RESOLUTION NO. 2013-138
RESOLUTION AUTHORIZING THE EXECUTION OF A COOPERATIVE
CONSTRUCTION AGREEMENT FOR BRIDGE NOS. 27038, 27038A AND
27038B LOCATED ON TH 100 AT BROOKLYN BOULEVARD (C.S.A.H.
152) BETWEEN THE STATE OF MINNESOTA DEPARTMENT OF
TRANSPORTATION AND THE CITY OF BROOKLYN CENTER
WHEREAS, the State of Minnesota Department of Transportation ("MnDOT")
has programmed the replacement of the Highway 100 (TH 100) bridge deck at C.S.A.H. 152 in
2014; and
WHEREAS, the City of Brooklyn Center ("City") and MnDOT have been
working cooperatively to include additional concurrent improvements with the standard bridge
deck project including maintaining the trails on each side of the roadway, street lighting,
aesthetic elements (decorative bridge railings, architectural stone surfacing, and other
streetscaping elements) and other associated construction elements; and
WHEREAS, the project is multi-jurisdictional, involving the MnDOT,
Hennepin County and the City; and
WHEREAS, MnDOT and the City desire to set forth their various construction,
funding, operation and maintenance responsibilities in a Cooperative Construction Agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that:
1. The City of Brooklyn Center enter into MnDOT Agreement No. 04746
with the State of Minnesota Department of Transportation for the
following purposes:
To outline maintenance responsibilities and provide for payment by the
City to the State for the City's share of the costs of the associated
construction to be performed upon, along and adjacent to Trunk Highway
100 at Brooklyn Boulevard C.S.A.H. 152 within the corporate City
limits under State Project No. 2755-101.
2. The provisions of the draft Agreement are hereby accepted and approved,
and the City Manager is hereby authorized and directed to execute a final
Agreement, which must be in substantial conformance with the provisions
of the Agreement attached hereto.

3. The City's total project cost is $227,000, and the funding source is Brooklyn
Center's TIF District 2 ($201,600) and Hennepin County Roadway
Enhancement Program Funding($25,400):

The motion for the adoption of the foregoing resolution was duly seconded by member
Kris Lawrence-Anderson
and upon vote being taken thereon,the following voted in favor thereof:
Tim Willson, Carol Kleven, Kris Lawrence-Anderson, Lin Myszkowski, and Dan Ryan;
and the following voted against the same: none;
whereupon said resolution was declared duly passed and adopted.
