POINTS TO BE CONSIDERED,- 1) Section 35-2'140. 2 Si-,-,,andards for Variances 5520 Lyndale Avenue North Minneapolis, Minnesota 55430 March 27, 1970 City Planning Comadfssion. 7100 Osseo Road Brooklyn Center, Minnesota Gentlemen: It was my understanding that the Engineering Department, Commission of Public Works at Brooklyn Center had recommended to the City Council that they acquire a small Portion of Lot 14, Garcelon's Addition to 14inneapolist at 55th and Lyndale which adjoins the Brooklyn Center Lift Station and to be included therein was our request for a variance on two building permits for single family dwellings on Lots 12, 13 and 14. In any event, the following is submitted for your information: We are applying for variances on Lots 12, 13 and 14, Garcelon's Addition to Minneapolis for two permits for • single family dwellings because of the existing set back, the topography of the land and width of the property. As can be verified with the Engineering Department, it has been impossible to apply for variances sooner as we have been waiting for quite some time to receive an indication from Brooklyn Center as to their intentions concerning Lot l4 and the acquisition of a part thereof which the city has been using as ingress and egress from the lift station. It is my understanding that the city requires only a very small portion of Lot 14 and the overall square footage of the remaining land would meet the building code requirements if variances were granted. We have a potential buyer for Lot 21 and part of 13 if the city would be willing to grant two permits to subdivide the property in almost the same manner as shown on the attached copy of a survey made. The two single family dwellings would run in the neighborhood of approximately $30,000 each and would be similar in nature and square footage on each floor to the house which now stands on lot 10. The lots in question, as they now stand, is an eyesore to the neighbothood, over grown with weeds and other debris and two 'homes would certainly enhance the value and add to the surrounding area. • We feel that a hardship exists here since we -were only able to buy all three lots in a package deal from the previous owner, and since the City recmilres only a minimal amount, this leaves u3 with a good deal of riverfront property which we cannot build on -2- without obtaining the variances. Brooklyn Center has acntinued to use part of our property over a year since put on notic'..*-, by registered mail not to trespass or advise if they were interested in a portion thereof. We feel we have been extremely pEltient in allow-Lag the city so much time. In addition, we feel. th'.it a variance should be allowed in view of the fact that the property is of little or no value to us without a building permit.
