It provides that the Council may rezone certain property to a more restrictive use where no structural, work has commenced theron. The ordinance also provides that there shat,], be an automatic review of certain rezoning action two years from the date the property was zoned. In my opinion., the adoption of such an ordinance and the revocation of the rezoned property pursuant to the terms of the ordinance would be a valid exercise of municipal power. The rules with respect to :rezona.aW, are discussed by the Supreme Court of Minnesota at Length in K1 s Vo City of St ul, 240 Minn. 522, 62 N.W. 2d 363 (1953). The genera rules se•t .forth 3.n that case and followed thereafter are as follow el 1) a municipality may rezone specific property to a more restrictive zoning classification where there is no vested right in the property owner which would preclude the application of a new zoning cl.assi- fication. 2) d property owner does not obtain a vested TIght by construction unless the work done prior to" the adoption of the new zo.mng classi- fication was sufficient to constitute an actual existing structure above the ground. 3) A m uiii cipality may include an automatic expiration date in a permit, or an automatic review of a zonig classification pursuant to an. ordinance. 4) Such rezoning procedure will not ba invalidated unless its application. to 'the property is arbitrary.. discriminatory,, or unreasonable. Los, Village Administrator, we submit the following recommandations 1. 62004 Request for Zoning Extention Osseo Road North of 70th Avenue North Multiple Family Use This request is for an extension of an existing RB Zone for a 7 unit 801 x 501 apartment unite The adjacent houses along Osseo Road are single family structrues on ample site lots in very good condition.. The lot to the East contains a moderate single family structure and barn type structure and virtually without dedicated access, A private church-school has tho re- maining undeveloped property adjacent to the East. The over- all land use should be considered to assure unified development in this area. The area south of the present Village Hall property to 70th Avenue North bounded by Osseo Road to than West and a future thoroughfare connecting 70th and 71st to the East. It seems in the future this total area should have a similar use. The present condition of the majority of than single family residences G6 in total) are in good condition and have a reasonably long life. Under the premise they will remain in their present use and the area should remain as single- family use. Lee Administrative Officer Village of Brooklyn Center 7100 Osseo Road North Minneapolis 22, Minnesota Dear Art: In a memorandum dated April 6, 1962, you asked whether the Planning Commission can recommend the issuance of a special use permit for a multiple dwelling where the application had requested a rezoning from R-1 to R-B, without requiring a new appli- cation. The procedure for requesting rezoning and requesting special use permits are set out in Sections 35-210 and 35-230, respectively, of the Village Ordinances. As a general rule, the Council and Planning Commission, once the Council has determined a procedure such as this, must follow the procedure which has been established. This rule is designed to protect the public and especially the people most directly affected by the govern- mental action, as well as to protect the owner-applicant. The public is protected primarily by the notice for hearing requirement of the procedure. This notice for hearing requirement is provided in both Section 35-210 and Section 35-230. The only significant difference is that the notice of hearing must be sent to more property owners in the case of an application for rezoning. Therefore, when a hearing is held to consider the rezoning of a particular parcel, a44 of the people who would be notified of a hearing to consider a special use permit would receive notice. Rezoning of a parcel to an R-B classification would carry with it the right to construct a multiple dwelling. Thus, anyone notified of a hearing to consider a rezoning to an R-B classi- fication would be aware that the hearing could result in permission to construct a multiple dwelling on the parcel involved. It is my opinion, therefore, that the public would be adequately protected if at the hearing the Planning Commission were to issue a special use permit rather than rezone the property. A special use permit, however, could not be issued without the consent of the owner or applicant. The applicant may want a rezoning and a rezoning only and could not be forced to accept a special use permit. If, however, the owner were agree- able, the application could in effect be amended to request a special use permit rather than a rezoning. It would be better procedure if this were to appear either as a written amendment to the application or as part of the motion indicating that the owner had requested ov consented to the amendment to the application. In my opinion, therefore, the Planning Commission may, with the owner's consent or at his request, issue a special use permit in lieu of rezoning as described above without requiring that the application be resubmitted. I have reviewed this ordinance from the standpoint of its legal ramifications anal more generally in the light of the recent decision of the Llinnesota Supreme Court in the case of Olsen v f.linnea�.olis. '2his is apparently tl.e case to rallich you referred in your letter concernin g special use , This case is particularly ap,3ropriate for consideration in connection r1ith this nro^osedy ordinance amendment because it involved the use of special use permits to restrict the construction of filling stations. There are several significant aspects of this decision, but its primary impact is summarized in the following sentence: "The council as nou Constituted is bound by the com-,)rehensive zoning classification, subject only to the erce;?tion that, if there is evidence that a nuisance rjill result from a commercial use in a particular neic,�hao:°hood, in its discretion it may deny an application for special permit to conduct a business ohich rjoulcl consitdte a nuisance there." The facts of the case riere that a property oraner uho 1janted to construct a service station on his lot which rias zoned for commercial construction applied for the necessary special use •,ermit. -he council denied his ;permit although he had fulfilled all of the requirements for approval by the fire marshal, city engineer, and the bui uinC ins. ector. the a?�parent grounds upon rihich the council relied in denying the ?permit mere the traffic, fire, and safety hazards that mould result from the construction of a service station- court specifically found that "many, if not all, of the commercial uses (other than gasoline filling stations) that are °)ermitted under the zoning ordinance lvould create ;problems more serious with respect to traffic than those problems, if any, rihich viould exist if a gasoline filling station is permitted at this location." 14I� purpose in discussing this case at this length is to emphasize that the Supreme Court has taken a dim vier, of unduly restrictive requirements upon the construction of service stations. This does not mean that the service station ordinance rihich you have proposed cannot be adopted. 71hat it does mean is that if it is adopted, its enforcement must be guided by the principles • nciated in this case and the strict letter of the ordinance probably cannot enu en follor�ed. Luse June 26, 1962 Page 2 "It is settled that purely aesthetic considerations do not form a sound basis for nullifying or destroying definite or valuable interests in proporty without compensation there- or to the owner.'' This language is especially significant in view of the requirements of sub- section 3 of the proposed now ordinance. Where is nothing p9r 1p wrong with the 'tillage requiring the submission of architectural and building plans ?rior to construction of the building. I have reviewed this ordinance from the standpoint of its legal ramifications and more generally in the light of the recent decision of the Minnesota Supreme Court in the case of Olsen v. Minneapolis. This is apparently the case to which you referred in your letter concerning special use permits. This case is particularly appropriate for consideration in connection with this proposed ordinance amendment because it involved the use of special use permits to restrict the construction of filling stations. There are several significant aspects of this decision, but its primary impact is summarized in the following sentence: "The council as now constituted is bound by the comprehensive zoning classification, subject only to the exception that, if there is evidence that a nuisance will result from a commercial use in a particular neighborhood, in its discretion it may deny an application for special permit to conduct a business which would constitute a nuisance there." The facts of the case were that a property owner who wanted to construct a service station on his lot which was zoned for commercial construction applied for the necessary special use permit. The council denied his permit although he had fulfilled all of the requirements for approval by the fire marshal, city engineer, and the building inspector. The apparent grounds upon which the council relied in denying the permit were the traffic, fire, and safety hazards that would result from the construction of a service station. The court specifically found that "many, if not all, of the commercial uses (other than gasoline filling stations) that are permitted under the zoning ordinance would create problems more serious with respect to traffic than those problems, if any, which would exist if a gasoline filling station is permitted at this location." • My purpose in discussing this case at this length is to emphasize that the Supreme Court has taken a dim view of unduly restrictive requirements upon the construction of service stations . What it does mean is that if it is adopted, its enforcement must be guided by the principles enunciated in this case and the strict letter of the ordinance probably cannot be followed. In this vein, another significant quotation from the case is: "It is settled that purely aesthetic considerations do not form a sound basis for nullifying or destroying definite or valuable interests in property without compensation therefor to the owner." This language is especially significant in view of the requirements of sub- section 3 of the proposed new ordinance. There is nothing per se wrong with the Village requiring the submission of architectural and building plans prior to construction of the building. It is apparent, however, that the Supreme Court of Minnesota would take a dim view of a refusal to issue a special use permit purely on the basis of the council's disagreement with the architectural design of the building. This case is particularly appropriate for consideration in connection with this permits ordinance amendment because it involved the use of special use permits to restrict the construction of filling stations. There are several significant aspects of this decision, but its ;primary impact is summarizes; in the following sentence: "The council as nou constituted is bound by the comprehensive zoninC classification, subject only to the e,:ce;?lion that, if there is evidence that a nuisance dill result from a commercial use in a particular neighborhood, in its discretion it may deny an application for special permit to conduct a business rjhich riould consituce a nuisance there." The facts of the case were that a property owner rho rianted to construct a service station on his lot shish was zoned for commercial construction applied for the necessary special use _;ermit. The council denied his permit although he had fulfilled all of the requirements for approval by the fire marshal, city engineer, and the builuinn ias octor. The apparent grounds upon which the council relied in denying the permit were the traffic, fire, and safety hazards that would result from the construction of a service station. The court specifically found that "many, if not all, of the convnercial uses (other than gasoline filling stations) that are ermi;,ted under the zoning ordinance would create .problems more serious with respect to traffic than those problems, if any, which riould e..ist if a gasoline filling station is permitted at this location." US purpose in discussing this case at this length is to emphasise that the Supreme Court has taken a dim viers of unduly restrictive requirements upon the construction of service stations. This sloes not mean that the service station ordinance which you have proposed cannot be adopted. ':mat it does mean is that if it is adopted, its enforcement must be guided by the principles enunciated in this case and the strict letter of the ordinance probably cannot be folloried. Ernst, 8625 Mattson Lane , Minne- apolis , Minnesota, has encroached on the bed of Upper Twin Lake by filling with earthen materials , thus increasing the land area of his own holdings . This trespass is in fact an attempt to appropriate the rights of the public in its waters to benefit and use of the individual with- out compliance with the statute which requires that a permit for Con- such action shall first be obtained from the Commissioner of Con- servation. No application for such permit is of record, in this office . This office does not recommend issuance of any permit or favorable action on any application if the objectives are considered to be adverse to the public interest. It is , therefore , requested that the Planning Commission of the Village of Brooklyn Center refrain from accepting any plan submitted. by Mr. Ernst until it can be shown that the exhibit is a correct and true representation not based. on evasion or violation of the statutes .
