consist- ing of vertical random length boards would not be desirab.k-: since that would result in a long wall effect. Chairman Gn-.,s's agreed and suggested that there was definit(aly a need for delineators approximately 40 feet in length for the reason cited by the Director of Public Works, and he suggested that the applicant develop alternative material and design criteria ic- provide screening in those delineators subject to the approval of the City staff. Chairman Gross also commented, that it appeared that the exterior finish and entrance tower design had been altered from the plans approved in July , 1974 The Secretary stated that there had been some modifications as to the application of the exterior finish and as to the geometric design of the entrance towers. Mr. Beck explained in detail. the reason for the alteration which was necessitated for both economic and and design reasons. Commissioner Engdahl inquired as to whether bicycle racks would be provided and Mr. Beck responded that while they had not been indicated on the submitted plans, they were to be installed around the Center. -9-- 8/14/75 A brief discussion ensued with respect to trash disposal facilities and the applicant indicated all trash disposal would be through compaction within the Center and that trash containers would be contained inside the building, Following further discussion, there was a motion by Recommend Approval. of Commissioner Engdahl, seconded by Commissioner Amen�irnents to Applim-,+,!�)In Jacobson to recommend approval of the amendments to No. 74040 (Gabbert & the site and building plans contained in Application Beck) No. 74040 submitted by Gabbert and Beck subject to the original conditions of approval and particularly the following: 1. Installation of certain parking stalls as indicated on the approved site and building plans may be deferred until deemed necessary by the City Council, providing such deferred areas are developed, landscaped and maintained in accordance with approved site plans and ordinance requirements. 2. Site plans shall be subject to review in July, 1976 with respect to deferral of certain site improvements necessitated by the existing N.S.P. easement, unless said easement has been vacated and said improvements are under construction or completed. 3 . The length of the screening delineators on the 4�side of the building shall be 40 feet in length and the type and design of materials within the delineator for screening pur, -, ..?s shall be submitted to the City staff for approval prior to construction. The motion passed unanimously. The next item of business was consideration of Planning Application No. 750'.�9 Commission Application No. 75029 submitted by Cicero's, (Gicero's, Inc.) Inc. The item was introduced by the Secretary who stated the applicant seeks permission for an eating establishment with live entertainment to be located in the Westbrook Mall. He noted the restaurant main entrance would be located within the Mall. He stated the entertainment consists of a large pipe organ and trappings and the maximum seating would be 250 seats. Chairman Gross noted that none of the notified property Public Hearing owners was present and waived the reading of the names. He also recognized Mr. Mike Belknap who discussed the nature of the proposed restaurant and commented as to the Commission's -concern that adequate area be provided at the entrance foyer for waiting customers to avoid undue con- gestion in the mall. Mr. Belknap also reviewed the proposed seating plan and in response to comments by the Secretary stated that a revised seating plan would be submitted prior to the City Council meeting. Following further discussion there was a motion by Close Hearing Commissioner Jacobson, seconded by Commissioner 8,1/14/75 -10- Pierce to close the public hearing. The motion passed unanimously .
