CHAIR'S EXPLANATION Acting Chair Rahn explained the Planning Commission's role as an advisory body. One of the Commission's functions is to hold public hearings. In the matters concerned in these hearings, the Commission makes recommendations to the City Council. The City Council makes all final decisions in these matters. DISCUSSION ITEM — PROPOSED ORDINANCE AMENDMENTS TO CITY CODE CHAPTER 35 (ZONING) Mr. Benetti explained he met with the City Attorney today regarding the language in the proposed ordinance amendment and he would like some additional time to review the language and offer suggestions before being considered by the Commission or City Council. He further explained he would like the Commission to review only the graphics tonight for input until the City Attorney has reviewed the proposed ordinance amendment further. He added the new yard definitions are being created to eliminate confusion over where vehicles can be legally parked or stored in certain areas of the yards and where trash containers and other regulated items can be stored or maintained within residential lots. SECTION 35-900 (DEFINITIONS) REGARDING THE REDEFINITIONS OF "FRONT YARDS". "REAR YARDS"AND "SIDE YARDS". Mr. Benetti described the proposed ordinance amendment to Section 35-900 DEFINITIONS and stated these changes redefine the meanings or determinations of "Front Yards", "Rear Yards" and "Side Yards". He reviewed various graphics and described how these definitions would affect vehicle parking and placement of garbage storage containers. Commissioner Christensen asked for details regarding what would constitute proper screening. Mr. Benetti explained the Planning Commission is only looking at defining front, rear and side yards. He added the City Council will more clearly define proper screening. Commissioner Morgan asked how many properties have violated ordinances related to this topic. Mr. Benetti explained there is no number available but numerous complaints are received regarding parking on the grass and the locations of garbage containers. Chair Burfeind stated he would rather see garbage cans located next to the house if screened rather than alongside the garage on the shared property line. There was further discussion by the Commissioners regarding various lot layouts, the proposed yard definitions and if existing uses would be grandfathered and allowed to remain. Chair Burfeind stated he feels the proposed layouts and definitions are clear and make sense. Page 2 1-30-2014 Y Mr. Benetti stated once the new language being drafted by the City Attorney is complete, the Commission will be provided with an opportunity to review it before it goes to the City Council. Commissioner Burfeind asked what other designations these definitions apply to. Mr. Benetti responded it also applies to setbacks for structures since there are certain items not allowed in the front yard that are allowed in the back yard. Commissioner Schonning stated one of his neighbors has an unusual yard and most of these definitions do not apply to his layout. DISCUSSION ITEM — CONTINUED DISCUSSION OF THE REDEVELOPMENT WITHIN THE SOUTHERN PORTION OF THE OPPORTUNITY SITE (BROOKDALE FORD & BROOKDALE SQUARE MALL SITES) Mr. Eitel provided examples of a mixed housing use project recently built in another community that might work in the Opportunity Site. He also described other possible buildings that could be located on the site. There were no other discussion items. OTHER BUSINESS Chair Burfeind stated there is an upcoming grand opening at Best Western and all are invited to attend. There was no other business. ADJOURNMENT There was a motion by Commissioner Morgan, seconded by Commissioner Schonning,to adjourn the Planning Commission meeting. The motion passed unanimously. You may recall staff initially presented this item to the Planning Commission at the January 24, 2014 meeting. Due to the level of high-end or market rate housing that is being proposed in this site, we felt it would be best to engage the Housing Commission in early discussions on this site to receive a broad range of feedback, including suggestions, concerns and/or recommendations, and forward any comments or recommendations to the City Council as needed. For the benefit of the Housing Commission, staff is providing this brief background information regarding this area: The Opportunity Site Study Area is an area of approximately 100 acres that lies north of Bass Lake Road, east of Shingle Creek Parkway, south of Summit Drive and west of State Highway 100. In the early 2000's, the Metropolitan Council included this area in a Regional Study (the "2002 Calthorpe Study') which facilitated a comprehensive approach to community planning that focused on transforming underperforming retail areas into vibrant mixed-use neighborhood destinations. In the winter of 2004, Team Brooklyn Center, led by Damon Farber Associates was commissioned by the City of Brooklyn Center to lead an eight member community task force to prepare a master plan, a set of design guidelines, zoning amendments, and a request for proposal for a phase one developer. In 2007, the City began its process of updating its Comprehensive Plan. The Land Use element of the 2030 Comprehensive Plan was amended to provide for a mixed land use of residential, office, retail business, and public & semi-public uses. Appendix B of the 2030 Comprehensive Plan (attached for review)provided and overall review of the Opportunity Site Master Plan and Development City Hall Community Center Police&Fire Departments 6301 Shingle Creek Pkwy 6301 Shingle Creek Pkwy 6645 Humboldt Ave N Brooklyn Center,MN 55430-2199 Brooklyn Center,MN 55430-2199 Brooklyn Center,MN 55430-1853 763-569-3300 Fax:763-569-3494 763-569-3400 Fax: 763-569-3434 763-569-3333 Fax: 763-561-0717 Guidelines and acknowledged the fiscal challenges of land assemblage and economic viability of implementing the plan given the current market conditions. In 2008, the EDA acquired the former Brookdale Ford Site, the southern 8.4 acres of the Opportunity Site fronting on Bass Lake Road. The buildings were demolished during the summer of 2008 and numerous attempts to work with the adjacent property owner were made to pursue redevelopment opportunities of the combined properties as a premier 32 acres site. As part of the recent strategic planning efforts, the Opportunity Site has been identified as three unique areas: • The Northern Area: the 23.67 acres lying north of John Martin Drive and west of Summit Drive, anchored by Target. • The Eastern Area: the 12.78 acres lying east of John Martin Drive, south of Summit Drive and adjacent to Highway 100, anchored by the former K Mart Building. • The Southern Area: the 47.36 acres lying north of Bass Lake Road and south of John Martin Drive, anchored by the EDA properties (the former Brookdale Square and Brookdale Ford sites) The second item on the agenda is a scheduled verbal update from Planning Staff of three select areas noted on the City's Community Development and Project Activities Map of 2014 (included herein). Staff is choosing to provide an update on the Industrial Park/Palmer Lake Plaza improvements; the Humboldt Avenue Corridor area (specifically, the Humboldt Avenue Condo Association acquisition by Gary Brummer, etal); and the Shingle Creek Crossing Redevelopment Project, specifically updates on new Buildings b, Buildings D and the Food Court removal and redevelopment. Other area updates will be forthcoming at future Planning Commission meetings. if you have any questions or concerns prior to the meeting, feel free to contact Gary at (763.569.3305) /email: eg itel(aci.brooklyn-center.mn.us or Tim at (763.560-3319) / email: tbenettikci.brookl-yn-center.mn.us.
