Adiournmenta PLANNING CQr'iI'`5SION INF()WATION ST-MET Application No. 72057 • Applicant: City of Brooklyn Center Locations 7231, 7211 Lyndale Avenue North and 407 - 73rd Avenue North Description of Request: Rezoning aACKGROUND , on June 26. 1972, the City Council reviewed and approved a rezoning application submitted by Swanson Homes, Inc. , seeking rezoning from R1 to R4. Concern was noted over remaining Rl parcels nearby, and the City initiated proceedings to rezone these to R4 as welll. The parcels are west of Lyndale and north of 72nd Avenue North. ANALXSYS AND RECOMMENDATION The Commission endorsed the concept of rezoning the remaining R1 parcels when the recommendation on Application No. 72020 • was forwarded to the Council on June 1, 1972. The property owners involved have been notified and informed of the rationale of the action. Affected property owners have also been notified. Location: N.E, Quadrant of T.H. 100 and Summit Drive Description of Request: Approval of preliminary Registered Land Survey BACKGROUIM The description of the area is-. "Outlot B, B.C.I.P. Plat 1 and Lot 1, Buick 2, Twin Cities Interchange Park and vacated Earle Brown Drive." The platting was a requirement of approval for Application YJO. 72024, approved by the Council on O'une 12th (rezone from I l to C -2) . ANALYSIS AND RECOVMENDA'TT.ON Staff has been attempting to determine, with the applicant, the alignment of the rezoned C -2 district in relationship • with the original plat.. it is recommended that, in conjunction with this application, the Commission recommend a separate vacating action for that part of Earle Brown Drive lying within the Twin Cities interchange Plato 1 y f • 1 / � � ' F tis oll i i r C011,117—S'STON Application No. 72061 • Applicant: McCarthy Construction Company Location: Between Knox and Logan Avenues North south of 73rd Avenue North Description of Requests Ar-proval of preliminary Registered Land Survey BACKGROUDW.- Thd applicant seeks subdivision approval for purposes of developing the property with single family dwellings. ANALYSIS AND RECOM4ENDATION The staff noted several revisions of the initial proposed survey submitted by the applicant; revised drawings had not been submitted at the first of the week. The main concern was that existing roadways (Knox, Logan and 73rd Avenues North) be shown as tracts. • Also noted was the substandard size of the northeast and southeast tracts ("C" and IIHII on the initial survey) . Revision should leave only the southeast tract substandard and, thus, unbuildablo until such time that it might be combined with Tract "D" of Registered Land Survey No. 1328. Assumlhg revised drawinge are available, recommendation is for approval subject to the following conditlons4 1. The final plat shall be subject to the requirements of the Platting Ordinance #,including the Bonding Reauirements of Section 15 -109) ; 2. The final plait shall be subject to the approval by the City Engineer; 3. The substandard tract northerly and adjacent to Tract "D" of R.L.S. Lahti Location: 5326 Knox Avenue North Description of Request: Variance BACKGROUND The applicant seeks a variance from Section 35-500 to permit construction of a dwelling on a substandard lot. ANALYSIS AND RECCk9MENDAT'I©N Section 35-500 provides that substandard lots may be built upon if the area is at least 70% of the ordinance requirement. The ordinance requires 9, 500 square feet; 70% is 6,650 square feet and the subject property is 5, 831 square feet. in addition, staff is concerned with the possible ramifications upon the neighboring properties, given probable substandard setbacks. • No survey data was submitted by the applicant which could serve to better determine the actual situation. A,, Olson, jr. , for Northbrook Alliance Church Location: 6252 Bryant Avenue North Description of Request: Approval of preliminary Registered Land survey BAC7GROUND The applicant seeks subdivision of the parcel lying easterly of the Northbrook Alliance Church property, for the purpose of constructing a single family dwelling. ANALYSIS AND RECOMMENDATION The general situation of this application is similar to that of Application No. 72055, submitted 'by the Vanman Construction Company, and tabled by the coruiission on July 13th, i.e. , there is a distinct possibility that the property will be affected by the planned upgrading of the • freeway. The Highway Development Citizen' s Advisory Group has yet to meet with the Highway officials (tentatively on August 9) . Action now on this application, as with No. 72055, could represent an unnecessary constraint upon the advisory group. Description of Request: Approval of preliminary plat BACKGROUND The applicant seeks approval of a preliminary plat to permit the development of 11 townhouse condominiums. This application has been previously considered and tabled pending rezoning of the subject property (Application No. 72020) . ANALYSIS AND RECOMMENDATION This application was heard on April 6 and June 1, and was tabled, pending disposition of No. 72020, which has since been approved by the Council. • Staff reservations are basically unchanged, regarding the layout. It appears that the land indicated for ripen space does not functionally or aesthetically serve the entire development as it might with other possible designs. There is concern also over the possible ramficiations upon the entire area, especially with regard to future uses of neighboring parcels. ANALYSIS AM RECOMMENDATION The matter was tabled pending disposition of No. 72020, which was approved by the Council. Staff reservation concerning the access and open space lay- out are the same. Concern is with the position of the building relative to the sideyard view of future develop - ments on adjacent lots. • It seems that other possible designs could better comprehend a planned utilization of open spare and access areas more amenable to a small neighborhood, rather than a standard "row house" concept which is indicated. Approval would be subject to the following conditions: 1. Utility and drainage plans are subject to the approval of the City Engineer; 2. Building plans are subject to the approval of the Building Inspector with respect to applicable building codes; 3. A performance agreement and performance bond (in an amount to be determined by the City Manager) shall be submitted to the City to guarantee the installation of the site improvements as indicated on the approved plans; 4. Homeowner Association Agreements and Bylaws are subject to review by the City Attorney. • PLANNING coi4mISSIOW INFORKAATION SHEET Application No. 72050 . Applicants B.C.I.P. , Inc. Location: 69th and Shingle Creek Parkway Description of Rec?uest: Site and building plan approval BACKGROUND The applicant seeks site and building plan approval for a 36 unit condominium townhouse project to be constructed on the 4.45 acre parcel south of 69th Avenue North and westerly of Shingle Creek Parkway. ANALYSIS AND RECOMMENDATION Staff has had substantial consultation with the applicant on the site layout and design of the clusters. The project is to be phased, with at least one building to serve as models through the completion of the project. Factors of concern have been: screening, landscaping, internal roadways, and access. Recommendation is for approval, subject to the following conditions: 1. Drainage and utility plans are subject to the approval of the city Engineer; 2. Building plans are subject to the approval of the Building inspector with respect to applicable building codes; 3. A performance agreement and performance bond (in an amount to be determined by the city Manager) shall be submitted to the City to guarantee the installation of site improvements as indicated on the approved plans; 4. Written provision shall be made for access easements to the parcel lying westerly of the subject property; 5.
