BACKGROUND:
The applicant is requesting site and building plan approval
for a proposed 1,950 square foot addition and site. improvements
on a parcel located at 3515 - 48th Avenue Forth.
ANALYSIS AND RECOMMEMATIONa
The site, as it exists, consists of a 6,000 square foot
building which is utilized as an office, machine repair,
and warehousing facility. The property is partially
paved, uncured, and partially landscaped.
The site plan, in addition to the 1,950 square foot expansion,
proposes to complete the parking and driveway areas by
adding additional bituminous surfacing and placing concrete
• curbing around the periphery of the driving and parking
areas. The remaining areas is to be sodded.
Plan .approval is recommended subject to the usual conditions,

Description of Re-cpiest s Side yard setback variance and
building ground coverage variance
The applicant is proposing to construct a 910 square foot
garage ten feet from the side property line.
The Zoning ordinance requires a 25 foot sine yard setback
one the street side of corner parcels and further, that
acresso.ry buildings not exceed 75% of the ground coverage-
area of the dwelling building. (Refer to Sgcti.on 35-310. 1(b) (3)
of the Zonina Ordinance) . The applicant in requesting
a l5 foot side yard setback variance and a 216* square
foot lot coverage area variance.

If a 10 foot setback is granted, it would pose a problem,
in that vehicles parking in the driveway would be encroaching

This problem becomes even more critical because Lakeside

a large parcel (261' x 2001) in which these is 30 feet of
right-of-way for street purposes. Because of the size of that
lot and a poszlbl.e future platting of it. it is anticipated
ithat the sufficient right-of-,way could be obtained through
dedication to provide for construction of a street of
sufficient wi at.h on Lakeside Avenue.

Consequently, granting of a minimal 10 woot setback vrtsuld
be a detriment and not be in the Wiest interest of traffic
safety if and when a roadway of sufficient width can be

It is therefore recommended that the sideyard setbacX
variance be denied because of the aforementioned factors,
and further, be-�.-ause the applicant has failed to show
ha dahi.p consistent with ordinance provisions.
Relative to the building got area coverage, it should be
noted that this ordinance provision is established to
prohibits
1) Construction ..)f accessory buildings as large as
or larger in square footage than the principal
building (IiTjinq dwelling) t
2) Proliferation of a :number of accessory buildings
as large as or larger than the principal building.
The existing Isome on the property in question has 925 square
feet of floor area and the proposed accessory building
(,<.arage) would contain 910 square feet of floor area.
Research of previous applications of a simi.lear nature irdicat(.f
that sufficient precedent has been established by the
Planning Coma-Assion and Council that mi.tigat6 against
granting the request variance.
X t is therefore recommended that the variance be denied
because it w,:)u .d establish an unwise precedent and burther,
th;A the applicant has failed to show sufficient hardship
relative to ordinance requirements.

into a living area over the past two years .-oithout obtaiainr
the necessary building permits. The Building 'Inspector,,
while making a routine inspection of a garage 'wing
• constructed on the parcel, discovered the remodeling
operation taking place and ordered the applicant to cease:
construction until proper approvals for a variance were
granted and a building permit could be issued.

• The lot in question has a rather peculiar shape in that
it is narrow in width (75 feet) with a total overall depth
of some 200 feet. Because of this shape and property Nines
which do not run coincident %lith the building, it appeara
that there may be merit for granting a variance.
