May 28, 1970
The Planning Commission met in study session and was called
to order by Chairman Robert Jensen at 7:35 P.M.
Roll Call: Chairman Robert Jensen, Commissioners Henry
Bogucki, Paul Ditter, Robert Grosshans, and Karl Schuller were
present. Also present was B. E. Peterson.
Chairman Jensen requested that the Commission consider
Planning Commission Application No. 70013 submitted by Byron
Dunkley requesting a variance on lot depth and front yard set-
backs for Lots 12, 13 and 14, Garcelon's Addition, commonly
described as being located on the east side of Lyndale Avenue
in the 5500 block. The application was last considered by the
Planning Commission on May 7, 1970, and was tabled and taken
under advisement.
Chairman Jensen was informed by the Secretary that the
variance requested was for deficiencies of lot depth and front
yard setback as required by Section 15-106 (g) 2 (bb) (dd) . The
Secretary further pointed out that subject application is in
a subdivision and that said lots do not meet minimum subdivision
design standards and can be considered as substandard lots as
defined by Section 35-500. Following this, members of the
Commission examined said parcels and concurred that if the appli-
cant's land survey was called into question by the City Engineer
that said land survey under question should be confirmed.
Following this, members of the Commission discussed those
vacant parcels south of said application and on the east side of
Lyndale Avenue from the 5300 block to the 5500 block. Concern :--..
was expressed by members of the Commission that granting a
variance would establish a precedent for these parcels. Following
further discussion, a motion was made by Commissioner Bogucki,
to recommend to the City Council that Application No. 70013
submitted by Byron Dunkley requesting a variance on lot depth
and front yard setback for Lots 12, 13 and 14, Garcelon's Addition,
be denied for the following reasons:
1) Concern with cars that might have to back out
on to Lyndale Avenue; and
2) That the granting of the variance would establish
a precedent.
The motion died for a lack of a second.
After considerable discussion, a motion was made by Henry
Bogucki and seconded by Karl Schuller to recommend to the City
Council that Application No. 70013 submitted by Byron Dunkley
requesting a variance on lot depth and front yard setback for
Lots 12, 13 and 14, Garcelon's Addition, be denied for the
following reasons:
1) The applicant has not presented sufficient evidence
nor has he demonstrated that all of the standards
for variances have been met;

2) The amount of variance is not specified in the
request;
3) The applicant has submitted a questionable land
survey which was called into question by the City
Engineer.
Voting for the motion were: Jensen, Schuller, Grosshans and
Bogucki. Voting against: none. Not voting: Ditter.
(Commissioner Ditter was not at the Commission meeting at the
time said application was under consideration.)
The next item for consideration was Planning Commission
Application No. 70014 submitted by Richard Zejdlik requesting
rezoning from R1 to R3 the vacant property commonly described
as the 6700 block on the west side of Orchard Avenue North.
Said application was last considered by the Planning Commission
on May 7, 1970, where action was taken to refer said application
to the Northwest Neighborhood Committee. At this time, Chairman
Jensen said that such a report would be forthcoming from the
Northwest Neighborhood Committee by the June 25th study meeting.
After considerable discussion, it was the concensus of the
Planning Commission that Neighborhood Committees be consulted,
if necessary, regarding those applications requesting rezoning.
The next item for consideration by the Planning Commission
was Application No. 69049 submitted by Peterson and Associates
requesting a special use permit for a nursing home which would
be located in the southeast corner of 55th and Bryant Avenues
North. The matter was last considered at the City Council
meeting of December 15, 1969, at which time said application was
referred back to the Planning Commission for study and recom-
mendation of development and operational standards for nursing
homes.
At this time, members of the Planning Commission discussed
the following factors :
1) That said nursing home should be in an activity
area rather than strictly in a residential setting;
2) That there is growing concern with occupant
density of nursing homes including number of
beds per room;
3) That many of the occupants of nursing homes are
receiving federal medi-care and state medi-care aid;
4) The federal and state nursing home requirements are,
at the best, minimum; and
5) The Commission, at this point in time, is unable
to properly make a recommendation to the Council
on standards without further time and assistance.
At this time, the Secretary related to the Commission that there
is a forthcoming application (Ron Fleissner, 70018 and 70032)
seeking special use permit and site and building plan approval
for construction of a nursing home. There followed a very

lengthy discussion regarding Application No. 69049 specifically
concerning 55th and Bryant Avenues as collector streets.
Following this discussion, a motion was made by Commissioner
Grosshans and seconded by Commissioner Bogucki, to uphold Section
35-311. 2 (d) requiring that nursing homes and rest homes have access
only by collector or arterial streets. The motion carried
unanimously.
A motion was next made by Commissioner Ditter, seconded by
Commissioner Grosshans to recommend to the City Council denial
of Planning Commission Application No. 69049, submitted by Peterson
and Associates requesting a special use permit for a nursing
home which would be located in the southeast corner of 55th and
Bryant Avenues North. The Planning Commission recommends denial
based upon its resolution 69-5 dated December 4, 1969. The motion
carried unanimously.
Chairman Jensen noted that the Brooklyn Park Planning
Commission will have a public hearing on June 10, 1970, regarding
rezoning of property on 73rd and France Avenues North and
requested that this meeting be attended by a Commission member.
Commissioner Bogucki stated that he will attend the June 10,
1970, Brooklyn Park Planning Commission meeting regarding
rezoning for the property at 73rd and France Avenue North.
Chairman Jensen mentioned to members of the Commission that
a subcommittee should be formed to consider the need for
freeway development zones in Brooklyn Center.
Motion by Commissioner Schuller and seconded by Commissioner
Grosshans to adjourn. The motion carried unanimously. The
Commission adjourned at 10059 P.M.
