BACKGROUND-.
A„ Parking Variance„
it is the contention of the applicant that the ordinance
requirement of one parking space per three theater seats
does not apply to the multi--theater concept such as is
being proposed. The applicant further contends that a
one parking space per four theater seats is more realistic
because tbeater hours are staggered and maximum capacity
is not needed at any one time,.
• The I to 3 ratio would require 623 parking spaces while
maximum recfuareroents at a I to 4 ratio is 468 spaces..
B. Site Plan Approval,
The site plan has a number of deficiencies in that there are
a number of problems in regard to traffic circulation at
the entrance, inadequate isle width, parking lot lighting,
underground sprinkler system deficiency and internal fare
sprinkling system.
RECOMENDATI ON.-
The staff has studied the applicant's contention that a
4 unit theater is unique because of the staggered hours
of showing as compared to the one unit theater, and it
appears,, clue to the fact that there will be hours of
maximum capacity during a given time period that thiere is
little difference between the two concepts in regarld to
parking requirements.

it is the opinion of the staff that in the absence of any
cl.earcut evidence that the 1 to 3 ratio is prohibitive
and the 1 to 4 ratio is adequate, the staff would recommend
denial.
The staff would recommend approval of site and building
plans providing the aforementioned deficiencies (See 8)
• are eliminated and the usual plan conditions are adhered too

Description of Request: The applicant is requesting approval
of a 35 foot rear yard setback

BACKGROUND
The applicant contends that although the parcel is zoned
R5, it is somewhat less than ideal for an apartment site
due to size, shape and proximity to County ]P,oad No. 10.
They further contend that the ordinance requirements requiring
90° of total building setback creates a hardship in developing
the sited
One additional consideration is that because the property
is in one ownership, it could be considered as part of a
unit development and thus negating the need for strict
application of ordinance requirements.
RECOMMENDATION:
The staff is of the opinion that although the site is marginal
in respect to required setbacks there is reason to believ<a
that if it is integrated with the Twin lake forth Apartmeat
project, the setback requirement becomes sozme0hat diminis'h.ed,
Parenthetically, it appears that the viability of this
variance request is determined by the ability of the appli-
cant to integrate the site with the Twin Lake North devel,'?pmont.
The staff would therefore recommend approval contingent
upon the above conditions and an affirmative action in
rezoning of the parcel.

BACKGROUND.-

RECOMENDATION:
The plan is in order in regard to the usual conditions as
prescribed by the ordinance, and the staff recommends
approvai subject to the following special conditions:
1) The ingress and egress curb cut shown on the South-
east portion of the parcel be eliminated due to
its proximity to the Win Lake North curb cut 28
feet to the east. it is further recormnended that the
Twin Lake ingress and egress curb cut on the east
be designed in such a manner to provide access to the
convenience center.
2) There is . a deficiency in landscaping on the 15 foot
green strip at the South portion of the lot and it is
recommended that this strip be augmented by additional
tree plantings.
3) it is recommended that the opaque fence at the North
portion of the parcel be removed and replaced by a
strip consisting of either cedar chips or -white rock.

BACKGROUND
This application was before the Planning Commission on
June 4, 1970, at which time it was denied because it is
inconsistent with the goals of the Comprehensive Plan.
The application was tabled by the City Council on July
27th and August 10th, because of problems involved with
the vacation of Irving Avenue and acquiring of additional
land to satisfy a density requirement for he existing
• R5 zone.
These particular problems have been resolved by the City
Council and the application has been remanded to the
Planning Commission to assess the comet-ercial land use upcn
its merits.
