WHEREAS, Planning Commission Application Noe 71052 submitted
by Marvin Gordon requesting rezoning from R1 to R3 of the property
described as Plat 89360, Parcel 2000, 'located on the south sine of
194 and Lee avenue North has been considered by the Brooklyn Center
Planning Commission on December 2, 1971, and January 27, 1972; and
WEB S, the proposed rezoning was duly presented at a public
hearing on December 2, 1971, at which, time neighborhood residents
submitted for the file a petition opposing the proposed rezoning; and
WHERFAS• the application was submitted to the went Central
Neighborhood ,advisory Group and a report of the findings dated
Januaty 5, 1972, has been reviewed and placed on files and

of Public Works, regarding the feasibility rag developing the property

denial of Planning Commission Application No. 71052 submitted by
Marvin Gordon requesting rezoning from Rl to R3, noting that:
1. The subject property has been consistently conceived
as Pa in nature and that there has been no significant
change in the property since the last zoning review;
2. The proposed rezoning constit6tes "spot zoning";
3. The cast of developing the land for R1 purposes is
not substantially different from R3 development costs;
4. With respellt to non-economic factors, no reliable
testimony has been introduced to indicate that it is
not feasible to develop the laud for Rl use;
5. The size of the tract is not viable for sound R3
residential development..

does not satisfy the conditions for granting of a subdivision
variance as set forth. in Section 15-112 of the Platting
• Ordinance (See attached sheet) .

the existing use of land in the vicinity, the nwnber of persons
to reside or work in the proposed subdivision and the probable
effect of the proposed subdivision upon traffic conditions in
the vicinity. To grant a variance, the Council shall finds
I. That there art special circumstances or conditions affecting
said property such that the strict agpl.tcation of the provi-
sions of this ordinance would deprive the applicant of the
reasonable use of his land.
2. That the variance is necessary for the Preservation and
enjoyment of a substantial property right of the petitioner.
3. That the granting of the variance will not be detrimental
to the public welfare or injurious to other property in the
• territory in which said property is sit=uated.
(b) Application for any such variance shall be made in writing by
the subdivider at the time when the preliminary plat is filed
for the consideration of: the Council, stating fully and clearly
all faat~s relied upon by the petitioner and shal=l be supplemented
with maps, plans or other additional data which may aid the
Council in the analysis of the proposed project. The plans
for such development shall include such covenants, restrictions
or other legal prov=isions necessary to guarantee the full
achievement of the plan.
Section 5-31 V.--�Llmm, if any 6ection, subsection, sentence, clause,
or phrase of thi:e� ordinance 4.8 for any reason held to be invalid, such
decision shall not affect the validity of the remaining portions of
this ordinance.
Section 3.5-13.4. MLATION PENALTY. Any person vialtiating any pro-
vision of this ordinance shall be guilty of a misdemeanor, punishable
by a fine of not more than Three Mindred ;Z$300.00) Dollars and by
imprisoa went. not to exceed ninety (90) days.
• Section 15-115. RRPEAL� Vie provisions of Chapteg 15 of the City
Ordinances are hereby repealed and the provisions of this ordinance
shall be hereafter designated as Chapter 15 and the sections hereof
number as designated.

Description of Request. Site and building plan

The applicant is approval of a 95 unit
townhouse complex to be located at Brooklyn Boulevard
and Wingard Lane.
The site contains about 14 ages with the proposed
density being 6+ units per acre. Eight units per
acre is permitted in R.3 zones.

to the following conditions:
1. The detailed plans for utilities, site grading,

and drainage shall be approved by the City Engineer
prior to the issuance of any building permit;
2. The final building plans are subject to the approval

3. A performance agreement and performance bond (in
an amount to be determined by the City Manager)
