RESOLUTION NO. 2008-29
RESOLUTION AMENDING CITY COUNCIL CODE OF POLICIES SECTION
2.30: POLICY FOR PUBLIC UTILITY ACCOUNT COLLECTIONS
WHEREAS, in cases where water service is shut off at the curb stop for a
residential property, the existing City Council Code of Policies indicates that quarterly utility
rates will not be charged for water, sanitary sewer, or recycling when water is shut off; and
WHEREAS, the City Utility Funds continue to incur costs for providing access
to these utility services even when water is shut off at the curb stop; and
WHEREAS, it is appropriate that a basic charge for access to utility services be
charged while services are available to a property by virtue of being connected to the City's
water and sanitary sewer systems; and
WHEREAS, the sanitary sewer system rates should be amended to provide for a
rate reflecting payment of the basic cost of being connected to the City's collection system.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that Section 2.3 0, Subdivision 5.D.1 be amended to read as follows:
The property owner must complete and sign a City form requesting and authorizing the
shut-off or provide an equivalent written request. Billing for water, sanitary sewer, storm
drainage, street light service district, and recycling program will continue;
a. at the minimum rates designated in the City's utility rate schedule while
the water is shut off for a period of one month or more; or
b. at the regularly scheduled rates when water is shut off for less than one
month.
BE IT FURTHER RESOLVED that Resolution No. 2007-141, Resolution
Adopting 2008 Sewer Utility Rates, Fees and Charges, be amended to include a Residential
Water Shut Off Rate of $9.40 per quarter when water is shut off at the curb stop for at least one
