BACKGROUND:
1) The existing building has a gross floor area of 139,128
square feet including mezzanine and requires 1,035 on sit.?
parking spaces.
2) The proposed addition has a gross floor area of 49,403
square feet and would require an additiona:. 343 parking
spaces for a total of 1,378 on site spaces,
3) The site plan as submitted shows 1,075 pa kleing spaces,
many of which are unusable.
• POINTS TO BE CONSIDERED:
1) Proposed additional new retail space (excluding additional
storage, and the garage addition) is 20,512 square feet
and would require 147 parking spaces for a total of 1, 182
spaces or 1.07 less than proposed.
2) Using the Boutell furniture store formula of 2 parking
spaces/1,000 square feet retail space (see City Council
minutes of 11/23/64) within the proposed retail furniture
area at Shoppers City of 23,182 square feet,would reduc-
required parking by 115 spaces.
3) Combini4 points 01 and V would reduce required parking
by 311 spaces for a new total of 1,067 and 1,075 are
proposed.

1) Three previous rezoning requests (Application No°s.
65060, 66002, and 66023) concerning the same general
area of the northwest neighborhood of the City, such
properties lying west of Osseo Road and (generally)
north of 71st Avenue - all denied.
2) This area was rezoned R-3 with the adoption of the new
Zoning Ordinance and Zoning Map.
• POINTS TO BE CONSIDERED
1) City Council Resolution No. 66-247
2) The recommendation of Rodne Associates that this area
be developed as a unit, consisting of a well designed
townhouse or single family "large estate type" lot
arrangements. See Hodne report of July 22, 1966.
3) Previous rezoning requests where a majority of the
neighborhood residents, expressing an opinion, were
against approval of the applications.

the first floor level.
3) The proposed signs are intended to replace 5 freestanding

BACKGROUND:
1) The property contained in this Application is designated with-
in the Comprehensive Plans as a "planned development area" .
2) Previous Planning Commission and City Council action on the
properties involved in this Application specified "that the
S development of those properties to the south of I-94 should
be directed toward multiple dwelling service/office or public
use" . (Planning Commission minutes of 4-2568.) CoLtncil action
denied rezoning from R-1 to a E-2 classification "as being
inconsistent with the goals of the Comprehensive Plan_ for the
City of Brooklyn Center and further, in recognition of the
conflict which would exist with a proposed C-2 interferring
with an established R-1 neighborhood". (Council Resolution 68-172)
3) This property was rezoned from R.-1 to R-B classification (and
since to a C-1 classification) at the request of Bermel. Smaby
Realty who at that time proposed an office building for the
location.
POINTS TO BE CONSIDERED:
1) Osseo Road Development Goals in the Comprehensive Plan, page
43 and 44, page 73 -- item 9, and page 73, item 10.
2) Possible encroachment northward to the freeway of other commercial
uses if this Application is approved.
3) Previous actions that have allowed an R-1 classification be
rezoned to the present C-1 classification and the present
request for higher type use.
4) The concept of residential and C-1 classification having a
buffer or transition features.

2) One--half of the building will be occupied by Automotive
Supply; the other half is not leased at this time.
3) The use classification is not known at thi,j time and
parking requirements are difficult to determine, but the
lot has enough area to provide parking for even the most
intense use.
• 41 It is believed that an easement grant exists that provides
part of the access to the subject lot in which case
evidence should be submitted showing that such an easement
has been duly recorded.

POINTS To BE CONSIDERED.-
1) The Federal Lumber Company has applied for a building
• permit to enclose the steel structure and add a
161 x 561 storage shed on the north side of the
principle building.
2) As stated in Section 35-250 of the Zoning ordinance.,
the ,policy of the City is to promote an attractive
well conceived business environment by the use of
good architectural concepts.
3) Whether the proposed construction cah be classed as
a major alteratimi or not, this application should
have the same ca,r-eful consideration that would be
given to a new building.

in February of 1968 plans were approved for the construction
of the Twin Lake North Apartment project which consists of 23
apartment buildings housing 2 76 living units, Detail site and
building plans for the proposed recreation building had not
been developed at that tthme and therefore were not part of the
approval.
An application for site and building plan approval has now
been submitted for a wood frame structure about 9,000 square
feet in area which the applicant consi.deres to be an accessory
building. The building is proposed to Douse a 241 x 601 indoor
swimming p6ol, party room, card room, kitchen, shower_ rooms,
sauna baths, toilet rooms, offices and one complete living unit:.
Section 35--314 (R-5 Multiple Family Residence Districts)
permits accessory uses which are i.ncidentcal to the principle
uses when located on the carne property with the use to which
it is accessory. The proposed building site is a separate
parcel, known as "Outlot A" and is situated in the approximate
center of the complex with the proposed R--3 townhouse area on
the east and the R-5 multiple residence on the west. side. With
the lot located as it is, I thinly it can safely be considered
a part of the total development and not something that could be
sold or used for rather purposes.
The points at which the proposed use is at variance with
the zoning and building ordinances are as follows:
1) A single family dwelling unit is riot a peratitted
use in either It-3 or A-5 zoning district. The
applicant wishes to call the living unit a "quest house"
for the use of friends or relatives visiting the
occupants of the townhouse or apartments. The
zoning ordinance does not comprehend the use of
"guest houses" or separate dwelling units as an
incidental. or accessory- use in any district.

2) Without information to the contrary, it is possible
that there will be a charge for the use of the
dwelling unit and than it will be rented to the
guests,, temporarily or permanently. she use of
the term "guest" when used to designate a
visitor in one's home generally means a person
to whoa the hospitality of the home, club, etc. is
extended without pay. if the recreation building and
all its features are not available to the tenants on
an equal basis, the use is not incidental to the
permitted or principle use and io therefore not an
accessory use.
3) The access; to the recreation building will be
limited to pedestrian traffic with a fare lane
type of vehicular driveway from the apartment
house parking lot. The zoning ordinance
(sec. 35-520) requires that every parcel, of land
a proposed for some permitted use shall abut a
public right-of-way, unless the City Council
should approve a reasonable alternative.
