Lots 1 and 2 are deficient in area required to support single family dwellings; 20 Lots 2 , 4, and 5 do not meet the ordinance requirements of 110 feet average minimum depth; 3. According to the ordinances a 30 foot street right-of-way would be classified as insufficient; 4. Unless add1-tional property is acquired from that lot designated as an exception between lots 6 and 7 , the turn around right-of-way would be absolutely insufficient,, VILLAGE OF BROOKLYN CENTER Donald G. Poss, Village Eng. • Building Department January 3, 1962 Planning Commission For quite some time the Building Department has been concerned about the enforcement of Section 35-421 of the Village Ordinance. Recently a conservative survey of the Village has been taken to determine how many violations actually .gist at the present time and how can we justify a decision to enforce said Section by actual measurements and by implyiag actual impediment of vision. The two stipulations May 6-e in conflict insofar as to what cons'.Atutes' a vision block laterally and uot be within the minimum requlremasts, Tice survey data and pictures as sumbitted, list over 90 corners which came under such classification and it should be noted that the photos do not present a true picture due to the loss of foliage at this time of seasons It should also be noted that the average elevation of a corner lot above a street intersection is approximately 2 feet thereby permitting only a very low planting if any at 311 in some areas. • The 50 foot limit from a point of intersection of the street would curtail the planting of evergreens In all corner lots due to the 25 foot side street set back and the 35 foot front set back. Such requirements result in 7 feet from the corner of the building for planting and usually that space is taken up by sidewalk. These measurements pertain to present platting and zoning, but do not pertain to the older areas in which most of the violations do exist, Enforcement would be practically Impossible especially from a maintenance aspect, . Chaos and dissention among property owners way result In the enforce- went of this Section of the ordinance and may not accomplish the desired effect of slowing down the traffic to a safe and sensible speed. This qualification to the removal of Governmental immunity is to prevent liability' attaching to stt,,,h actions of the municipal Government as the enactment of ordinances. In aasvaer to he first question, it is our opinion that she Village can enter into such a lease agreement. There have been rum erous situations where municipalities have been allowed to lease municipal property which is not currently needed for municipal purposes, Some examples of this are where the municipality may lease a civic auditorium to a private corporation for showing moving pictures or the use of a civic building for private dinners or other functions, In answer to the second question, it would probably be well to have a month-to mouth lease which would be terminable upon a mouth's notice, This agreement should contain a "hold harmless clause" which would protect the Village from any liability, as well as any costs of defense on any lawsuit arising out of the use of the property b., the non-profit corporation. In answer to the third question, it seems to me that the clear intent of Seotion 35-310 when paragraphs I e,, and 3 h, are taken together is than this kind of use should be permitted, To make it clear, however, it might be wall to amend Section 3 h, to read "unlighted ball parks not operated for profit," If you want to proceed with this matter, let one know, and I will draft; the appropriate lease aglreement, Very truly ymUrs„ Arlen C. Members appointed to the Commission in April were: Two year terms: Robert Grosshans, Dallas Holm, Frank Kampmeyer, Dallas Lawrence, Roger Machmeier, Mrs. Don McArthur, Charles Nelson. One year terms: Gerald Gerber, Harry Johnson, Wayne Lubrech., Robert Oslund, Norman Qualey, Earl Simons, Harlan Sween. Norman Qualey resigned and was replaced by Charles Gerber in October. Robert Grosshans was appointed to the Planning Commission and was replaced • by Marshall Jacobsen in March. Dallas Holm and Charles Gerber resigned from the Commission in March and have not been replaced at the time of this report. However; Charles Nelson and Harlan Sween have been replaced by Arthur Raeker and Earl Rydberg, respectively. Officers elected were Robert Oslund, Chairman; Dallas Holm, Vice Chairman; Ernee McArthur, Secretary. This report consists of our activities during the year, including general remarks and recommendations. Also attached is a copy of the recap of our Industrial Climate Study. In order for the members of the Commission to have readily available this information, a Cataloguing Committee was appointed. Upon completion of the committees work, each member was furnished with a catalogue showing the size, location, and other pertinent information on each of these tracts. During discussion and study of the Cataloguing Committees report, and information received from the Contact Committee, we found this land was not available. It appeared that this land was being held for speculation purposes at prices unattractive to prospective buyers. Since the price of this land was so high, the Commission felt we should investigate the assessed valuation of thevarious properties. john Nordberg, Village Assessor, was invited to appear before this Commission for purposes of discussing taxation policies on industrial properties in Brooklyn Center. Mr. Nordberg informed us that the land was assessed and taxed at a rate similiar to that of other property in the area, and was not based on the asking price of the land. It has been difficult to retain any real interest in Brooklyn Center industrial properties because of the speculative prices. Primary interest to the Commission has been the proposed Urban Community Plan for Brooklyn Center, reviewed with the Commission by • Tom Hodne, of Community Planning and Design Associates Inc. The plan was favorably received by the Commission, and felt that further development of this area should be expedited by all possible means. Since the nucleus of this further development was already established at Brookdale, Robert Crabbe, of Southdale management, and Mr. William Crear, Jr. , of Southdale, Brook- dale, and the Dayton Co. , appeared before the Commission and explained the proposed use of the land in the Brookdale shopping area. To inform the Department of Business Development of the State of Minnesota, of Brooklyn Center's interest in attracting industry, Mr. IfTilliam Farrell, Director of Business and Industrial Services, was asked to meet with us. Mr. Farrell stated that it would be necessary for Brooklyn Center to complete their questionaire in regard to specific information about Brooklyn Center. This complete questionaire is now on file with this department, and will be used for promotional purposes. To update the Community Fact Survey by Northern States Power Company, current and more extensive information was required. As a means of accomplishing this purpose, the Commission completed a Industrial Climate Study. This study provided the necessary information for the Community Fact Survey, now being prepared by Northern States Power Company. Additional information was gathered, by personal interviews with each business and industry. The results of this study are compiled and attached to this report. Since the questionaire used was similiar to one used by Bloomington, a comparison of results is also included. i ` ANNUAL REPORT -2- March 22, 1963 i, To further acquaint the members of the Commission with characteristics that industry finds desirable in a community, Mr. Martin Polland, Northern States Power Company; and Mr. Richard jesberg, Reviewing Appraiser of Prudential Insurance Company, appeared before the Commission. Some of the other areas covered by committee work were publicity and ordinance revision. The Publicity Committee has had published numerous articles in the Brooklyn Center Press and other news media. The model of the Urban Community Plan was displayed at Brookdale and at the Brooklyn Center State Bank. Members of the Commission studied the proposed revision of the zoning ordinance and made recommendations. At a joint meeting with a sub-committee of the Planning Commission, this Commission went on record as being in accord with the Planning Commission's interpretation of land uses in Brooklyn Center. SUMMARY We feel the Commission has made substantial progress during the past y,:ar. A considerable amount has been background information, which is hard to evaluate. Several problems have been noted in the course of the year's work. It has been repeatedly brought to our attention that approval of proposed developments is a lengthy and time consuming process, and might be subject to study for possible revised procedures. Many reports have been received, throughout the year, referring to the sign ordinance as being excessively restrictive and unfairly administered. Several speakers expressed the idea that industry does not consider land to be available until zoned for its intended use. This would seem to be particularly important for the Brooklyn Center Urban Community. Since the Industrial Climate Study seems to indicate that the existing businesses in Brooklyn Center feel that the village is not doing all it can to attract new industry, the Commission's future plans include a program of additional promotional work, such as considering a means of distributing a promotional brochure. Studies under consideration are, whether Brooklyn Center should have a consolidated school district for more stablized tax base, and whether Brooklyn Center has a need for a Industrial Development Corporation. Ernst - Twin Lake Oaks Plat Gentlemen: At a recent Council meeting, the Village Council considered a letter from Mr. R. C. Ernst concerning the above plat. The Council has asked me to send this letter to the Planning Commission outlining the oral opinion I gave the Council at that meeting. As you know, the zoning ordinances require that a lot contain 9500 square feet of area before a permit to construct a single family dwelling will be granted. Section 35-601 contains an exception for property which was single ownership of record in 1940. My opinion to the Council was that the Ernest property did not come within this exception. Mr. Ernst also expresses the opinion that a refusal to allow him to use the two sub-standard lots designated as Tracts A and B for construction of dwellings would deny him the right to the reasonable use of his land. He argues that the fact that the lots are on the lake shore and therefore provided with much open space provided by the lake eliminates the reasons for the 9500 square foot requirement. I pointed out to the Council that this is an argument that deserves con- sideration. However, it is not necessarily controlling. It should be taken into consideration in the initial determination by the Planning Commission and the Council as to whether the ordinance as applied in this situation is reasonable. This is a determination which must be made upon all of the facts and must be made by the Council with the advice of the Planning Commission.
