Applicant: Normandale Tennis Clubs, Inc.
Location: Southeast corner of Lakebreeze and Azelia Avenues
Request: Site and Building Plan/Special Use
The applicant seeks site and building plan and special use permit approval to con-
struct a racket and swim club on the 7.4 acre area of land at the southeast corner
of Lakebreeze and Azelia Avenues. The property in question is bounded by Lake-
breeze Avenue on the north, by Azelia Avenue and a single-family residence on the
west, by Highway 100 on the south and southeast, and by Denny's Restaurant on the
east. This application was tabled by the Commission at its October 20th meeting.
The tabling action directed the applicant to prepare plans for a parking ramp and
directed staff to prepare an ordinance amendment and obtain comments from Mn/DOT
regarding the status of the intersection of Highway 100 and Indiana Avenue.
Staff have prepared an ordinance amendment for consideration by the Commission
(attached) . The ordinance amendment requires parking spaces for racket and swim
clubs, athletic clubs and the like on the basis of: 20 spaces for the first
1 ,000 sq. ft. of gross floor area, plus one space for every additional 300 sq. ft.
of gross floor area, plus two spaces for every outside tennis court. For the use
in question, this parking formula would require 311 spaces for the building
and 24 additional spaces for the outside tennis courts for a total of 335 spaces.
As discussed in our previous information sheet, the applicant proposes to install
240 spaces initially and show proof-of-parking for the remainder on a plan for a
parking ramp. This ramp would only be installed upon a determination by the City
that the 240 spaces are inadequate. This determination would be made in accordance
with a legal agreement drafted by the City Attorney and entered into by the City
and the applicant.
The plan for the parking ramp provides 105 stalls on an elevated platform 9' 6"
above the parking lot level (7' 6" clear) at the northwest portion of the site.
The parking lot slopes downward from east to west and the ramp will follow that
contour, if built. The elevation of the parking lot at the west end is 854' .
The level of Azelia Avenue is between 862' and 864' . Therefore, the level of the
parking ramp would be a foot or so above the level of Azelia at the west end. It
would rise to an elevation of about 870' , six to eight feet above the level of
Azelia Avenue. In addition, there would be a 3' 6" high barrier which could
serve as partial screening of the parking ramp, which itself will be screened by
trees and shrubs in the 15' greenstrip adjacent to Azelia. Access to the ramp
would be via Lakebreeze Avenue.
Staff have received one letter from Mn/DOT which suggests that the City plan for
the possibility of a link between Lakeside and Lakebreeze Avenues and the closing
of the intersection at Highway 100 and Indiana. This position conflicts with
the position taken by Mn/DOT in 1980 when the City was informed by the District
Engineer that Mn/DOT had no plans to close the Indiana intersection (copies of
both letters are attached for the Commission' s review) . Staff have, therefore,
met with representatives from Mn/DOT to discuss the matter and request that the
1980 position be upheld. However, Mn/DOT has informed City staff that the 1980
position was in error and ask that the City keep in mind the possibility of a
link between Lakeside and Lakebreeze.

Staff feel that this position need not necessarily be adhered to because the
modifications to Highway 100 are a low priority and will not take place for many
years, if ever. Approval is, therefore, recommended, subject to at least the
following conditions:
1 . Building plans are subject to review and approval by the Building
Official with respect to applicable codes prior to the issuance
of permits.
2. Grading, drainage, utility and berming plans are subject to review
and approval by the City Engineer, prior to the issuance of permits.
3. A site performance agreement and supporting financial guarantee (in
an amount to be determined by the City Manager) shall be submitted
prior to the issuance of permits to assure completion of approved
site improvements.
4. Any outside trash disposal facilities and rooftop mechanical
equipment shall be appropriately screened from view.
5. The building is to be equipped with an automatic fire extinguishing
system to meet NFPA standards and shall be connected to a central
monitoring device in accordance with Chapter 5 of the City
Ordinances.
o. An underground irrigation system shall be installed in all land-
scaped areas to facilitate site maintenance.
7. Plan approval is exclusive of all signery which is subject to
Chapter 34 of the City Ordinances.
8. B512 curb and gutter shall be provided around all parking and
driving areas.
9. The special use permit is subject to all applicable codes, ordinances,
and regulations and any violation thereof shall be grounds for
revocation.
10. Plan approval acknowledges proof-of-parking for at least 95 additional
stalls based on a formula of: 20 spaces for the first 1000 sq. ft. of
floor area, plus one space per 300 sq. ft. of additional floor area, plus
two spaces for each outside tennis court (this formula subject toadoption
of a Zoning Ordinance amendment by the City Council ) . Part or all of
these additional parking spaces shall be provided by the construction
of a parking ramp above the west end of the proposed parking lot. Said
parking ramp shall be appropriately screened. The applicant shall enter
into a written agreement with the City to install this parking ramp at the
request of the City and this agreement shall be filed with the property
at Hennepin County.
11 . Plan approval is contingent on adoption of the parking formula in Conditia
No. 10 by ordinance amendment. No building permits shall be issued prior
to the effective date of this ordinance.
12. The developer shall be responsible for installing the turnaround area
at the end. of Azelia Avenue including curb and gutter in conjunction
with the development of this plan.

13. Building permits shall not be issued until the plat comprehended under
Application No. 83052 has been given final approval and filed with
the County.

Request: Preliminary Plat
The applicant requests preliminary plat approval to combine into a single parcel
the 7.4 acre area of land at the southeast corner of Azelia and Lakebreeze Avenues.
This area is zoned C2 and consists of three parcels and two sections of right-of-
way, one from Grimes Avenue and one from Lakeside Avenue. This application was
briefly reviewed at the October 20, 1983 Planning Commission meeting and was
tabled since no public hearing could be held at that time. A public hearing has
been scheduled for the November 10th meeting.
The primary concern with this plat, not raised in the previous information sheet
on this application, is the question of providing a link between Lakeside and
Lakebreeze Avenues. Such a link would be needed if the intersection at Highway
100 and Indiana Avenue were closed, in order to allow traffic from The Beach
Condominiums to reach Highway 100 without passing through a residential neighbor-
hood. The existing Grimes Avenue right-of-way was dedicated with the intention
of someday providing such a link. However, the proposed tennis club and accompany-
ing plat would foreclose the possibility of the Grimes route.
In April , 1980 the City was advised in writing by the Mn/DOT District Engineer
that Mn/DOT had "dropped consideration for the closing of the Indiana Avenue
intersection. " This letter (attached) was in direct response to an inquiry by the
City Council to the District Engineer at a City Council meeting regarding the future
of the T. H. 100/Indiana Avenue. intersection. Based on that letter the City has
entertained discussions with interested parties regarding a large development
encompassing this entire area that would involve the vacation of Grimes Avenue and
a portion of Lakeside right-of-way. It should be noted that the architect for
Northwest Tennis Clubs also contacted the Mn/DOT District V office and was advised
by a transportation planning engineer that there are no plans for the future up-
grading of T. H. 100 that would eliminate the Indiana intersection.
As part of the notice requirements for the preliminary plat Mn/DOT has again been
contacted. They have responded in a letter (attached) which suggests that accomm-
odation be made for a future link between Indiana and France Avenues. This
obviously contradicts the position taken by Mn/DOT in a 1980 letter regarding the
same subject. Staff have discussed the matter with Mn/DOT personnel and their
position is that the 1980 statement should have been qualified with the statement
in the "near future. " 'They state that never is a long time and they can foresee
that in the distant future T. H. 100 might be upgraded necessitating the need for
a frontage road and that they are only suggesting consideration.
Staff feel that the suggestion from Mn/DOT need not be adhered to in light of the
low priority such a project has and the length of time before it would take place.
We feel that, for the foreseeable future, the proposed tennis club poses no
problem and should not be abandoned on the very tentative, long range unplanned
possibility by Mn/DOT. Other options are also availa 0 e. We, therefore, recommend
its approval , subject to at least the following conditions:
1 . The final plat is subject to review and approval by the City Engineer.
2. The final plat is subject to the provisions of Chapter 15 of the City
Ordinances.

3. Hookup charges for water shall be paid in conjunction with the platting
of the property.
4. The agreement regarding installation of the parking ramp shall be
executed prior to final plat approval and filed with the County in
conjunction with this plat.

Notice is hereby given that a public hearing will be held on the 19th day of
December, 1983 at p.m. at the City Hall , 6301 Shingle Creek Parkway, to
consider an amendment to the Zoning Ordinance providing a separate parking re-
quirement for racket and swim clubs.

AN ORDINANCE AMENDING CHAPTER 35 OF THE CITY ORDINANCES
TO PROVIDE A PARKING REQUIREMENT FOR RACKET AND SWIM CLUBS
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS:
Section 1 . Chapter 35 of the City Ordinances of the City of Brooklyn
Center is hereby amended in the following manner:
Section 35-704. MINIMUM PARKING SPACES REQUIRED.
2. Commerce (Retail and Service/Office)
(i ) Racket and swim clubs, athletic clubs, health spas and the
Tike:
Twenty spaces for the first 1 ,000 sq. ft. of Gross building
floor area, plus one space per 300; sq. ft. of gross f oor
area in excess of 1 ,000, sq. ft. plus two (2 spaces per
outside tennis court.
Section 2. . This ordinance shall become effective after adoption nd
upon thirty (30) days following its legal publication.
