Excerpt from the mUnutes of the Planning Commission
Meeting of May 7, 1970.
"The next item of business was Application No. 70013 sub-
mitted by Byron Dunkley requesting a variance on lot depth
and front yard setback for Lots 12, 13 and 14, Garcelons
Addition, commonly described as being located on the east
side of Lyndale Avenue in the 5500 block.
Following an explanation by the Secretary, who explained
the deficiencies of lot depth, front yard setback, and some
inconsistencies in the land survey, Chairman Jensen called on
affected property ow ers notified of the public hearing who
generally indicated concern with the following:
1) concern lwitb cars that might have to back out an
to Lyndale Avenue;
2) The potential obstruction of the revier view;
3) That the granting of the variance would establish
a precedent;
4) That Byron Dunkley purchased the property without
investigating the zoning restrictions.
Motion by Bogucki and seconded by Nichols to close the public
hearing. The motion carried unanimously.
At this time (9;22 pj,4.) commissioner fitter arrived.
Motion by Nichols and seconded by Schuller, to table Appli-
cation -No. 70013 submitted by Byron DunItley, requesting a
variance, and take it under advisement. voting for the motion
were: Jensen, Schuller, and Nichols. Voting against: -- Bogucki.
not voting: bitter. (Commissioner Bogudki felt that this
application should be denied until the petitioner seeks profes-
sional architectural advice as to the unique design and
construction requirements of constructing a single family home
on the subject property.) he motion carried.
Excerpt from the min-rtes of the City Council meeting of
December 15, 1969.
• "The Council next considered Planning Cominission Appli!-ation
No. 69049 submitted by Peterson and Associates requesting a
special use permit for a nursing home which would be located in
the southeast corner of 55th and Bryant Avenues North. The City
Manager reviewed events relative to this applicationi%hereupon
mayor Cohen called upon the applicant, Mr. Peterson, for his
comments. There followed a discussion among the Council and
City staff and applicant on the merits of the proposed use and
the conflict with the collector street access requirement of
the ordinance.
Xt was agreed that there exists a social need for such nursing
homes and that there is merit in establishing such facilities in
Brooklyn Center. It was suggested that pos.44bly.—the colilecto.-C
street requirement was based on the assumption that nursing homes
are relatively large generators of traffic, and that such
assumption may not be accurate. it was also suggested that
there may be some benefits to be gained by examining the
relationships of occzpancy density and traffic generation
and size and bulk of structures to the neighborhood.
• After considerable discussion, mayor Cohen asked the applicant
if he would concur in tabling the application in order to allow,
the Planning Commission to research the matter of nursing hoines,.
The application concurred with the tabling action, whereupon
the City Manager recommended that the application should be
tabled until June 1, 1970.
Motion by JobAi Leanj and seconded by Theodore Willard to
table Api.Aication No. 69049 submitted by Peterson and Associates
until J,Ine 1, 1970, during which period the Planning Cormnission.

Voting in favor were: Philip Cohen, John Leary, Earl Rydberg,
Howard Heck and Theodore Wiliard. Voting agsint were: none.
