*Zhe applicant is requesting site and building plan approval
for a 142 unit condomiai atz townhouse development for a
parcel located at 56th and Major Avenues biorth east of the
`Twin Lake Worth: Apartment's.
The Planning conmiiss:ion initially reviewed this application
on April 2, 1970, at w li.ch time a re mua►endat:ion for
conceptual approval of the site plan was made to the
City Council with- the pro-vision that any change in the
plan should be referred back to the Planning Ccxmission
if deemed appropriate by the staff for the Planning
comm,issior; Chairman., with. the understanding that legal
c?ocum,�nits required for the development would have to be
approved by the City Council.
• The C1t.y council reviewed the applicati.on on April 13, 19100;
at which time concept: playas were approved
virh the 6irection that the City Manager develop and
recoirmend methods for resolving ing inconsi,stenc es and conflict
between tj,e subject proposal and the p=resent ordinance
structure.
On May 24 1971, the city Council reconsidered the appli--
catien anci it wags their action at that time to remand it
to the Plvnning Commission for review and recommendation.

40 when the units are pre-sold. When the phase One is
completed, each individual unit would then be surveyed
and a plat submitted for approval.
Phase T"a consists of 58 cluster units and two tot lots
to be developed utilizing the same procedure as set forth
in Phase one.
Review of 1:he site plan indicates that it is in order
relative to general site considerations, landscaping,
and setback requirements, however, general information in
regard to drainage, elevations and general construction
techniques may be required by the City Engineer and
Building inspector prior to the issuance of any buildin-.7
permits
At previouo bearings related to this application, there
has been discussion in regard to the feasibility of placing
a snow fence on the west side of the property to protect
the residences on June Avenue from potential debris and
materials that may be blown into the properties during
the period of constructiun and a question in regard to the
associatiop agreement for the townhouse development.
Review of these matters we uldindicate that it way be well
as part of a requirement of the plan approval for the
Commission to consider the merits of requiring such a
fence during construction.
in regard to the Association Agreement, it should be noted
that it hao been forwarded to the City Attorney for his
review who will in turn, background the Commission on Me
matter at the meeting on June 3, 1971.
in summary, it is recommended that the site and building
plan be approved subject to the following conditions%
1. That '.he total site plan be approved with the
provinions that Phase Two be reviewed by the
Vlannnng Comnission and/or Council upon completion
of Phase One to determine if there are any necesra:o.y
adjustments to the total development plan prior to
enterLng into phase Two

• 2. That a model four unit cluster be allowed to

and convalescent home licensed and regulated by the
State Board of Health and local municipal nursing home
ordinance.

MCKGROUND t
The applicant is requesting rezoning from R3 and C2
to R4 to permit construction of a 165 bed nursing home
facility to be located east of the Georgetown Apartment
complex and north of 66th Avenue North.
The application was previously tabled on June 4, 1970,
to al'-ow time to develop standards and criteria for the
construction, licensing and operation of nursing home
facilities within the City .

The City Council bas recently adopted a nursing home
ordinance establishing criteria, licensing and regulations
• for such facilities and the applicant is now requesting
the rezoning to R4 which permits nursing home facilities tv�

existing .R3 and C2 zoning districts do not allow nursing
homes as either a permitted Cori a special use.
The property in question is bounded on the east by C2
(commercial) , on the north by R3 (multiple) OYI the west

Given the nature and character of the uses in the proximity
to the sit,,, it would appear that an R4 zoning is an

Church located at 5840 Humboldt Avenue North.
ANALYSIS AND RECOMMENDATIONt
An R4 district is the lowest zoning classification that makes
specific reference to day care centers as a special use,
Brooklyn Center Baptist Church is located ir an R1
residential district which requires a special use permit
for
1) Public and private elementary and secondary schools
offering a regular course of study accredited by the
Minnesota Department of Education provided primiry
• vehicular access shall be gained to the uses by a
collector or arterial street; and
2) Other non-commercial uses required for t4%e public
welfare in an RI district, as determined by the
City Council.
The day care center requested by the Baptist Church could not
be construed as a public or private elementary or secondary
school offering a regalar course ouf study, however, -the
proposed use is one that can probably be associated with
such a use and therefore brought to the attention of the
Planning Commission.
It may, however, be associated with non-comatercial uses
required for the public welfare as determined by the City
Council and it is therefore recommended that the special
use permit be approved subject to the speciel consition t'.'Iat
the State of Minnesota license required for the operation of
such a day care center is procured, and a copy of which i3
submitted to the City and placed on file prior to the
commencement of the operation.
