HomeMy WebLinkAbout1970 04-02 PCM I Minutes of the Proceedings of the Planning Commission in the City of Brooklyn Center and County of Hennepin and State of Minnesota April 2, 1970 The Planning Commission met in regular session and was called to order by Chairman Robert Jensen at 7:35 P.M. Roll Call: Chairman Robert Jensen, Commissioners Karl Schuller, Robert Grosshans, Paul Ditter and Charles Nichols were present. Also present were James Merila and Robert Haarman. Motion was made by Schuller, seconded by Grosshans, to approve the minutes of the regular meeting of March 5, 1970, and the study meeting of March 26, 1970, as submitted. The motion carried unanimously. As the first item of business, Chairman Jensen read a letter from Robert W. Schmidt of Brook Park Realty requesting withdrawal of further consideration Planning Commission Application No. 69021 requesting rezoning from R3 to R5. Chairman Jensen acknowledged the withdrawl and directed the letter be placed in the file. The next item of business to be considered was Application No. 70012 submitted by Darrel Farr requesting a recommendation from the Planning Commission to the City Council regarding a land use plan for townhouses adjacent to the development known as Twin Lake North Apartments. Following an introduction of the application by the Secretary, who indicated that existing Brooklyn Center ordinances and plan approval procedures do not adequately regulate this type of town- house development, Chairman Jensen recognized Mr. Charles Van- Eeckhout who represented the application. Discussion of the application with Mr. VanEeckhout and staff centered on the following: 1) FHA will be involved in guaranteed mortgage loans on these townhouse units in a manner similar to FHA's mortgage loans on single family houses. 2) Two, three and four bedroom townhouse units including double garages and additional tandem parking for two additional cars for each unit will be constructed after an initial quantity have been presold. 3) A home owners association or development corporation will have to assume maintenance of the common land areas not sold with this type of townhouse development. 4) Protective covenants and utility easements will have to be worked out. 5) The probability of platting the development after it is completed rather than before which is the usual requirement. 6) Site and building plan and concept approval with the understanding that ordinance changes or additions may have to be made to accommodate this type of land use. 1 1 -2- A motion was made by Ditter, seconded by Grosshans, to recommend to the City Council that Application No. 70012, re- questing a recommendation for the City Council regarding this land use plan, be referred to the City Council as follows: 1) The Planning Commission recommen s conceptual approval of the site and buildinc plan with the understanding that ordinance charges or additions may have to be made to accommodate this type of land use. 2) Any change in the plans should be brought back to the Planning Commission if deemed appropriate by the staff or the Planning Commission Chairman. 3) The Planning Commission refers the matter to the City Council with the understanding that several legal documents required by this type of development will have to be approved by the Clity Council. The motion carried unanimously. The next item of business was Application No. 69066 submitted by Henry Stenquist requesting a Special Use Permit for group dance lessons in the Stenquist residence a 7100 Willow Lane. Mr. Stenquist had modified his application in light of an opinion from the City Attorney of which he had no knowledge prior to his original application. Following its introduction by the Secretary, Chairman Jensen read a letter from Mr. Stenquist which, in effect, requested a special use permit for group dance lessons until June 3, 1970. Following a discussion of the letter with Mr. Stenquist, Mr. Jensen called on affected property owners notified of the public hearing. Comments received from neighboring property owners generally indicated: 1) Concern with traffic congestion and parking on the streets; 2) The commercial nature of the dance studio 3) The June 3rd conclusion for the present dance classes. 4) Section 35-220.3 of the City ordinance. Conditions and Restrictions. During this discussion with affected property owners, photographs relative to the alleged traffic and parking problems were shown to the Planning Commission. Motion was made by Grosshans, seconded by Ditter, to close the public hearing. The motion carried unanimously. Following Chairman Jensen' s review of the Special Use Permit application, a motion was made by Grosshan , seconded by Ditter, to recommend to the City Council that Appl cation No. 69066 submitted by Henry Stenquist, requesting a Special Use Permit for group dance lessons, be denied with the following condition: 1) The applicant shall have until June 3, 1970, to cease and desist operation of the dance studio. 1 1 -3- Voting for the motion were Schuller, Gross ans, Jensen and Ditter. Voting against: none. Not votin : Charles Nichols. The motion carried. (Commissioner Nichols felt the dance studio should cease operations before June 3rd.) At this time, Chairman Jensen called Eor consideration of Application No. 70010 submitted by Fred Le in requesting rezoning from R4 to R5 the vacant property commonly described as being within the southwest corner of the intersection of 58th Avenue North and Osseo Road. Following its introduction by the Secretary, Mr. Ledin answered questions for the Commission cone rning the feasibility of the apartment development he proposed. Of the affected property owners notified of the public hearing, only one was present, and he questioned the additional traffic that would be generated by a higher density apartment zoning. Motion was made by Schuller, seconded by Nichols, to close the public hearing. The motion carried unanimously. A motion was made by Grosshans, seconded by Nichols to recommend to the City Council that Application No. 70010 requesting rezoning from R4 to R5 be denied because the applicant has not demonstrated that the rezoning would be in the best interest of the City of Brooklyn Center. The motion carried unanimously. At this time Chairman Jensen called for discussion of Application No. 70011, submitted by Brooklyn Center Industrial Park, requesting preliminary approval for a registered land survey which comprehends the realignment of Lushine Drive. Following its introduction by the Secretary, Mr. Steve Krogness, representing the application, answered questions for the Commission. Motion was made by Grosshans, seconded by Schuller, to recommend to the City Council that Application No. 70011, requesting preliminary subdivision of property by Registered Land Survey be approved. The motion carried unanimously. At this time, 9:38 P.M., Chairman Jensen called for a recess. The meeting resumed at 9:48 P.M. The next application to be considered was Application No. 69065 submitted by Lecon Properties requesting rezoning from R3 to R5. The application had been introduced at a public hearing held by the Planning Commission on January 8, 1970, at which time it was tabled and taken under advisement. The matter was also considered at a study meeting of the Planning Commission held February 25, 1970, at which time the Application was again tabled with the applicants requested to consider a mixture of land uses such as R3, R4 and R5 as opposed to a pure R5 land use. Chairman Jensen called on Mssrs. Wessin and Bernu, representing the application, to explain any revisions to the plans as originally presented. A discussion ensued relative to the revised proposal which indicated, generally, that a structure representative of R4 zoning would be built along France Avenue North and serve as a buffer, for the single family residences on France Avenue, against the R5 bulk and density on the remaining t o thirds of the property. Chairman Jensen indicated that Ihe Plating Commission was waiting for a forthcoming report from the Nwrtjowest Neighbor- -4- hood Advisory Committee and further that affected neighborhood property owners would have to be notified of the meeting when the Planning Commission makes its recommendation to the City Council. The remainder of the meeting consisted of discussion by the Planning Commission of various planning subjects under their consideration. A motion was made by Schuller, seconded by Nichols, to adjourn.
