CALL TO ORDER
The Planning Commission meeting was called to order by Chair Burfeind at 7:10 p.m.
ROLL CALL
Chair Scott Burfeind, Commissioners Randall Christensen, Benjamin Freedman, Carlos Morgan,
and Stephen Schonning were present. Also present were Secretary to the Planning Commission
Tim Benetti, Director of Business & Development Gary Eitel, and Planning Commission
Recording Secretary Rebecca Crass. Commissioner Michael Parks was absent and unexcused.
APPROVAL OF MINUTES—NOVEMBER 14, 2013
There was a motion by Commissioner Morgan, seconded by Commissioner Schonning to
approve the minutes of the November 14, 2013 meeting. Motion passed unanimously.
CHAIR'S EXPLANATION
Chair Burfeind explained the Planning Commission's role as an advisory body. One of the

DISCUSSION ITEM — REVIEW PROPOSED 2014 COMMUNITY DEVELOPMENT
ACTIVITY MAP
Mr. Benetti reviewed the following projects from the 2014 Community Development Activities
and Projects:
• Maranatha— old nursing home is vacated and the residents have been moved to the new
facility. The old building will be demolished once environmental issues are resolved
with the removal of asbestos, etc.
• Residential lots near 69th and Brooklyn Boulevard — redevelopment opportunities are
being explored with the removal of several residential properties at the northwest corner.
• Luther Brookdale Volkswagen — old building has been removed in preparation for
construction of a new Volkswagen site. Luther has also purchased Atlantis Pool to create
a five acre site.
• Brooklyn Boulevard Market located at 69th and Brooklyn Boulevard — was previously
approved for a 6,700 sq. ft. commercial building but currently there is no activity on the
site.
• Luther Honda and Toyota Dealerships — consideration of EDA approved funds to make
improvements to fencing and screening.
• Embassy Phase 11 - site plan previously approved.
• Northport Elementary—completed third phase of five and are looking at improvements to
student drop off areas, playground and the parking lot.

• Howe Fertilizer—additional sampling taking place and the developer is working with the
Minnesota Department of Agriculture to clean up contamination on the site.
• Bridgeman's Brooklyn Boulevard Center — the City acquired the vacant lot at 63rd and
Brooklyn Boulevard and is planning for future development.
• Cars With Hearts Site — has been acquired by the city and will be combined with other
properties for future development.
• 6000 Brooklyn Boulevard — the City has acquired six lots and are working on the
remaining two for future development.
• 5700 Block of Brooklyn Boulevard — proposed redevelopment of upper half or entire
block which would require several acquisitions to create a desirable development.
• Opportunity Site — to assemble a desirable parcel, the city is acquiring the Brookdale
Square shopping center. The plan for a new development is similar to the Opportunity
Site approved in 2005 which includes a mixed use residential/commercial project.
OTHER BUSINESS—CHAIRPERSON ELECTION PROCESS
Mr. Benetti explained according to the Planning Commission By-Laws and a Resolution
Defining Duties and Responsibilities of the Planning Commission, an election must take place at
the first regular meeting of the new year, which is scheduled for January 16, 2014. He added the
Chairperson selects a commissioner to serve as the Vice-Chairperson as well. Mr. Benetti stated
the Commissioners may use this meeting to express their desire to serve as the Chair or Vice-
Chair for the 2013 Planning Commission.
Chair Burfeind stated it has been an honor to serve as the Chair and he is interested in continuing
as the Chair.
There was no other business.
ADJOURNMENT
There was a motion by Commissioner Morgan, seconded by Commissioner Christensen, to
adjourn the Planning Commission meeting. The motion passed unanimously. The meeting
adjourned at 7:50 p.m.

RE: Planning Commission Agenda Item No. 12 — Discussion of Proposed Ordinance
Amendments to Chapter 35-ZONING
Attached for the Commissioner's review is a copy of two separate ordinances, which provide for
certain amendments to Chapter 35- Zoning of the City Code of Ordinances. The Commissioners
may recall discussing these items at the August 15, 2013 regular meeting. Slight changes have
been made to the previous versions, and the Building and Community Standards Department
directors requested Planning Staff present these updated ordinances to the Planning Commission
for your additional input and recommendations.
The first ordinance proposes a new Section 35-400.1, which is titled "LOT COVERAGE AND
IMPERVIOUS SURFACES." As the title implies, the new language provides for a definition or
determination of"Impervious Surface," which is typically held to hard surfaces constructed with
or consisting of concrete, asphalt, and graveled/compacted materials. Pools and decks would be
considered exempt under this regulation, but not the impervious surfaces surrounding a pool.
The ordinance continues with specific standards or limits of these impervious surfaces for those
properties within the R1 One Family Residence Districts. The impervious surfaces (driveways
or parking areas in particular) are limited to no more than fifty percent (50%) of the front yard
areas. It further provides the overall lot coverage of impervious surfaces, including principal
dwellings, garages, sheds, driveways and patios, may not exceed fifty percent (50%) of the total
lot area.
It is interesting to point out that the new ordinance only targeted or identified the R1 District for
these new standards, when in fact a number of the existing R2 Two Family Residence Districts
contain a number of single-family dwelling units, particularly the large R2 Zoned area on the
south end of the city (Figure-1 below-between 55th and 53rd Avenues and Lions Park and I-94).

To reinforce these standards equally across the city, the Commissioners may wish to recommend
or consider applying these same standards to the R2 Zone Districts, and even the few planned
unit development districts that contain an underlying R1 (PUD/Rl) as part of their zoning.
The second ordinance proposes certain amendments (revisions) to Section 35-900
DEFINITIONS. These changes redefine the meanings or determinations of "Front Yards",
"Rear Yards" and "Side Yards". This ordinance also provides illustrations (Figures 1 — 6) for
added reference, which would be a first addition to our current Zoning Code. These new yard
definitions are being created to eliminate confusion over where vehicles can be legally parked or
stored in certain areas of the yards, and where trash containers and other regulated items can be
stored or maintained within residential lots.
The Commissioners may recall from the previous August 2013 presentation, and by the heading
notations of this same draft Ordinance, the City intends to modify Sections 19-102 and 19-103 of
the City Code. Chapter 19 is titled PUBLIC NUISANCES AND PETTY OFFENSES. Certain
amendments to these sections will specify new requirements for driveways; and the parking of
vehicles, recreational vehicles and trailers o residential properties. Because Chapter 19 is not
specifically related to zoning standards, the Planning Commission is not being tasked with
establishing a recommendation on these changes.
Upon the review and consideration of this new Section 35-400.1 and amendments to Section 35-
900, Planning Staff requests the Planning Commission formulate an official recommendation to
the City Council, which will be presented sometime in the near future. This presentation will
include a request to set a public hearing, and involves two (separate) official readings by the
Council. Should the Council accept or adopt these ordinances after the second reading, the
ordinances would become effective 30-days after publication in the Sun Post newspaper.

zoned areas for steps, stoops, ramps, landings, porticos, ramps, open decks, open or
closed porches, andlor similar.
Mr. Benetti explained the information provided to the Commission related to proposed ordinance
amendments to Chapter 35 regarding defining yards, adding a new section regarding
requirements for lot coverage and impervious surfaces and also allowing encroachments in front
yard setbacks for steps, stoops, ramps, etc.
Commissioner Christensen asked if pools would count towards the statement that `No more than
50 percent of the area of the front yard may be covered by an impervious surface' or `Lot
coverage of Impervious Surfaces may not exceed 50 percent of the lot area.' Mr. Benetti replied
that he would check into that and respond back to the Commission.
Mr. Benetti further reviewed the proposed amendment regarding the placement of waste
containers, specifically the requirement that all garbage cans may not be located in the front yard
area, cannot be visible from any public street and cannot be out before 4 p.m. the day prior to
pick up. Commissioner Christensen asked about the requirement that garbage cans be in the
garage or in an enclosure at least 48 inches from the main structure. Mr. Benetti replied the city
ultimately wants garbage cans moved into garages and not be visible from the street.
Commissioner Christensen pointed out some numbers from the city survey taken regarding
garbage can requirements. Mr. Benetti replied these issues had been studied for almost two
years and part of that process involved input from the residents.
Commissioner Christensen stated he wanted the minutes to reflect he is against the 48-inch
setback requirement and the screening requirement for waste containers.
Mr. Benetti continued by reviewing driveway parking area requirements as well as what types of
vehicles (recreational) can be parked in a residential area. He also reviewed a proposal regarding
non-conforming driveways and parking areas that are gravel and how they must be maintained.

AN ORDINANCE RELATING TO IMPERVIOUS SURFACE
COVERAGE ON RESIDENTIAL LOTS; ADDING NEW CITY
CODE SECTION 35-400.1
THE CITY COUNCIL OF THE CITY OF BROOKLYN CENTER ORDAINS AS FOLLOWS:
Section 1. Brooklyn Center City Code is amended by adding new Section 35-400.1 as follows:
Section 35-400.1. LOT COVERAGE AND IMPERVIOUS SURFACES.
1. For purposes of this section, "Impervious Surface" means a surface that allows very little
or no penetration of water or moisture into the soil or ground. Examples include
concrete, asphalt, and various compacted materials including aggregate, limestone and
recycled bituminous. Buildings, rooftops, patios and driveways and any other structure
shall be included for the purpose of calculating lot coverage. Exception: Pools and
Decks will not be considered when calculating lot coverage percentage. Impervious
surfaces surrounding a pool are included in calculating lot coverage percentage.
2. Lots in the R-1 District are subject to the following limits for Impervious Surfaces:
a. No more than 50 percent of the area of the front yard may be covered by an
Impervious Surface.
b. Lot coverage of Impervious Surfaces may not exceed 50 percent of the lot area.
Section 2. This Ordinance shall become effective after adoption and upon thirty (30) days
following its legal publication.
