EDA RESOLUTION NO. 2015-05
RESOLUTION DESIGNATING BUILDINGS AS STRUCTURALLY
SUBSTANDARD (OPPORTUNITY SITE)
WHEREAS, under Minnesota Statutes, Section 469.174, subd. 10(d), the
Economic Development Authority of the City of Brooklyn Center, Minnesota ("Authority") is
authorized to deem parcels as occupied by structurally substandard buildings despite prior
demolition or removal of the buildings, subject to certain terms and conditions as described in
this resolution. and
WHEREAS, the Authority previously acquired the property described in
Exhibit A hereto (the "Designated Property") and intends to cause demolition of 7 buildings
located on that property; and
WHEREAS, the Authority may in the future include the Designated Property in
a redevelopment or renewal and renovation tax increment financing district as defined in
Minnesota Statutes, Sections 469.174, Subd. 10a, respectively, and to that end has determined to
designate 6 existing buildings on the Designated Property to be substandard prior to demolition.
NOW, THEREFORE, BE IT RESOLVED by the Economic Development
Authority in and for the City of Brooklyn Center as follows:
1. The Authority finds that 7 buildings located on the Designated Property as described in
Exhibit A are structurally substandard to a degree requiring substantial renovation or
clearance, based upon the analysis of such building set forth in the "Report of Inspection
Procedures and Results for Determining Qualifications of a Tax Increment Financing
District as a Redevelopment District," dated March 3, 2015, prepared by LHB, Inc. on
file in City Hall.
2. After the date of approval of this resolution, 7 buildings on the Designated Property may
be demolished or removed by the Authority, or such demolition or removal may be
financed by the Authority, or may be undertaken by a developer under a development
agreement with the Authority.
3. The Authority intends to include the Designated Property in one or more redevelopment
or renewal and renovation tax increment financing districts, and to file the request for
certification of such district(s) with the Hennepin County auditor within 3 years after the
date of building demolition on the Designated Property.

4. Upon filing the request for certification of the new tax increment financing district(s), the
Authority will notify the Hennepin County auditor that the original tax capacity of the
Designated Property must be adjusted to reflect the greater of (a) the current net tax
capacity of the parcel, or (b) the estimated market value of the parcel for the year in
which the buildings were demolished or removed, but applying class rates for the current
year, all in accordance with Minnesota Statutes, Section 469.174, subd. 10(d).
5. Authority staff and consultants are authorized to take any actions necessary to carry out
the intent of this resolution.

The motion for the adoption of the foregoing resolution was duly seconded by Commissioner
Kris Lawrence-Anderson
and upon vote being taken thereon, the following voted in favor thereof:
Tim Willson, April Graves, Kris Lawrence-Anderson, and Lin Myszkowski;
and the following voted against the same: none;
whereupon said resolution was declared duly passed and adopted.
