B-ACKGROWID:
The applicant seeps approval of a variance from section 15-104
of the City ordinance to permit the subdivision of a parcel
by metes and bounds description. The apPlicant' s intent
is to create two buildable single-family residential lots,
one with front6ge on Lyndale Avenue North and the other
on Fifth Street

• There are precendents for granting this request. The pro-
posed size of the wes-tterly parcel would be approximately Ile
feet by 194 feet, and the proposed size of the easterly parcel
would be approximately 194 feet- by 116 feet. It is noted
that the descriptions of the parcels are not as simplified
as other circumstan-zes wheze similar action has been taken.
There is concern that written provision be invade in the
descriptions W include certain road-way easements and
the Director Of Public Works will be prepared to comment
further on this.
Reconrqendation is for approval subject to the following
conditions:
13 The final plat is subject to review and approval by
the City Engineer.
2) Approval is subject to the applicable conditions of
the platting ordinance.

Description of Request: Site and Building Plan Approval
BAaKGROUM
The applicant requests site and building plan approval for
a 40,000 square foot addition to the Arctic metals man-
ufacturing facility. This expansion was anticipated when
approval. was given for the 80,000 square foot facility on
April 26, 1971. The total area of the manufacturing
facility will be 126, 550 scraare feet.
AVALYSIS AND RECOMMENDATION
According to the initial plans, the minimum parking re--
quirements are exceeded by 39 spaces. It is the recom--
mendation that concrete islands be placed at the ends of
the parking rows to delineate the driving aisles. While
• some loss of parking spaces would be realized the remaining
number would be in excess or the required 159 spaces.
Also relative to parking, the applicant has been requested
to submit a letter indicating the number of employees at
the facility on the maximum shift. The concern is that while
the addition is initially intended for warehousing and
loading purposes, it is conceivable that a certain amount
of the available space could be put to manufacturing uses
in the futu-r_-e.
Noted also is the re-location of a standby L.P. gas "farm"
which is presently located at -1--he easterly end of the site,
The new location is Tviesterly of the present site, set in the
midst of the parking and truck maneuvering area. The pro-
posed construction of this standby gas "farm." in the area
indicated is considered aesthetically undesirable and alter-
natives should be examined such as underground installation.
It is imperative that the applicant- be cautioned as to the
special requirements in this district with special reference
to noise, vibration, wastes and out-door storage and activity.
• These standard requirements are particularly noteworthy in
light of the apartments located on the parcel abutting to the
east.

• Recommendation is for approval subject to the following
cond i t ions n
1) Building plans are subject to the approval of the
Building inspector with respect to applicable build-
ing codes,.
21, Utility drainage and elevation plans are subject to
the approval of the City Engineer prior to the issuance
of the building permit.
3) A performance agreement and performance bond in an
amount to be determined by the City manager shall be
submitted to the City to guarantee site improvements
designated on the site plans.
4) (Provisions shall be made in constructing the building
to assure compliance with the ordinance special re-
quirem-eats for the 1-2 District with particular regard
for sound and vibration limitations.

BACRGROURD.-
The applicant is seeking approval of a Special Use Permit
in accordance with Section 35 -312 (Planned Residential
Developments) , The permit would comprehend the proposed
Master Plan and the first phase of the project. Phase one
includes a 120-unit condominium apartment building and 24
townhouse units. Application No. 72045 in the request
for site and building plan approval,

While the special use application is- in order, there have
been several pzoblems relative to the submission of
appropriate site and building plans.
• The Special Use Permit should he considered in conjunction
with those plans since approval of Application No. 72045
is contingent upon approval of this one.
Each subsequent phase will require formal modification of
the permit and hence, will be reviewed at similar hearings
before use and building permits are issued for each stage.
The present permit comprehends only the Master plat, and
Phase One. Neighboring property owners have been notified
of the hearing.

BA CKG ROUND
The applicant is seeking Master Plan approval for a
phased, 496 unit Condominiunt-townhoase project (Planned
Residential Developments on a 62 .7 acre site located
in the northwest quadrant of the City.
Specifically, site and building plan approval is sought for
Phase 1, so that permits may be secured for a 120 unit
condominium apartment building and parking facilities, as
well as for 24 townhouse units and parking.
The Commission gage the project: conceptual approval at the
July 13th meeting,- and plans were further studied on
• September 7, 1972.
ANALYSIS AND RECOMMENDATION
Action on this application is contingent: upon action on
Application 72076 seeking a Special Use Permit..
Due to the mo gnitude of the proposed project, the applicant;
has been required to provide documented planning data,
relative to the layout of the buildings, the phasing, and
particularly the drainage of the site.
An open drainage way is proposed, and the ]director of Public
Works, who has worked extensively with the applicant's
engineering staff, will be prepared to cormient further.
The project consists of three phases, the first compre--
hending a 120 unit apartment building at the northwest; end
of the site, and 24 townhouse units at•, the southwesterly
(69th Avtf-nue) end. Phasing has been of prime concern to
the c'ommiss.ion iri earlier considerations of this application..
Determination should be made of 't:he actual intent relative to
• Home Owner Association Agreements. Apparently there will be

• separate Associations, to be _rtlerged as the project develops,
Due to physical proximity, however, the status of townhouse
Owners vs. condominium apartment owers is not fully clear

Landscaping also is of prime cincern, particularly where the
townhouse development abuts the R •1 properties.
According to the Building Inspector, the preliminary building
plans are in order.
Certain easements relative to utilities and access have been
sought by the applicant, and documentation should be submitted.
While the Cominission is being asked for approval of the
master plan, encompassing all phases, the action here is
relative to the Faster Plan and site and building plans
for Phase I only. Other phases must be reviewed and ap--
proved as they are actually developed.
As of this writing, the applicant had yet to supply complete
• site plans for Phase one. The Secretary and Director of
Public Works will be prepared to comment further as to
the status of the plans.
Approval of the master plan and approval of Phase 1,
as a Planned Residential Development, would be subject to
the following conditions :
1. Drainage, grading and utility plans are subject to
approval by the City Engineer prior to the issuance of
building permits,

Building Inspector with respect to applicable building
codes:

The applicant seeks approval for a special use permit
for offering livo entertainment as provided by Section 35-322:
and a special use permit for accessory offsite parking as
required by Sections 35-322 and 35• 701
These requests are in conjvnetion with the applicant's
intent to refurbish the restaurant and to exercise a
liquor license -- the application now pending before
the City Council..

The 'Live entertainment permit application appears to be
in order. The seating plan -.1"or the, rennovated facility
indicates a stage area near the center of the restaurant.
Recommendation is for approval subject to annual rev-Lew.
This is the first application for a permit to allow supplemental
accessory offsite parking under the recently adopted ordinance
amendment.
The proposed site for the accessory parking is easterly of
the restaurant, across the service road, south of the
Midwest Federal site. The plan submitted indicates 36
spaces on that site.
There are currently 68 spaces on the principal site; the
total would thus be 104 spaces.
On the seating plan submitted, the applicant has indicated
accommodations for 183 persons, and the manager has stated
that there will be 13 employees. 14inimum parking must be
• provided at the rate of one space for every two seats or
employees; hence, a total of 98 spaces is required, and a
balance of 4 spaces remains.

Extensive discussion has oecured with the applicant
relative to the proposed seating capacity and further
evaluation u=a.11 be available at the hearing.
Approval would be subject to the conditions that
drainage and grading plans are subject to the Engineer's
review, and that the permit will be revi.ewied annually.

BACKGROUND
The applicant seeks site and building plan approval for
an addition to his home which is a non-conforming use
in a C-1 district. He proposes to operate a beauty shop
in his home.
ANALYSIS AND RP-COMPI&NDATION
The various ramifications of the non-conforming use pro-
visions in terms of this application are treated in a
• memorandum to the commission dated October 31, 1972.
A copy of correspondence from the Building inspection
Department to the applicant is in the file. it refers
to the applicant 's unlawful installation of the footings
and foundation for the addition; a stop order was issued.
As noted in the meri-torandum the recommendation is for
. denial, leaving the non-conforming use intact.
