Motion by Grady Boeck to recommend to the Village Council that
they approve the proposed plan as submitted by the Minnesota
State Highway Department. This plan pertained to the inter-
change at Xerxes Avenue North and F,B,.Z. #94 with a half
diamond at approximately 400 feet East of the North South
Section line.
Seconded by Paul Bullen.
An Amendment to the motion was made by Vern Ausen to recommend
that it is the understanding of the Village that there vrill be
a grade separation on the collector street thru the proposed
industrialarea East of Shingle Creek and F.A.I. #94 when the
need arises*
Seconded by Bob Jensen.
Amendment carried.
The amended motion read as follows:
Recommend to the Village Council that they approve the
proposed plan as submitted by the Minnesota State High-
way Department, This plan pertained to the interchange

line. It is the understanding of the Village that there

Upon vote being taken on the motion, members Warhol, BLtUen,
Kattar, Boeck, Jensen and 1Vel.ch voted for the motion. Ausen
abstained from voting because he felt he had a conflict of
interest.
111. Special Use Permit

deny application #61270 for rezoning from R-1 to B-1 and for
a, Special Use Permit for a gas service station for the fallowing
reasons t
1. The proposed development should be submitted for the
entire tract.
2. The service station at this location would readily
jeopardize the R-1 zoning on the oiest side of Osseo Road.
39 Primary objection is the introduction of traffic
accident potential.
4. Present zoning ordinance does not permit construction
of a gas service station adjacent to R-1 zoning.

The Zoning Committee presented the suggested reclassification of
zoning districts as prepared by the planning consultant and asked to have
it placed on the agenda April 26, 1962 for further consideration.
Motion by Vern Ausen that the Planning Commission recommend to the
Village Council that an opinion be requested of the Attorney General of
the State of Minnesota concerning the legality of proposed new Section 35-234,
revocation of zoning,action, and concerning the authority of the Village
Council to rezone specific properties for more restrictive uses, as for
example, from commercial to residential, when this and new use is compatible
with adjoining land uses.

April 5� 1962
The Planning Commission met in regular session and was called
to order by Vice-Chairman Vern Ausen at 8:00 P.M.
Roll Call: Vern Ausen, Paul Bullen, Hick Warhol, Grady Boeck,
Robert Jensen and Homer Welch were present. Chairman Al Kattar ,
absent.
Motion by Nick -Warhol to approve the minutes of March 1, Larch 15,
and March 29, with corrections made in the March 15, and March 29 minutes.
Seconded by Robert Jensen.
Motion carried unanimously.
Motion by Grady Boeck that the public hearing be closed and
that action on applications #62007 and #62008 regarding a proposed
plat., rezoning and special use permit be tabled until the regular
meeting of the Planning Commission on May 3, 1962.

April 12., 1962
The Planning Commission met in special session and was called to
order by Chairman Al Kattar at 8:00 P.M.
Roll Call: Chairman Al Kattar, Vern Ausen, Nick uVarhol, Paul
Bullen, Grady Boeck, Robert Jensen and Homer Welch were present.
Public hearing was held on amendments to the Zoning Ordinance
restricting gasoline service stations. There were no owners or
operators of service stations present at the hearing
Member Vern Ausen introduced the following ordinance and moved
its recommendation to the Village Council for adoption:
AN ORDINANCE AI&NDING CHAPTER 35
OF THE ORDINANCES OF THE VILLAGE
OF BROOKLYN CENTER
The Village Council of the Village of Brooklyn Center ordains
as follows.
Section 1. Chapter 35 of the Village Ordinances is hereby
amended by adding the following new section.
Section 35-413. SPhCIAL RE,�TRL,gENTS FOR AUTOiAOBILE SERVICE
STATIONS. Automobile service stations pose particular problems in
achieving compatibility with abutting and adjacent land uses because
of potentially detrimental aspects of their operation. The problem
is basically both functional and aesthetic, involving traffic hazards,
noise, light glare at night, outdoor storage of merchandise, poor
architectural design, indiscriminate advertising, etc., all of which
contribute to less enjoyment in use of and reduction of property
values in surrounding properties. It is hereby determined that the
general welfare will be better served by minimizing adverse functional
and aesthetic conditions which may result from operations of automobile
service stations, and that the use, enjoyment and improvement of
surrounding properties will be enhenced by the following requirements:
1. Automobile service stations must front and the primary
building shall face on a street designated by the Village Council as
a major thoroughfare. The minimum width and depth respectively of
the use site shall be one hundred and twenty (120) feet.
2. The use site shall not abut an R-1 district unless the land
abutting is occupied by a building, which building is not a dwelling
or a building accessory thereto, or by a multiple-family divelling unit
which is part of a planned development area together with the service
station. For the purpose of this paragraph, a lot which merely adjoins
the use site at one corner will not be deemed to abut the site.
3. Prior to any construction, the owner or developer shall
comply with the requirements of Section 35-707, which relates to
approval of preliminary plans. The owner or developer shall also
submit final architectural drawing and specifications to the Planning
Commission, which shall then make recommendations to the Village
Council. Any construction must conform to the drawings and speci-
fications as approved by the Council. In evaluating architectural
design, the Planning Commission and Council shall follow the principle
that the building express sincere concepts and honest construction,
and be compatible with surrounding buildings. The appearance of the
community and landscape is to be disturbed as little as possible.
Yloveover, the design of the building and of the canopy, if there is
one, shall be in scale with the surroundings. This section shall
apply to all exterior additions or alterations, including accessory
structures and signs.
4. No driveway will be permitted within seventy-five (75)
feet of the intersection, of the street lines of a corner use site.
The maximum width of any driveway shall be thirty (30) feet. No
driveway shall be within forty (40) feet of another driveway on the
same use site, or be flared outward on the boulevard in such a way
as to encroach upon the boulevard of abutting property.

5. Provision will be made for an unobstructed area, free of
all vehicles, pumps, signs, displays or other materials which tend
to obscure vision, when the use site is at the intersection of two
streets. The unobstructed area shall be bounded by the street lines
of the lot and a straight line joining points along such street
lines fifty (50) feet from the point of intersection of the street
lines. This is not intended to preclude one identification sign
which is seven feet or more above the street grade level and is
supported by a pedestal twelve inches or less in diameter.
69 Facilities for chassis and gear lubrication and for washing
must be enclosed within the principal building. No merchandise may
be displayed for sale outside the principal building except within
four feet of the building or in the pump islands, unless enclosed
by a structure compatible with the building. No discarded trash,
parts or tires may be accumulated outside the building unless enclosed
by a durable structure compatible with the design of the principal
building.
7. Lighting surrounding automobile service stations must be
adequate for safety only, and designed to minimize the amount of
light reflecting on abutting or adjacent properties. Lighting design
must be submitted to the Planning Commission for recommendations to
the Council, and all lighting shall conform to drawings and specifi-
cations approved by the Council.
8. Any required buffer or screening area shall be so constructed
as to keep the beam of automobile headlights from shining into abutting
properties.
9. There may be one permanent, detached, non-flashing identifica-
tion sign of a pedestal type, Sections 35-320, 35-330, 35-340, and
35-350 not withstanding. No part of the supporting pedestal shall be
within thirteen (13) feet of the property line. The station shall
otherwise comply with the sign regulations of the land use district
in which it is located.
10. The station will not display or permit to be displayed any
banners, pennants, noisy ribbons or similar attention-distracting
devices, except that a permit may be issued for such displays for a
period not exceeding ten days at any one time or twenty days total
per calendar year, or for thirty days following a grand opening. The
permit will be issued by the Building Inspector upon payment of a ten
dollar fee.
11. The following activities are prohibited:
a. Body work, painting, and major motor or major transmission
repair.
b. Vehicular parking, except that owners and employees
automobiles and automobiles being serviced may be parked
for a maximum period of forty-eight hours at any one time.
Not more than three service vehicles may be parked.
c. Sale or vending of items other than automotive fuels,
lubricants or automobile parts (except the vending of
soft drinks, candy or cigarettes within the principal
building for convenience of customers) or the renting
of trailers or other equipment, and other uses, unless
they are specifically approved by a special use permit.
12. The lawful use of land for any automobile service station
existing at the time of the adoption of this ordinance may be continued,
even if such use does not confoom to the above regulations, provided
that the use is made to conform to all sections except 1, 21 33 and 4
within twelve months of the date the ordinance was adopted. Section 3
shall apply to all exterior additions or alterations, including accessory
buildings and signs, from the date the ordinance was adopted.

13. The owner or lessee shall be jointly and severally responsible
for seeing that the above regulations are observed.
Section 2. Section 35-315 shall be amended by adding thereto
the following paragraphs

Brooklyn Center and partially in Brooklyn Park. Since the existing
zoning ordinance makes no provision for golf courses, member Vern Ausen
made a motion that public and private golf courses be included as a
"Special Use" in the P-1 zone.

Section 35-413. MECIAL REjUIREGENTS FOR AUs MOOI,LC 5i:;MICE
S E.''iICHS. Automobile service stations pose particular ;,problems in
achieving compatibility with abutting and adjacent land uses because
of potentially detrimental aspects of their operation. The problem
is basically both functional and aesthetic, involving traffic hazards,
noise, light glare at night, outdoor storage of merchandise, poor
architectural design, indiscriminate advertising, etc., all of which
contribute to less enjoyment in use of and reduction of property
values in surrounding properties. It is hereby determined that the
general welfare will be better served by minimizing adverse functional
and aesthetic conditions cuhich may result from operation of automobile
service stations, and that the use, enjoyment and improvement of
surrounding properties will be enhanced by the following requirements:
1. Automobile service stations must front and the primary
building shall face on a street designated by the Village Council as
a major thoroughfare. The minimum width and depth respectively of
the use site shall be one hundred and ttuenty (120) feet.
2. No service station shall be constructed on a lot abutting a
R-1 district; provided, hotuever, that a service station may be constructed
on such a lot if the abutting lot is occupied by a multiple family duell-
ing which is a part of a planned development area together with the
service station, or by a building other than a duelling or an accessory
thereto. For the purpose of this paragraph, a lot which merely adjoins
the use site at one corner will not be deemed to abut the site.
3. Prior to any construction, the otuner or developer shall
comply with the requirements of Section 35-707, which relates to
approval of preliminary plans. The owner or developer shall also
submit final architectural dratuing and specifications to the Planning
Commission, .which shall then matte recommendations to the Uillage
Council. Any construction must conform to the drawings and speci-
fications as approved by the Council. In evaluating architectural
design, the Planning Commission and Council shall follow the principle
that the building express sincere concepts and honest construction,
and be compatible faith surrounding buildinUs. The appearance of the
community and landscape is to be disturbed as little as possible.
Loreover, the design of the building and of the canopy, if there is
one, shall be in scale with the surroundings. This section shall
apply to all exterior additions or alterations, including accessory
structures and signs.
4. No driveway will be permitted within 'forty (40) Beet of the
intersection of the "urb lines of a corner use site. `ahe maximum
width of any drivecuay shall be thirty (30) feet at the property line.
No driveway shall be within thirty (30) feet of another driveway on
the some use site, or be flared outward on the boulevard in such a
way as to encroach upon the boulevard of abutting property.
5. Provision will be made for an unobstructed area, free of
all vehicles, pumps, signs, displays or other materials tuhich tend
to obscure vision, when the use site is at the intersection of two
streets. The unobstructed area shall be bounded by the street lines
of the lot and a straight line joining points along such street
lines fifty (50) feet from the point of intersection of the street
lines. This is not intended to preclude one identification sign which
is ten Beet or more above the street grade level and is supported by
a ;pedestal ttuelve inches or less in diameter.
6. Facilities for chassis and gear lubrication and for washing
must be enclosed eui.thin the principal building. No merchandise may
be displayed for sale outside the ,principal building except within
four feet of the building or in the pump islands, unless enclosed
by a structure compatible tuith the building. No discarded trash,
parts or tires may be accumulated outside the building unless enclosed
by a durable structure compatible with the design of the principal
building.

7. Lighting surrounding automobile service stations must be
adequate for safety only, and designed to minimize the amount of
light reflecting on abutting or zdjacent properties. Lighting design
must be submitted to the planning Commission for recommendations to
the Council, and all lighting shall conform to drauings and specifi-
cations aroved by the Council.
3. Any required buffer or screening area shall be so constructed
as to reey the beam of automobile headlights from shining into abutting
residential properties.
9. There may be one permanent., detached, non-flashing identifica-
tion isgn of a pedestal type which shall conform to the conditions of the
special use permit. No part of the sign shall overhang the )roperty line.
10. The following activities are ,prohibited:
a. 3ody viork, painting, and major motor or major trans-
mission repair.
b. Vehicular parking, except that oviners' and employees'
automobiles and a maximum of three service vehicles
may be parked, and automobiles being serviced may be
-)arlted for a ma<.imum period of 4.3 hours at any one time.
C. Sale or vending of items other than automotive fuels,
lubricants or automobile ;arts and accessories (ei.cept
the vending o� soft drin%i, candy, civarettes, and
other incidental items vjithin the principal building
for convenience of customers), the renting of trailers
or other equipment, and other uses, unless they are
specifically a)proved by a special use permit.
11. The lacaful use of land for any automobile service station
existing at the time of the adoption of this ordinance may be continued,
even if such use ;:foes not conform to the above regulations, ;provided
that the use is made to conform to all sections e,.cept 1, 2, 3, and 4.

The Planning Commission held the monthly study meeting which was
called to order by chairman Al Kattar at 8;00 P. M.

The Planning Commission met in regular session and was called to
order by Vice Chairman Vern Ausen at 8:00 P. M.
Roll Call: Vern Ausen, Paul Bullen, Robert Jensen and Homer Welch

Motion by Robert Jensen and seconded by Paul Bullen to approve the
minutes of the regular Planning Commission meeting of August 9, 1962 and
the study meeting of August 30, 1962. Motion carried.
3a. Notion by Robert Jensen and seconded by Paul Bullen to recommend
to the Village Council that application #,62040 for a Special Use Permit to build
three 24 unit apartment buildings be denied for the lack of detailed plans and
specifications, and it is further recommended that the 6 month waiting period
required under section 35-232 be waived in this case. Motion carried
unanimoulsy.
3b. Motion by Robert Jensen and seconded by Paul Bullen to recommend
to the Village Council that application ;,,62046 for a Special Use Permit to build
a 10 unit apartment building be approved on the condition that the petitioner
ctubmit detailed plans and specifications which must be approved by the Village
Engineer and the Building Inspector and the Planning Commission. Upon vote
being taken Robert Jensen, Homer Welch and Paul Sullen voted in favor
thereof, Vern Ausen voted against the same. Motion carried.
3c. Motion by Paul Bullen and seconded by Robert Jensen to recommend
to the Village Council that application #;62043 for a Special Use Permit to build
a 76 bed nvirsing home be approved subject to the Village Engineers recommend-
eti.ons as shown on the application and it is further recommended that the final
plans shall be reviewed by the Planning Commission. Upon vote being taken
Paul Bullen and Robert Jensen, voted in favor thereof, Vern Ausen and Homer

The Planning Commission met in special session and was called
to order by Al Kattar at 8:00 P.M.

The Ordinance Committee presented an alternate proposal of
land use districts for single and multiple family development which
took into account some of the objections to the original redistricting
plan. The Planning Commission will study the alternate plan and the
redistricting of the Business and Industrial zones at the meeting to
be held October 25, 1962.
Mr. Hodne, the Planning Consultant, submitted a map showing
the proposed land use districts and discussed Stage 1 for the adop-
tion of the plan to rezone.

Vern Ausen led the discussion of the proposed redistricting plan which
was referred back to the committee. The committee is to have a new draft, with
the suggested revisions, ready for the November 29, 1962 study meeting.

The Planning Commission held the monthly Study Meeting which was called

plan as submitted by Jerry Harrington provided that the parking area be 135
feet in length extending south from the north boundry line of the parking area

Addition, provided that a 10 foot utility easement across the property shows on

the Platting regulations.

the Village Council of application 962059, as revised and grant a variance to the
Church of Christ at 6206 North Lilac Drive, permitting 75 parking spaces instead
of 85 as required by Section 35-704. Upon vote being taken Al Kattar, Paul
Bullen, Nick Warhol, Robert Jensen, Grady Boeck and Homer Welch voted in favor of
the motion. Vern Ausen not voting for the reason that he thinks we are inviting
possible trouble in the future and that some of the parking spaces are not usable.

The Planning Commission, in response to a request by Roland Erickson for
permission to build a service station on the southeast corner of 69th and Humboldt
Avenues, restated their position requiring compliance with Section 35-412 of the
Village Ordinances which requires the minimum development in a (b-1) district to
have 25,000 square feet of gross floor area.
The Chairman, Al Kattar, with the consent of the members called a special
meeting of the Planning Commission for December 13, 1962, at 8:00 P.M. to study
a planned development which will be presented by the Industrial . committee. The
secretary was instructed to send notices of the meeting to all members.
Iviotion by Homer !belch and seconded by Robert Jensen to cancel the December
27, 1962 study meeting.
Motion carried unanimously.
Motion by Grady Boeck and seconded by Robert Jensen to adjourn. Meeting
adjourned at 10:00 P.M.
