Motion by Paul Bullen and seconded by Al Kattar that the Planning Commission recommend to the Village Council that the request for a variance as submitted by Jack Kahn for the E. C. Peterson property, from 15 feet to 5 fe%t for a green h strip across the front of this property and abutting Trunk Highway 100, the property is listed as Parcel 7930 of Lot 57, Auditor's Subdivision No. 218 and is particularly described as lying between Trunk Highway 100 and Knox Avenue North from 59th Avenue North to a point approximately 225 feet south of 59th Avenue North. Motion carried. The Planning Commission further discussed the ingress and egress to this property which is to be developed into a medical clinic where the existing residence will be incorporated with an additional new building to form the entire medical center. It was determined that access to the parking area which is to be northwest of the existing residence would be from 59th Avenue North or Logan Avenue North. The entrance from Logan Avenue North would necessarily have to cross private property to the south of and adjacent to the lot in question or else across highway department property. In either case, it was felt that it was the petitioner's responsibility to obtain this necessary access or right-of-way. The access to the parking area off from 59th Avenue North would not present a right-of-gray or property problem. The following stipulations are recommended to be incorporated into the division of this property before approval will be given: • That the petitioner, when subdividing his property will dedicate the westerly and southerly 30 feet of the above named lot for street purposes and that the lot divided from the northeast corner of the property be according to the regulations of the zoning and platting ordinances. Prior to action on Report No. 127, as submitted by Mr. Harlan Harms, the Planning Commission discussed the necessity and desires of the park department to have a perimeter street around the proposed park to be located between 6E,th Avenue North and 73rd Avenue North and between approximately Bryant Avenue North and Camden Avenue North. The discussion of the subdivision of this property at th`s time involved consideration for the eventual division of this property so that the remaining area may be suitably divided into lots meetin4 f frontage and area requirements as set forth in the ordinance. Mr. Hipp was not present at the meeting and therefore the Planning Commission merely discussed it and requested that before action be • taken, Mr. Hipp be present to answer various questions relating to regulations as set forth in the ordinance and clarification thereof, before a decision can ha made on this request. This was a request for a discussion by Mr. Russ Howe relating to the possibility of rezoning or special use permits for his residential property located south of the Village Pump Houses on the east side of Osseo Road, south of 63rd Avenue Borth. Mr. Howe has the first lot south of the pump houses, and is interested in either an incorporation of his house into an office of some type or the possibility of a dental or medical clinic. It was the concensus of opinion of the Planning Commission, without any formal action being tak.en, that there should be no change in th:s property and that the pump houses as such are not necessarily offensive to a residential neighborhood. Report No. 129 - April 20th Agenda. The Planning Commission discussed the possibility of zoning a fringe area :gin a 132 Zoned area. The particular problem has come about because of the area which we presently know as the Dayton Property lying east of Trunk Highway 152 (Osseo Road) and south of 57th Avenue North, which is designated as B2.. B2 area, according to the ordinance is a regional shopping area. The ordinance also stipulates that where a regional shopping center faces a major thoroughfare, the set-back shall be 150 feet from the property line. in this particular case, the Dayton Company owns all except approximately 7 parcels which abuut on the Osseo Road. These parcels are approximately 150 feet deep and if the ordi:Hance was strictly adhered to, these private or individual parcels will not be permitted . to have any type of construction whatsoever and they may be regarded as a lot designated as green strip only. ,Also, the Planning Commission discussed .ehe proposed street layout and shopping center location as proposed by Dayton: and the possibility of a conflict of any street which may be constructed in a north and south direction parallel to and east of tY.e Osseo Road. This street could be classified as a public thoroughfare and world require another 150 ft. set-brick. This set-back would not be difficult adjacent to the shopping center proper because parking area could be incorporated in this 150 ft.; however, on the arrest side of this proposed street beti^uree3n the street and the Osseo Road, there is a possibility that there could remain possibly 500 ft. or less of area and if 150 ft. ' ras taken off from both sides, there is a possibility of leaving maybe 100 or 200 ft. wide strip of property which would decrease its developable potentials.
