PLAISWING COMMISSION 11STFORMTION Sn. ET
ARrlicatioft No. 71003
Applicantf, B.C.I.P. , Inc.
Of Requ'est' Site and builLding plan approval
The applicant is requesting site and building plan approval
for a three unit, 1,586 seat theater to be located on Tract 33,
41300' jqhiCh 4S
R,.L.S. , — -1 cortmonly described as being located
at John. Martin Dr-Live and County road 10.
The Convaission has previously recommended approval of
sito and, b-,ailding plans for a theater on this site on Septed'3er
24, 1970, but the application has been withdrawn. Therefore..
a new proposal is submitted for consideration.
The site in question is rather difficult to dovelop bet,. usr,?
• of the peculiar -shape. + Ilote enclosed raap)
The type of business operation iz such, in the opinion.
of the applicant, that tJje s%ructure must; be Iccated in an
,area that would allow maximum exposure f?om. County Road 1.0,
Fig.hte.-ay 100 arc' *,rohp. Martin Drive. Them fox-, e, the building
is lt.:, at 1-he soutt-herly portion of the parcel.
The designated location poses a problew in regard to what
shculd be consi.derc-6 as the front, sides and rear o:E the par'zel
f:-,-v setback. Purposes.
if the sout-her'y portion, of the parcel, that which faces
County Rm)d 10 and a portion of i-Jighway 100 off reaup to County
Road 10, is considered as frontage, the ordinance requires the
kolloving setbacks:
I F-ront - -che most southerly portion of the structure
must be setba=k 50 feet from t"Itle, south -Pro!,:verty lin-e.
Side - 10 -1'7eet front the west and t-':?e east propert_.,,-
lines.
Rear - 40 feet from the north p.,:operty line.
Page 2
APPI-t-cation NfO. 71003
if it is aetermined that the property frontage is
located on County Road 10 and a portion of the .951-ghway 100
off ramp to County P.n-ad 10, then all setback requirements
are met as proposeel on the site plan.
.E-iowever, if -he ceasterly portion of the pax-cel, that
which faces a:ohn m1axtir Drive and Figh,,)ay 100 is considered
as frontage, the ordinance "requires the fallow-ing setbac, kzsz
1. Pront 540 feet from the cast property iine.
2. Side 3.0 feet front the north and the south
proper-Y lines.
3. Rear -- 40 feet from the 1,est propert-y line.
if the easterly po-r-ILion of the parce-1, ';---bat which faces
john Plartin D°.J.ve an-2- 1-lighway 100, is c-onk-idered as frontage,
t 116-n the rear setback is 30 feet short- of 11- e ordinance
• cec.ruirerkent .
The fact that the parcel has a rather unusuaj- shape makes
' t (3 I f f -
icult to deteermine what shoo-Id! be considored as frcr-tage
xor setbac.'.k purposes. ETowever, there are a numiner of points
t'hatl- sbould Le ccnsidered'-
1. Access - Access to the parcel is gained J!rom a
proposed road-t;ay- to be located at the north property
line. If- it is determined that the north d.-,7ive-,,;ay
'Lf lt"--bP frontage of the property, then al,',- setback
re-quirement,@ are met, because the a.-ea facing County
Road 10 would be a rear yard, and the areas to the
easiz and :A?est of the structure would be -considered
as side yardG.
2. Tau;ldinq Orientation - The ent-rance and lobby area
for ice the&er faces tI)(-.% east prope.—':y line
proposeo
at John Tlaxt-in Drive and Higlyaay 100. 14` - t is
dete.--Lqined that the east proparta, 3.1ne the
frontage c-f the parcel, a 30 foot rear yard variance
would be required. Such a variance Tr.a not. been
• requested by the applicant, or it be
recoizaended b-,r the staff.

3. Bui.'t 'j lq Ex-posure - 'the building so located at the
'sO_1j_t_he_rn _p'o'r_'6_ionof the parcel *,dould probably receive
its greatesit exposure from County, Road iO and the
Hig'awav 100 off ramp. if exposure i,,5 deerted as a
detriment in designating frontage -,'Zor the parcel,
then Uie soutb lot line should be designated as
such and all ordinance setback requirements would
be met,
Tf the E:ontage and setback requirements are resolved,
it is reconmiended that the site and building plans be appro%,ed
